Bolen, Commissioner Department of Conservation and Economic Development - Division of Parks 1201 State Office Building Capitol Square Richmond, Virginia 23219 Re: SP-78-05 VEPCO TOWER on Bear Den Mountain - Your letter of April 14, 1978 Enclosed: Board of Supervisors conditions of approval - March 15, 1978 VEPCO proposal to satisfy conditions - April 10, 1978 Dear Mr. Bolen: On March 15, 1978, the Albemarle County Board of Supervisors approved the above- referenced microwave tower subject to seven conditions, one of which was "staff approval of fence and landscape screening around tower to discourage trespass." On April 12, 1978, in phone conversation, Mr. Lemmon stated that neither the Virginia Division of Parks nor the National Park Service endorsed landscaping of the site due to barreness of the area, etc. I indicated to Mr. Lemmon that I interpreted the Board's action in requiring landscape screening to be for the purposes of minimizing visual impact in the area and to prevent trespass. Since, in the opinion of the Virginia Division of Parks and the National Park Service, such screening would be obtrusive and would be contrary to the purpose of minimizing visual impact, the staff would not require landscape planting. However, we did agree, as I recall the conversation, that fencing of a limited area around the facility would not be detrimental. Therefore, such fencing as described by VEPCO and shown on the attached plan shall be required for the purpose of discouraging trespass. Staff opinion is that this measure will suffice the Board's condition. .., On that same day, April 12, 1978, under the assumption that these concerns were resolved, I notified the Building Inspections Department that VEPCO's proposal for satisfying the Board's conditions of approval was satisfactory and that a building permit could be issued. The building permit is expected to be issued in the next few days. Mr. Ben H. Bolen, Commissioner April 18, 1978 Page 2 The Planning staff cannot waive the conditions of approval imposed by the Board of Supervisors on a special use permit. At this time, the staff opinion is that the applicant, VEPCO, has provided an adequate scheme to satisfy these conditions so that this project may proceed. Should the Virginia Division of Parks or the National Park Service choose to pursue the deletion of fencing for this project, the most appropriate approach would be to request the Albemarle County Board of Supervisors to recall and reconsider its previous action in respect to Special Use Permit 78-05. Graves 1719 Hydraulic Road Charlottesville, Virginia Re: BOARD OF SUPERVISORS ACTION SP-78-05 Dear Mr. Graves: This is to advise you that the Albemarle County Board of Supervisors at its meeting March l5, 1978, approved your request for SP-78-~5. subject to the following conditions: \ ~ 1. Staff approval of fence and landscape screening around tower to discourage trespass; 2. Tower shall be removed within 90 days of abandonment, if such shall occur; 3. Equipment shed, tower and antennae t~ be camoflauged with painted pattern or painted solid color appropriate to surroundings, if permitted by FAA; 4. FAA approval of tower; 5. Enlargement shall require amendment to this special permit; 6. Tower and equipment shall not be located within Virginia State Parks Scenic easement; 7.
