Dear Mr. Greene:
Bohler Engineering is pleased to submit on behalf of Avon Holdings LLC, the revised WPO Landfill
Capping Plan for the proposed 5th Street Station at 5th Street SW & Avon Street Ext. in Charlottesville,
VA. The following is our comment response letter addressing comments received from you dated March
4, 2015. Each comment is addressed and responded to as follows:
Stormwater Pollution Prevention Plan(SWPPP)
Comment 1: The SWPPP content requirements can be found in County Code section 17-405. A
SWPPP must contain(1)a PPP, (2)an ESCP,(3)a SWMP,and(4)any TMDL measures
necessary.
Response 1: Comment noted.
Comment 2: The existing on-site SWPPP for this project will be updated upon final approval of this
project submittal.
Response 2: Comment noted.
Pollution Prevention Plan(PPP)
Comment 1: The PPP content requirements can be found in County Code section 17-404.
Response 1: Comment noted.

Stormwater Management Plan(SWMP)
Comment 1: VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or
disapprove a SWMP. This plan is disapproved, and the reasons are provided in the
comments below. The stormwater management plan content requirements can be found
in County Code section 17-403.
Response 1: Comment noted.
Comment 2: Exiting conditions shows the stormwater system installed with inlet protection. This plan
cannot be implemented until the pipes are installed and deemed functional by the County
VSMP Inspector.
Response 2: Per discussion, a"Phase P" Plan has been added showing the grading pulled back so that
the existing sediment traps can be utilized as an erosion and sediment control measure.
Please see Sheet 5.
Comment 3: Please state the WPO #201300079 in the SWM portion of the Narrative for future
reference.
Response 3: Comment noted.The SWM portion of the narrative has been revised.Please see Sheet 7.
Erosion and Sediment Control Plan(ESCP)
Comment 1: Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an
ESCP. This plan is disapproved, and the reasons are provided in the comments below.
The erosion control plan content requirements can be found in County Code section 17-
402.
Response 1: Comment noted.
Comment 2: The existing conditions and proposed site work appears to show future road and
stormwater conveyance system that have not been installed at this time. The approval of
this plan will be contingent on the installation of the infrastructure as depicted.
Response 2: Comment noted. As discussed, the plan was revised to reflect the phasing intent of the
placement of fill in the focus area. Please see Sheets 4-5.
Comment 3: Silt fence does not appear adequate to protect the site during construction.
Response 3: Per discussion, the site shall be wrapped with super silt fence during construction, as well
as utilize existing sediment traps.
Comment 4: The narrative states the site will be active for over 9 months. The Board of Supervisors
will need to grant the extended duration of operation per 17-808.B.2 of the County Code.
Response 4: Comment noted.An extension will be applied for at that time.

Comment 5: Existing sediment traps should be clean/rehabbed and utilized for this project until such
time as the fill operation requires them to be filled and stabilized.

Per our conversation, attached is the final report. As noted below, I confirmed that the roadway section analysis
included the full limits of the profile, including the toe. The critical surface is reflected in the plot provided and does not
pass through the toe of the slope. A statement to that effect is provided in the attached report, in the paragraph above
that stating the results of the analyses. We have also included the additional report sections from the original which
provide detailed recommendations for pond related site work. The report also reflects today's date,to avoid confusion
with that provided last week.
As we discussed,we understand that you will not provide a formal approval letter limited to the slope analysis, as it will
be included as part of the broad DEQ component. However, a brief email response confirming that the attached report
meets your requirements regarding the slope stability portion of this process would be much appreciated.

Grant,
I have two comments about the report.
1. The slope stability for the roadway: Based on the graph, the toe of the failure surface is in the middle of
the slope because of restriction was set in the middle of the slope. Have you run a case to extend the
failure surface to the toe of the slope?
2. The revised report seems short than the original report. By comparing the table of contents for both
versions. lots of the sections in the original report were deleted. Are you sure those sections are not
needed?

Per our discussions earlier this week,attached is a formal report with full analyses of critical sections for the pond and
roadway areas. Following our call yesterday, I got directly involved in the analysis and pulled in expertise, as
needed. The two critical analysis results are provided in the appendix. We analyzed both circular and sliding block
mechanisms and still have estimated strength parameters within conservative ranges. The corresponding factors of
safety are 1.79 for the pond and 1.61 for the roadway. Well above the industry standard minimum of 1.50.
