[14-302 (A)(9)] Building sites on proposed lots. Provide a 30,000 square foot building site rectangle within Tract D that meets all of the requirements of section 4.2.1 of the Albemarle County Zoning Ordinance. Rev. 1: Comment Addressed. 2. [14-302 (A)(10)] Right of further division of proposed lots. Provide an Affidavit Regarding Removal or Conversion of Dwelling. There are two residences listed as existing within TMP 62-36 in the County's online GIS. One dwelling unit needs to be demoted to a guest house, or removed from the property, in order to utilize one of the development rights to create Tract D. Rev. 1: Comment not yet addressed. Submit an "Affidavit Reaarding Removal or Conversion of Dwelling". had discussed this with the two People who made the visit (Francis MacCall & Stewart Wright). They agreed that what they saw was appropriate to be considered a guest house. However, it is my_ understanding that they informed the owner that he also needed to submit an "Affidavit Regarding Removal or Conversion of Dwelling". We have no record_ of him doing so. See the attached a PDF of the form. 3. [14-302 (13)(8)l Yards. Both Key West Drive (Route 1445) and Willow Dale Lane (Route 816) are considered "Internal Public Roads" and therefore have a 25' Minimum Front Yard. Include in coversheet note "H" the general designations of "Front (on existing public Road)" and "Front (on internal public or private road)" Rev. 1: Comment Addressed. 4. [14-303 (C)l Boundary lines. Provide a leader arrow from the bearing and distance measurements for the 58.35' proposed property line to the line it is labeling. Rev. 1: Comment Addressed. 5. [14-303 (L)l Public Utility, drainage and sight distance easements. Provide any existing or proposed site distance easements at the entrance onto Key West Drive (State Route 1445). Rev. 1: Comment Addressed. 6. [14-308.1] Groundwater Assessment. The groundwater assessment should be available before the end of the week and will be emailed to you. Rev. 1: Comment Addressed. 7. [14-309; 14-310] Soils evaluation; Health Director Approval. Health Department letter of approval for the soil evaluation has been received and is attached. Rev. 1: Comment Addressed. 8. [14-316] Approval of entrance onto public streets. Provide verification from VDOT that the location for the private street entrance on Key West Drive, within the proposed new 20' private street easement, will be adequate to support 2 lots. Rev. 1: Comment Addressed. 9. [NEW Comment] Affidavit verifying family relationship of grantor and grantee. Clarify the relationship that Marci Corle has with the grantors. If Marci Corle is the wife of Quintin Corle she should be removed from the "Affidavit verifying family relationship of grantor and grantee" and a new form signed, notarized and submitted. If she is a family member, as defined in the code, then her relationship needs to be specified separately and a new form signed, notarized and submitted. 10. [NEW Comment] Recordation of Private Street Maintenance Agreement and Covenants and Restrictions. The Private Street Maintenance Agreement and Covenants and Restrictions, that were previously submitted, must be recorded at the time thatthe lat is recorded. The applicant has also submitted a second declaration that limits the sale of the parcels to family members. It is my understanding that such a document is not normally included with a family subdivision application. The phrasing of#2 in this declaration includes some of the wording specified in 14-212(D) but it is not exact. The note included on the plat itself is worded as specified by 14-212 (D). So submission of this second declaration seems to be redundant to the wording of the plat and somewhat different. At your earliest convenience,please review these documents and the attached plat for the division. Should you have any questions or comments please feel free to contact me. This is my first submittal of documentation for review to the attorney's office. If I have inadvertently not included something or submitted it incorrectly please just let me know.
