Perez, Senior Planner Division: Current Development Date: June 14, 2016 Subject: SUB201600101— Larsen - Family Division Fax 434-972-4126 The County of Albemarle Division of Current Development will grant or recommend approval of the Family Subdivision plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] 1. [14-316] Approval of entrance onto public streets. Prior to final plat approval submit documentation from VDOT that the entrance along State Route 635 complies with their standards for the number of lots served by the entrance. Please provide this documentation. 2. [14-212] Affidavit. Provide a completed, signed, and notarized affidavit verifying family relationship of grantor to grantee (attached). 3. [14-212(B)] Conditions of approval. The subdivider shall place a restrictive covenant on the lots created by the family subdivision. A template for this covenant is attached. County Attorney approval is required prior to final plat approval. 4. [14-317] Instrument evidencing maintenance of certain improvements. Provide a private street maintenance agreement for the proposed private street. A template for this agreement is attached. County Attorney approval is required prior to final plat approval. 5. [14-303(S)] Control Points. Provide at least 4 control points, evenly distributed across the property and located at survey property corners. At the option of the subdivider, the control points may be shown on a copy of the final plat, rather than the original signed/notarized version for recordation. 6. [14-302(B)10] Stream buffers. Provide the following note: "The stream buffer(s) shall be managed in accordance with the Albemarle County Water Protection Ordinance". 7. [14-302(B)7] Reservoir watershed/agricultural forestal district. Provide the following notes: "This property lies in the South Fork Rivanna Reservoir Water Supply Watershed" and "This property does not lie in an agricultural forestal district. " 8. [14-302(A)15] Identification of all owners and certain interest holders. Provide the addresses of the owners of record. 9. [14-302(B)8, 18-10.41 Setbacks. The front setback depicted on sheet 2 is incorrect and shall be revised. Rural Area (RA) setbacks applicable to this division are as follows: Front (internal private roads) — 25' Side — 25' Rear — 35' 10. [14-212(D)] Conditions of approval. Revise note #1 as follows: "No lot shown on this family subdivision plat may be sold or conveyed to a person other than an eligible `member of the immediate family, 'as that term is defined in Chapter 14 of the Albemarle County Code, for a period of four (4) years after the date of recordation of this plat except as authorized by section 14-212(A) of the Albemarle County Code. If any lot created by the recordation of this plat is conveyed back to the grantor during the four (4) year period, it shall be recombined with the parent lot within six (6) months after such conveyance. " 11. [14-412(A)4] Streets serving family subdivisions. Revise note #2 as follows: "The existing and/or proposed right-of-way is of adequate width and horizontal and vertical alignment to accommodate a travelway passable by ordinary passenger vehicles in all but temporary extreme weather conditions, together with area adequate for maintenance of the travelway, as required by section 14-412 of the Albemarle County Code. " 12. [14-302(A)10] Right offurther division. Revise the development rights notes #4 & #5 as follows: "Parcel X is assigned I development right and may not be further divided. The residue of Tax Map/Parcel 56-20 (Parcel E) is retaining I development right and may not be further divided. " 13. [14-302(A)9] Building sites. Revise note #8 as follows: "Parcel X and the residue of Tax Map/Parcel 56-20 each contain a building site that complies with section 4.2.1 of the Albemarle County Zoning Ordinance. " 14. [14-302(A)3] Easements. Provide the width of the easement being platted. 15. [14-303(Q)] Water Supply. Provide the following note: "Under current county policy, public water and/ or sewer service will not be available to this property. " 16. [14-303(A)] Statement of consent to division. Changes to the State Code and to the County of Albemarle Subdivision Ordinance require changes to the consent to division statement. Please revise the statements to read: "The platting or dedication of the following described land [insert correct description of the land subdivided] is with free consent and in accordance with the desire of the undersigned owners, proprietors and trustees, if any. " If the applicant would like to continue utilizing the previous ordinance language: "Any reference to future potential development is to be deemed as theoretical. All statements affixed to this plat are true and correct to the best of my knowledge. " Please utilize it as a separate note on the plat. Revise. 17. [14-302(A)1] Name of the subdivision. The title of the plat references "Parcel E as 13.136 acres "; however, sheet 2 has the parcel listed as 13.242 acres. Please correct the acreage discrepancy in the title. 18. [14-309 & 14-3101 Soil evaluations & Health director approval of septic systems. The soil work for the proposal was sent to the Health Department and is pending a review. Health Director approval is required prior to final plat approval. 19. [14-302(B)1] General Information. When the plat is revised provide the date of the last revision on the plat. Staff has provided references to the County Code. The Code is kept up-to-date by the County Attorney's office and may be found at www.albemarle.or /cg ount, cam. In accord with the provisions of Section 14-229(B) of Chapter 14, if the subdivider fails to submit a revised plat to address all of the requirements within six (6) months after the date of this letter, then the application shall be deemed voluntarily withdrawn.
