Subject: SUB -2016-86 Holloway/Graham-Meyer - Boundary Line Adjustment
The County of Albemarle Planning Division will grant or recommend approval of the
Final Plat referenced above once the following comments have been addressed: [Each
comment is preceded by the applicable reference, which is to the Subdivision/Zoning
Ordinances unless otherwise specified.]
Please note that these comments are an updated version of first round comments.
1. [14-301 (D) & 14-302 (13)(1)] Approximate North; General Information. Update
north arrow so that it is pointing to the north.
2. [14-302 (A)(10)] Right of further division of proposed lots. Provide notes that
specify the right of further division for both TMP63-33 and TMP63-33C. See the
Boundary Line Adjustment Plat Checklist for the wording of the note. On your
plat you need to note what the development rights will be after the plat is
recorded. Therefore you need to include development rights notes for TMP 63-
33C, TMP 63-33, Parcel X and Parcel Y. If no development rights are
transferred from TMP 63-33 to TMP 63-33C with Parcel X and Parcel Y that
needs to be stated. Please see the Boundary Line Adjustment checklist for
wording of these notes.
The 1979 Tax Map shows that TMP 63-33C existed and was the same shape as
it is today. However, it is and was 3.00 acres. Therefore TMP 63-33C only has
one (1) development right. The 1979 Tax Map shows that TMP 63-33 was
larger than it is today. It would have had 5 development rights in 1979 but one of
those development rights was given to TMP 63-33D when that parcel was
created. Deed book 1128 page 636 note #4 on the plat specifies that four (4)
development rights remained with the residue, which was TMP 63-33.

An informal assessment (free & takes up to two weeks) of development
rights or an official Letter of Determination of Development Rights ($100
& may take 30 to 90 days) can be requested when development rights
are unknown. The Citizen's Guide to Development has information on
how to determine the number of development rights and the last page
includes information on how to request an informal or official

3. [14-302 (A)(15)] Identification of all owners and certain interest holders. In
"Property standing in the name of:" area provide name of the Graham Meyer
Living Trust that owns TMP 63-33C and then list the names of the trustees under
the trust's name.
4. [14-302 (13)(5)] Zoning. Update the zoning note to specify "RA" zone.
5. [14-302 (13)(10)] Stream Buffers. Provide the location of the stream buffer that is
required by the water protection ordinance and include a note that states "The
stream buffer(s) shown hereon shall be managed in accordance with the
Albemarle County Water Protection Ordinances."
6. [14-303 (A) & 14-303 (0)] Statement of consent to division. Separate the Owners
approval into two separate approval areas, one for each lot. Under Robert A.
Graham's and Jennifer A. Meyer's name's specify that they are trustees of the
Graham Meyer Living Trust.
7. [14-303 (H)] Monuments. Provide either I.F. or I.S. labels, based upon their
status, to the two monument location 20 feet off the center of Lonesome
Mountain Road Route 610).

1. 114-301 (D) & 14-302 (B)(1)] Approximate North, General Information. Update
north arrow so that it is pointing to the north.
2. [14-302 (A)(4)] Private easements. If there are any private easements within the
two properties show them and include the width, deed book, page number and
owner of the easement.
3. [14-302 (A)(5) & 14-303 (L)] ] Public easements, Public utility, drainage and sight
distance easements. If there are any public easements within the two properties
show them and include the width, deed book, page number and owner of the
easement. This included any electric or telephone easements. If the precise
location is unknown add a note stating the existence of the easement, its width,
the owner, and the deed book and page number.
4. [14-302 (A)(10)] Right of further division of proposed lots. Provide notes that
specify the right of further division for both TMP63-33 and TMP63-33C. See the
Boundary Line Adjustment Plat Checklist for the wording of the note. An official
Letter of Determination of Development Rights can be requested if the
development rights are unknown. The Citizen's Guide to Development has
information on how to determine the number of development rights and the last

5. [14-302 (A)(11)] Instrument creating property proposed for subdivision. Provide
the deed book and page number for both the deed that transferred the parcels to
their current owners and the plat that created the parcels. Deed book 3567 page
217 is the instrument that transferred TMP 63-33C to the trust, but it did not
create the parcel. Deed book 1128 page 636 is the instrument that subdivided
TMP 63-33D from TMP 63-33, but it did not transfer the parcel to the current
owner.
6. [14-302 (A)(15)] Identification of aII owners and certain interest holders. In

7. [14-302 (13)(4)] Places of burial. Confirm that there are no burial sites within the
portions of TMP 63-33 being added to TMP 63-33C.
8. [14-302 (13)(5)] Zoning. Update the zoning note to specify "RA" zone.
9. [14-302 (13)(10)] Stream Buffers. Provide the location of the stream buffer that is
required by the water protection ordinance and include a note that states "The
stream buffer(s) shown hereon shall be managed in accordance with the
Albemarle County Water Protection Ordinances."
10. [14-303 (A) & 14-303 (0)] Statement of consent to division. Separate the
Owners. approval into two separate approval areas, one for each lot. Under
Robert A. Graham's and Jennifer A. Meyer's name's specify that they are
trustees of the Graham Meyer Living Trust.
11. [14-303 (C) & (E)] Boundary lines, Dimension standards and information on all
lots, streets, alleys, easements, and shared driveways. Provide the bearing and
distance for the existing parcel line that is labeled "old line".
12. [14-303 (E)] Dimension standards and information on all lots, streets, alleys,
easements, and shared driveways. If any private or public easements exist
provide all linear, angular and/or curvilinear dimensions. Identify easement
holder(s) on the plat.
13. [14-303 (H)] Monuments. Provide either I. F. or I.S. labels, based upon their
status, to the two monument location 20 feet -off the center of Lonesome
Mountain Road (Route 610).
14. [14-303 (P)] (Votary panels. Place the notary panels below the owner for whom
they are witnessing. Also, it appears you are using a notary panel which is not
current. Updat the notary panel.
