When we worked with Megan on the rezoning amendment review we discussed generally the fact that we would need easements from the Fire Company for the work and improvements that would take place or be located within the Fire Company property, and that we would be hooking the Fire Company up to the public system as part of our first phase. We also discussed with Megan the need from early on in the rezoning to have the Fire Company approve our submittal of the rezoning amendment application, and at that time they started engaging us on the terms of any future easements. We had a lengthy back and forth with them on general easement terms and compensation requirements before they would agree to sign the landowner authorization form,and I kept Megan in the loop on that generally throughout the process,for at one point we were up against a tight deadline to get the form submitted to Megan or we would have to defer continued County staff review of the rezoning amendment. That was in April,2014. A copy of a letter is attached that was generated and sent to ERVFC at the time and provides a bit of flavor. We always knew that the ultimate easement agreement would be subject to the County's review and approval, but we couldn't even get to the first step with ERVFC on the rezoning unless we committed up front to certain compensation for the future easements. Enclosed is a copy of a landowner authorization form that complies with the County's requirements for demonstrating that the East Rivanna Volunteer Fire Company ("ERVFC") consents to its property being included in the rezoning amendment. We ask that an authorized member of your Board execute the authorization form, and we will make arrangements to obtain the signed statement from you as soon as possible. We hereby acknowledge and agree that the ERVFC's execution and delivery of the authorization form is made solely for purposes of confirming ERVFC's consent to include the ERVFC property in the Rivanna Village application and to permit the County's review of the application to continue, and that such execution and delivery in no way obligates or commits the ERVFC on any other issues, including,without limitation,negotiations on the easements and matters related thereto that we discussed in our meeting yesterday. For our project to stay on the current review schedule,we must deliver an original executed authorization statement to the County staff no later than Monday, April 15th.
