Our Responses are as follows: Planning—Christopher Perez August 6,2014 Initial Site Plan 1. Comment: [COD Section I, 8.5.5.3] Street landscaping. VDOT comment#4 dated 8-5-14 requires the street tree landscaping along Rio Road to be relocated out of the landscaping strip in the right-of-way due to Clear Zone requirements. The street tree landscaping is depicted in the application plan for ZMA2013-00001 and is required; however, the required plantings can be relocated outside of the landscape strip to where VDOT requires it. In order to facilitate the relocation of the street tree landscaping a Variation request will need to be requested and processed to modify the typical street design requirement and the application plan from the rezoning. This item can be handled at the final site plan stage. The Variation will be reviewed through the special exception process, if staff is recommending approval of the variation it will to the BOS on consent agenda. If staff is recommending denial it will be required to go the PC first and then the BOS. Response: The street trees are being required to be located outside of the clear zone by VDOT. This results in the trees being located approximately 12.5 feet to the west of that shown on the ZMA Application Plan. It should be noted that VDOT reviewed the approved Application Plan during the ZMA process. It is understood that VDOT has reconsidered the street tree location since that time. A variation is not required or warranted as street trees along Rio Road are being provided in accord with the approved Application Plan and Code of Development. Comment: [COD Section I, 8.5.5.3] Landscaping strip.VDOT comment#5 dated 8-5-14 requires the landscaping strip along Rio Road to be six (6) foot wide, rather than the five (5) foot wide as provided. The landscaping strip is depicted in the application plan for ZMA2013-00001 as five (5) foot wide and is required; however, it can be modified to meet VDOT requirements if needed. In order to facilitate the relocation of the street tree landscaping a Variation request will need to be requested and processed to modify the typical street design requirement and the application plan from the rezoning. This item can be handled at the final site plan stage. The Variation will be reviewed through the special exception process; if staff is recommending approval of the variation it will go the BOS on consent agenda. If staff is recommending denial it will be required to go to the PC first and then the BOS. Response: The street trees are outside of the VDOT R-O-W(see response to previous Comment 1 and VDOT Comments 4 and 5). The width of the landscape strip is acceptable to VDOT as there will be no plantings. 3. Comment: [COD Section I, 8.5.5.3,32.5.2(n), 4.12.16(c)(3)]Angled Parking Spaces. VDOT comment#9 dated 8/5/14 requires the two (2)parking spaces along the entrance from Rio Road to be relocated to meet minimum throat length IF the two parking spaces Are to be relocated from what is depicted on the application plan from the rezoning then a Variance shall take place. IF the two spaces can be pushed back slightly to meet the throat length but are in the same general location and design, a Variation will not be needed. Response: These parking spaces have been revised to perpendicular type, have been annotated with appropriate dimensions and have been shifted approximately 5 feet to meet the VDOT throat length requirement(35' from the adjacent Rio Road travel lane). 4. Comment: [32.5.2(n) 4.12.16(c)(3)] Angled Parking Spaces. Also, for the two spaces mentioned above provide the angle of these spaces so staff can verify they meet the required dimensions per section. 4.12.16 (c)3. Response: These parking spaces have been revised to perpendicular type and have been annotated with appropriate dimensions. 5. Comment: [32.5.2(n) 4.12.16(c)(4)] Curvilinear Parking Spaces. For the first curvilinear space after you enter the site provide a one-hundred (100) foot sight distance line on the plan. Response: The requested sight distance has been added to Drawing C-6. 6. Comment: [COD Section I, 8.5.5.3] Pedestrian Path. The original path design provided access to the open space on the southwestern portion of the property. Instead, on the site plan the path has been modified to double back and lead to the passive recreation area near the pond and rear of the building. Staff suggests the original design/layout of the path also be incorporated into the site plan, in addition to what is depicted on the site plan. Regardless of the design in order to facilitate a change from the application plan/rezoning a Variation request will need to be requested and processed to modify the path location. This item can be handled at the final site plan stage. The Variation will be reviewed through the special exception process, if staff is recommending approval of the variation it will go to the BOS on consent agenda. If staff is recommending denial, it will be required to go to the PC first, then the BOS. Response: The pedestrian path has been reconfigured to be in compliance with that shown on the approved ZMA 2013-00001 Application Plan; thus, a variation is no longer warranted. 7. Comment: [ZMA2013-1,Proffer#2] Transit Reservation Area. On the site plan, label and depict the small transit shelter associated with the bus stop. Response: The transit shelter has been added to the plan and labeled as such(see Drawing C-6 and detail on Drawing C-10). 8. Comment: [32.5.2(a) & (o) & Proffer#1] —Rio Road Improvements. On the plan clearly delineate with shading any area proposed to be dedicated for the improvements to Rio Road. Also,provide a note stating that the land is to be dedicated for public use. Response: The requested shading and note has been added to Drawing C-6. 9. Comment: [ZMA2013-1,Proffer#1] Rio Road Improvements. Prior to final site plan approval the Rio Road widening/dedication to public use will need to take place on a subdivision plat to be reviewed by the County, approved, and then recorded in the Clerk's Office prior to final site plan approval. The DB page information of this action shall be provided on the final site plan. Response: The requested plat will be submitted under separate cover. 10. Comment: [ZMA2013-1, Proffer#3] Affordable Housing. "Each site plan for land within the property shall note the aggregate number of units designated for Affordable Units"Provide the affordable unit information on the site plan for staff to verify the requirement is met. Comment: [32.5.2(n),4.12.16(c)(1)] Perpendicular Parking Size. Throughout the plan label the aisle widths, including in the parking areas. Spaces along a 24'aisle shall be 9'wide by 18'long. Response: The parking spaces have been dimensioned as necessary (see Drawing C-6). 12. Comment: The design of the parking garage does not provide a vehicle turnaround location to be used when all the spaces are full. Rather vehicles will be prompted to reverse out of the site if the lot is full. For safety reasons it is suggested that two spaces at the northern end of the unit are stripped for no parking to facilitate vehicle turn around, such as would be for a hammer head turn around. Response: A turnaround at the north side of the garage has been provided. A turnaround at the south side of the garage is not warranted due to length of travel. 13. Comment: [4.12.6] Parking. On the plan depict the required parking spaces based on the use, show the calculations. Continue to depict the spaces provided. Staff understands a parking waiver was processed at the rezoning stage; however,the overall mix of unit types has changed since the rezoning. Previously it was 40-single bedroom units, now it is 35-single bedroom units. Previously it was 25—two bedroom units, now it is 29—two bedroom units and 2-three bedroom units. Provide the revised information so that Zoning can determine if the parking provided is still adequate. Response: A parking tabulation has been added to Drawing C-2. The bedroom count has been revised. 14. Comment: [32.5.2(a),32.7.3(a),32.5.6.i,32.7.2.3(a)(c)] Sidewalks. The sidewalks fronting the property shall be built to the side property lines. Currently each sidewalk stops 10 feet short of the property line. Revise. Response: The sidewalk has been extended to the property on the north and south side. 15. Comment: [32.5.2(n),32.7.2.3(a), 14-422] Sidewalks and landscaping strips. On the plan please dimension and label all proposed sidewalks and planting strips. Response: The plan has been dimensioned accordingly(see Drawing C-6 and road cross section details on Drawing C-10). 16. Comment: [32.5.2(a) & (n)] General Information. The zoning of the property is correctly labeled as NMD. Also, under the zoning of the property provide a note that proffers are associated with ZMA2013-1. Staff understands that page two lists the proffers, but sheet 1 under zoning should also state that proffers apply per the rezoning ZSMA2013-1. 3040 Avemore Square Place • Charlottesville,VA 22911 Telephone(434) 984-2700 •Fax(434) 978-1444 Charlottesville ■Lynchburg Page 4 of 18 Niue Response: The title at the top of Drawing C-1 denotes proffers as well as the zoning under Site Data. 17. Comment: [32.5.2(d),30.7.5] Managed and Preserved Slopes. This parcel no longer contains "critical slopes"; it has a combination of both"managed slopes"and "preserved slopes"based on the approved overlay map. Show both the managed and preserved slopes as represented on the approved map and label them accordingly. These slopes should be shown on the site plan as well as the existing conditions sheet to give a better understanding of the impacts on each type of slope. The proposed disturbance of the preserved slopes is allowed based on the exhibit and special exceptions approved with ZMA201300001 which requires construction in the area. Additionally, disturbance of managed slopes is now permitted without a waiver as long as certain performance standards are met. Coordinate with engineering to make sure the construction proposed on the managed slopes meet these requirements. Response: The critical slopes have been annotated as preserved and managed on Drawing C-5 and are based on field survey to establish slopes 25% and greater. 18. Comment: [32.5.2(a)] Setbacks. On Sheet 1 of the site plan assure that the 10'setbacks are noted. Response: The setbacks have been added under Site Data on Drawing C-1. 19. Comment: Throughout the plan provide directional arrows for the drive aisles. Response: Directional arrows have been added to the drive aisle to denote circulation. 20. Comment: [32.5.2(b)] On Sheet 1, revise site data information to break down how 70,696SF of Open Space is being provided onsite. Notably, sheet 10 does not depict enough open to have 70,696SF of Open Space. Please address this. Revise. Response: The open space has been corrected. 21. Comment: It appears as though only one (1) dumpster is being provided onsite. Being there are to be 65 units in the multifamily development, it seems appropriate more dumpsters will be required to handle all the waste product. Assure the amount of dumpsters is provided which will adequately service the development. Response: A single dumpster is sufficient for 65 multi-family dwelling units as based on the owner's/developer's/applicant's knowledge obtained from owning and operating multi-family rental apartment buildings of similar size. 3040 Avemore Square Place • Charlottesville,VA 22911 Telephone(434) 984-2700 •Fax(434) 978-1444 Charlottesville •Lynchburg Page 5 of 18 22. Comment: [4.17] Lighting. On sheet 1, under Notes,the lighting note shall be revised, as lighting shall not exceed one half(0.5) foot candle. Revise to provide the following standard lighting note on the lighting plan: Each outdoor luminaire equipped with a lamp that emits 3,000 or more initial lumens shall be a full cutoff luminaire and shall be arranged or shielded to reflect light away from adjoining residential districts and away from adjacent roads. The spillover of lighting from luminaires onto public roads and property in residential or rural areas zoning districts shall not exceed one— half foot candle. Response: This note has been deleted from the cover sheet. Drawing C-26 has been added to the plan to address the exterior lighting. 23. Comment: If any off-site easements are required they must be approved and recorded prior to Site Plan approval. Response: There are no off-site easements required for the development of this property. 24. Comment: This site plan cannot be approved until all reviewers complete their reviews; comments will be forwarded upon receipt. Response: Acknowledged. 25. Comment: [32.5.2(n) & (p)] The following will be required for final site plan approval: • Outdoor lighting information including a photometric plan and location, description and photograph or diagram of each of our outdoor luminaire [Sec. 32.7.8 & Sec. 4.17] • A landscape plan in accordance with [Sec. 32.7.9] and the Code of Development associated with the rezoning. Response: Albemarle County Code compliant landscaping and lighting has been provided (see Drawings C-6, C-7, C-22, C-23 and C-26). Landscaping and Lighting 1. Comment: [32.5.2(n)] Show proposed lighting locations on the layout, utility and landscape sheets to verify no conflicts exist. Response: Exterior lighting has been added to the requested sheets. 2. Comment: [4.17] On the light plan include cut sheets for proposed lights and provide legible photometric plan on final site plan. Comment: [32.5.2(p) & 32.7.9.4(b)] Existing trees may be preserved in lieu of planting new plant materials in order to satisfy the landscaping and screening requirements of section 32.7.9, subject to the agent's approval. If you intend to use existing trees to satisfy any of the landscape plan requirements, please include the following: • Areas and other features shown on landscape plan. The landscape plan shall show the trees to be preserved,the limits of clearing, the location and type of protective fencing, grade changes requiring trees wells or walls, and trenching or tunneling proposed beyond the limits of clearing. • Conservation checklist. The applicant shall sign a conservation checklist approved by the agent to ensure that the specified trees will be protected during construction. Except as otherwise expressly approved by the agent in a particular case, the checklist shall conform to the specifications in the Virginia Erosion and Sediment Control Handbook,pages III-393 through III-413, and as hereafter amended. Response: Existing vegetation has not been utilized to satisfy these requirements except for screening along the western boundary. The checklist has been added to Drawing C-18. 4. Comment: [32.5.2(p),32.7.9.5] When a parking lot is located such that parked cars will be visible from a public street, low shrubs should be planted to minimize the view of the parked cars. The parking above ground parking will be visible from Rio Road; on the landscape plan provide shrubs to screen the parking area from Rio Rd. Response: The landscaping plan is in conformance with this requirement. 5. Comment: [32.7.9.6] Landscaping within a parking area. Parking lot landscaping shall apply to above ground parking. Response: The landscaping plan is in conformance with this requirement. 6. Comment: [32.7.9.8] Tree Canopy. On the plan provide the calculations for the tree canopy,to include required and provided. Response: Tree canopy calculation has been added to Drawing C-23. 7. Comment: [32.5.2(p) & 32.7.9.7] Proposed SWM Facility should be screened from the adjacent residential lots. Comment: [32.5.2(p) & COD Section X] On the landscape plan associated with the final site plan, provide a chart or other schedule demonstrating how the required Landscape Treatment requirements listed in Section X of the Code of Development are being satisfied. Response: The requested information has been added to Drawing C-23. RWSA—Victoria Fort August 6,2014 1. Comment: In addition to the comments provided by ACSA, RWSA requests that the applicant provide an estimate of future sewer flows from this development. If projected flows are in excess of 40,000 gallons per day, the project will require a flow capacity certification from RWSA prior to final site plan approval. Response: The requested information has been added to Drawing C-2. Flows are less than 40,000 gpd. ACSA—Alexander J. Morrison,E.I.T.July,23 2014 1. Comment: Relocate water connection so it is an extension of the existing watermain on TMP#61A-29. Response: An easement cannot be obtained from the adjacent property owner. We request that the connection be made to existing RWSA facilities as shown on the plan. 2. Comment: The proposed connection to the existing RWSA watermain in Rio road is not an approved connection. Response: See response to ACSA Comment 1. 3. Comment: Call out all fittings. Response: Fittings haven called out on the profiles. 4. Comment: Call out water meter"To be Sized by ACSA". Response: Requested information has been added to Drawing C-6. 5. Comment: Call out backflow prevention. Response: Requested information has been added to Drawing C-6. 7. Comment: Call out sewer lateral invert in as well as the existing invert in, invert out, lid and depth for the manhole. Show ACSA details (found at www.servic eauthority.org). Response: Requested callouts have been added to Drawing C-6. Appropriate details have been added to Drawing C-25. 8. Comment: Include waterline profiles. Response: Profiles have been added to the plan(see Drawing C-25). VDOT—Troy Austin August 6,2014 1. Comment: It appears that the right of way should be adjusted at the entrance to The Lofts at Meadowcreek to accommodate the crosswalk across the entrance. Response: The right-of-way has been adjusted accordingly. 2. Comment: There are two utility poles shown in the bus stop area that will need to be relocated. Response: This is understood. Overhead utilizes are to be moved out of the clear zone (see General Demolition Note 12 on Drawing C-5). 3. Comment: Additional detail, including spot elevations, should be provided at the entrance to the storm water management facility to ensure positive drainage across the entrance and to clarify the transition from curb and gutter to shoulder/roadside ditch. Response: The cross sections on Drawing C-24 demonstrate positive drainage along Rio Road as well as the entrance in question. 4. Comment: The clear zone along Rio Road needs to be considered. It is likely that the street trees shown in the typical sections for Rio Road will not be allowed due to clear zone restrictions. Response: As based on Table 3-1 of the AASHTO 4th Edition 2011 Roadside Design Guide (page 3-3), it appears that a clear zone of 15 feet from the face of curb is appropriate (3.5 feet from right-of-way). Street trees are located 4 feet from the R-O-W. 5. Comment: The minimum width of a landscape strip between the back of curb and the sidewalk is 6' rather than the 5' shown. 3040 Avemore Square Place • Charlottesville,VA 22911 Telephone(434) 984-2700 • Fax(434) 978-1444 Charlottesville •Lynchburg Page 9 of 18 `fir rr' Response: A 5 foot tree lawn/landscape strip will remain as is. No street trees will be planted in this strip. See response to VDOT Comment 4 above. 6. Comment: The pavement design for the Rio Road improvement will need to match the existing pavement structure of Rio Road. Response: The Treasdale Project noted the following pavement structure for Rio Road: 1.5" SM-12.5A, 2" IM-19GA, 6" BM-25PA and 8" 21B. We propose this same section(see Drawing C-10). 7. Comment: Per the 2011 AASHTO Manual,the deceleration taper for the bus stop should be at a minimum a 5:1 ratio, or a minimum of 50' rather than the 30' shown. Please refer to pages 4-69 in the AASHTO Manual. Response: The decel taper has been revised (see Drawing C-6 and detail on Drawing C-10). 8. Comment: Rather than only showing the details from the Work Area Protection Manual, it would be helpful to also show the sign locations and channelizing in plan view, to scale for this project. Response: The Traffic Control Plan is a guideline. The final plan will be subject to the selected contractors means, methods and conditions of the Land Use Permit obtained from VDOT. 9. Comment: The parking spaces located closest to Rio Road do not appear to meet the minimum throat length as defined in Appendix F of the Road Design Manual. Response: The parking spaces have been shifted such that it is 35 feet from the edge of the closest Rio Road travel lane per Table 4-2, Appendix F, Road Design Manual (page F-108) with the Final Site Plan submission. Engineering—John Anderson August 6,2014 Initial Site Plan (Code Chapter 18 section 32) 1. Comment: Update Coordination Note 5, sheet 3 —VSMP Phase 1 Land Clearing General Permit is not an option. Comment: Minor: Update General Notes for ESC Plans Note 17: "Straw mulch to be applied at 80 lbs/1000SF Response: The note has been revised accordingly. 4. Comment: List"D" in schedule of abbreviations, title page. 'D' appears inside manhole structure symbols, sheets C-6, C-7, and C-8. Response: The schedule of abbreviations on Drawing C-3 has been revised to include the "D". 5. Comment: Confirm design of semi-circular parking area at base of entrance drive ramp and position of dumpster pad allow waste management service vehicles sufficient space to reverse and exit. [AC Code 18-4.12.15.e.] Response: The subject parking area geometrics are sufficient to facilitate the ingress/egress movements of waste management vehicles. 6. Comment: Parking spaces to immediate right and left of parking garage entrance should be replaced with islands. Vehicles cannot use either space without reversing. These spaces impede sight distance for vehicles entering and exiting the parking garage. Eliminate these two spaces and replace with islands [AC Code 18-412.15.f.]. Radii on islands should be 3' minimum. Response: Raised islands have been added to provide separation/barrier between parking spaces and the travelway. 7. Comment: Curvilinear parking spaces (exterior to parking garage require bumper blocks or paint striping 94.12.16). Response: "Bumper blocks"or pavement markings are not warranted as sufficient vehicle overhang in the adjacent grass strip is provided. 8. Comment: Handicapped parking spaces should be located on the east side of the parking facility to eliminate the need to cross vehicle access isle. [AC Code 18-4.12.15.i.] Response: Marked crosswalks from the handicap spaces to the point of ingress have been provided. Comment: Sidewalks—Maximum grade is 5%, revise sections that exceed 5% [VDOT Road Design Manual,Appendix A, p. A-121]. Furnish 1' wide (min.) flat(<2%) area at back of sidewalk leading to biofilter [VDOT Road Design Manual, Appendix A, Fig.,p. A-123]. Response: Pedestrian access has been provided in accord with the ADA requirements as pertinent with the conditions of this particular development. 10. Comment: Relocate/revise design of SWM biofilter. Floor of proposed basin is 20-ft from 21-ft high retaining wall. Final contours (east side of basin) disappear at retaining wall. Relocate biofilter away from retaining wall. Evaluate 100-yr storm water surface elevation relative to retaining wall; design must eliminate influence of subsurface saturation on retaining wall foundation. Provide a 10-ft W(min.) maintenance strip on the west side of biofilter, and revise biofilter side slopes to 3:1 or flatter to minimize risk to residents posed by 2:1 slopes. Show basin dimensions (L x W/floor of biofilter). Response: The retaining walls are being designed by Circeo Geotechnical Engineering, P.C. Mr. Circeo has indicated to me the retaining walls will be designed to accommodate the adjacent conditions. 11. Comment: Furnish SCALE, sheet C-7; correct SCALE, sheet C-8. Response: The scale has been corrected. 12. Comment: Sheet C-10: Channel @Retaining Wall detail— see SCC calculations on Dwg. No. C-17 for channel lining material and Dwg. No. C-15 for channel location. Sheets C-17, C-15 not included. Show channel location. Response: This detail has been removed from the plans. All retaining walls are being designed by others. The plan has been annotated to denote such and that a separate building permit is required. The retaining wall designer will prepare the retaining wall plans to include guardrail. The retaining wall plans will be submitted to the County's Building Review Department for review and approval. Channel information may be found on the E&SC drawings. 13. Comment: Segmental Retaining Wall Notes (1./6.; sheet C-10) are inconsistent with review and approval process. Retaining wall design review and approval required prior to final site plan approval (see#2, below). Response: See Responses to Comments 10 and 12. The detail has been modified accordingly. 14. Comment: Reference to guardrail detail in SRW detail, sheet C-10, is confusing. Comment: Sheet 15 of 16 Shows building and retaining walls, East Elevation, in profile view. Retaining wall sections appear discontinuous in profile, yet continuous in plan views. Bobby mentioned that there will be a soil engineer on site to determine soil quality during placement of the outlet pipe and with the soil engineers approval the dam core will be placed either just under the outlet pipe or throughout the length of the dam wall. The question being whether or not the cutoff trench will follow the entirety of the dam wall. The County will expect the cutoff trench to follow the entire length of dam wall, not just installed under the installed outlet pipe. Any change to the plan will be required to be submitted to the County as a plan amendment and accompanied with a stamped, certified letter from the soil engineering firm performing the oversight for review.
