This sign will be used for a variety of messages, both public service emergency and non-emergency as well as Crozet FD messages. Background • Electric Message Signs (EMS)are allowed only by Special Use Permit. • No specific criteria applicable to this use. Legislative intent was to make sure the EMS was not in a location that would distract drivers or be done in a distracting way. • Criteria for special use permit review is applicable. (. This is a special permit use because it is not appropriate in all locations without any conditions or restrictions. For example, a flashing EMS or an EMS which shows an entire video would be distracting on a high-speed highway especially where traffic is not being stopped by a stoplight. 9 ARB Review •Applicant has been working with the ARB as they have developed design criteria for EMS. • On April 18th, the ARB approved this application subject to conditions. These conditions are largely relating to notes on the plan. • The Crozet VFD has been working on this proposal for about 2 years. They've worked directly with Margaret M and the ARB as they've developed design criteria for EMS. The FD has provided sign manufacturers and consultants with EMS signs for some of that ARB deliberation on the design criteria. • The ARB design criteria include specifications relating to a) frequency of message change (to avoid flashing and other distracting quick changes); b) brightness; c) text size; d) color choice and the like. • On April 18th, the ARB conditionally approved this application and did not object to the special use permit. 10 Special Use Permit Criteria ..No substantial detriment to adjacent lots—This proposal introduces an illuminated changing message sign. To address impacts on an adjoining house about 150 feet away, staff recommends the applicant either obtain a letter of no-objection or take measures to limit the visibility. 2.Character of district unchanged—with the sign as proposed and subject to the ARB design criteria, staff is of the opinion the character of the district is unchanged. Because this application introduces a new illuminated sign (although not flashing), we are concerned there could be a new impact on those residents. Harmony—staff is of the opinion the proposal as recommended, is in harmony with the applicable zoning regulations and the public health, safety and welfare. 4.Consistency with the Comprehensive Plan—staff is of the opinion that the proposal subject to the ARB design criteria, is consistent with the Comprehensive Plan. • This application is consistent with applicable zoning regulations. • Subject to the proposed conditions and the ARB design criteria, it is our opinion that this application is consistent with the Comp Plan. 13 Staff Recommendation Staff recommends approval subject to the following conditions: �. This permit is limited to one (1)freestanding sign. 2. Unless the sign is oriented so as to directly face the road, measures are necessary to limit the impact on adjoining residential property. Prior to approval of the building permit to erect the sign, the applicant shall obtain Zoning Administrator approval of either a)letters of no objection from the owners of parcels 43 and 44 or b)a landscape plan or other measures designed to screen the sign from parcels 43 and 44. 3. The sign shall comply with approval of the certificate of appropriateness. • Condition #1 just clarifies that you would be approving their proposal and not a wall sign or multiple signs. • Condition #2 is crafted to address visual impact on adjacent properties. As proposed, the sign will face adjacent properties (be perpendicular to the road). This condition is intended to either a) find there's no objection or b) provide options the applicant can use to address the visual impact. • I want to explain why condition #3 is included because Greg advises us to not condition what is otherwise an ordinance requirement. Absent specific ordinance criteria for this type of sign (EMS), the ARB design criteria address specifications that allow it to meet the criteria for issuance of a special use permit.
