Dear Mr Schmick
rhis is to advise you that the Albemarle County Board of Supervisors at its
meeting January 3, 1 c179, approved your request for boating, canoe , livery,
recreational activit) and dock area for portage on l4 5 aces zoned A-l subject
to the following ccnditions
1 Site plan apprcval including among other requirements
(a) Statement from County Engineer that the applicant's proposal for
securing c:nd anchoring all structures and portable items
related tc the use are reasonably adequate to insure that the
same will not be carried off-site in the case of flooding;
(b) Signed stc.tE!ment by the applicant and property owner that they
have read and are in full understanding and agreement with
Section 9]-:;-7 and Section 9A-7 of the Zoning Ordinance;
(c) The site plan may include a dock;
2 Use permitted under this permit be limited to existing structures on
the site and any proposed docks may be approved under item "1 (c) " ;
3 Should any struc1:ure be damaged beyond limits of restoration as provided
in Section 9A-~I, the Zoning Administrator may require immediate removal of
the damaged structure, if in the opinion of the Zoning Administrator the
same may be ha.:a:~dous to downstream property owners or the public in general

Dear Mr. Schmick:
This is to advise you that the Albemarle County Planning Commission at its meeting
December 12, 1978, by unanimous vote, recommended the above item to the Board of
Supervisors for approval with the following conditions:
1. Site plan approval including among other requirements:
a) Statement from County Engineer that the applicant's proposals for securing
and anchoring all structures and portable items related to the use are
reasonably adequate :to ±nsure that the same will not be carried off-site in
the case of flooding;
b) Signed statement by the applicant and property owner that they have read and
are in full understanding and agreement with Section 9A-5-7 and Section 9A-7
of the zoning ordinance:
c) The site plan my include a dock;
2. No canoe is to be rented without an adequate number of floatation devices for the
occupants;
3. Should any structure be damaged beyond limits of restoration as provided in
Section 9A-9, the Zoning Administrator may require immediate removal of the damaged
structure, if in the opinion of the Zoning Administrator, the same may be hazardous
to downstream property owners or the public in general.
This item will be heard by the Board of Supervisors, Wednesday, January 3, 1978, 7:30
p.m. , County Courthouse, Charlottesville, Virginia. YOU OR YOUR REPRESENTATIVE MUST
BE PRESENT FOR THIS MEETING.

STAFF REPORT
SP-78-74 Jeff Schmick
Request: Canoe livery and dock (2-1-15(A) ; 9A-1-2; 9A-4-2)
Acreage: 14.5 acres
Zoning: A-1 Agriculture with Flood Plain overlay
Location: Property, described as Tax Map 136, Parcel 12, is located on the James River
at Hatton.
Character of the Area
The Hatton ferry and C & 0 railroad are in this area. The standard project flood level
is about 14 feet above ground level at the existing structures under consideration.
Staff Comments
The Engineering Department has made field inspection of this property and has stated
opinion that the existing structures are in the flood fringe (see attachment) . Staff
recommends approval subject to the following conditions:
1. Site plan approval including among other requirements:
a) Statement from County Engineer that the applicant's proposals for securing and
anchoring all structures and portable items related to the use are reasonably
adequate to insure that the same will not be carried off-site in the case of
flooding;
b) Signed statement by the applicant and property owner that they have read and are
in full understanding and agreement with Section 9A-5-7 and Section 9A-7 of the
Zoning Ordinance, to be submitted with site plan;
