Erosion and Sediment Control Plan. A. Approved Plan The VSMP Plan WPO2014-00087 contains the Erosion and Sediment Control Plans and consists of Sheet Numbers 1, 18, 19, 20 and 21 of 30. An 11" x 17" copy of these • sheets is contained in this Section of the SWPPP. A copy of the approved VSMP Plan will be issued by the Albemarle County Erosion and Sediment Control officer at the pre- ,,., construction meeting to be held on-site. B. Erosion and Sediment Control Plan The erosion and sediment control plan is a two-phase plan. The Phase 1 plan is ev• depicted on the VSMP Plan Sheet 19 of 30. The Phase 2 plan is depicted on the VSMP Plan Sheet 20 of 30. A narrative of the Erosion and Sediment Controls is contained on Sheet 18 of 30. Erosion and Sediment Control details and support calculations are contained on the VSMP Plan Sheet 21 of 30. The Phase 1 plan is to permit clearing and grading to facilitate installation of the construction entrance, sediment trap with permanent embankment and outfall structure and pipe, the perimeter controls consisting of silt fence and diversion dikes, the stockpile area, the parking/staging area as well as the remainder of the site. The Phase 2 plan is implemented after the clearing and grubbing operations and installation of the Phase 1 erosion and control measures have been completed. Mass grading will be performed along with construction of building groundworks, the building retaining walls as required to facilitate building and travelway construction. Utilities and stormwater conveyance channels will be constructed concurrently with the mass grading operations as grades permit. Inlet protection is to be provided concurrently with construction of the closed conduit storm drain system. tom Care shall be taken to preclude transport of sediment off-site. In addition, the outfall OP-1 is through a preserved steep slope area. Strict adherence to the limits of .. construction/disturbance is required(see VSMP Plan Sheet 7 of 30). WWA Project No.213001.03 4-1 The Lofts at Meadowcreek SWPPP Charlottesville,Virginia May 26,2015 C. Special Considerations and Requirements 1. The DEQ Permit No. VAR 10E 747 issued for this project denotes that the proposed land disturbance and discharges to a surface water identified as impaired or for which a TMDL waste load allocation has been established and approved prior to the term of the general permit for sediment or sediment related parameter or nutrients. Therefore, the following general permit (Part 1.B.4) and SWPPP requirements (Part 11.A.5) must be implemented for the land disturbing activity as follows: a. Permanent or temporary soil stabilization shall be applied to denuded areas within seven (7) days after final grade is reached on any portion of .. the site; b. Nutrients (e.g., fertilizers) shall be applied in accordance with manufacturer's recommendations or an approved nutrient management plan and shall not be applied during rainfall events; asp c. Inspections shall be conducted at a frequency of(i) at least once every t. four (4) business days or (ii) at least once every five (5) business days and no later than 48 hours following a measurable storm event. In the event that a measurable storm event occurs when there are more than 48 hours between business days, the inspection shall be conducted on the next business day; and d. Representative inspections used by utility line installation, pipeline construction, or other similar linear construction activities shall inspect all outfalls. D. Inspection 1. Inspections shall be performed by qualified personnel as listed in Section 8 of the SWPPP. WWA Project No.213001.03 4-2 The Lofts at Meadowcreek SWPPP r Charlottesville,Virginia May 26,2015 r r tam 2. Inspection schedule shall be in accord with that listed in the General Permit Part 11 F2 (pages 10 and 11 of 21)of Section 11 of this SWPPP document. 3. Inspection requirements are listed in the General Permit Part II F3 (pages 11, 12 and 13 of 21) of Section 11 of this SWPPP document. 4. Inspection report shall contain the items listed in the General Permit Part II F4 (page 13 of 21) of Section 11 of this SWPPP document. 5. The inspection report and any actions taken must be retained by the operator as part of the SWPPP for at least three years from the date that general permit coverage expires or is terminated. The inspection report shall identify any incidents of noncompliance. Where an inspection report dos not identify any incidents of noncompliance, the report shall contain a certification that the construction activity is in compliance with the SWPPP and this general IMP permit. The report shall be signed in accordance with the General Permit Part III K(page 17 of 21)of Section 11 of this SWPPP document. r 6. Inspection Log/Report is presented in Section 12 of this SWPPP document. E. Rainfall Event ... 1. The location of the on-site rain gauge that will be used to determine the occurrence of a measurable storm event for the purposes of ESC and Pollution ... Prevention inspections will be provided by the Contractor and identified on the record set of plans or in other appropriate SWPPP documents for this land disturbance(construction)activity. 2. The rain gauge shall be observed daily at 1:00 PM to determine the occurrence of a measurable storm event (i.e., 0.25 inches of rainfall or greater in a 24 hour period). A log book shall be maintained to record observation information which shall include (i) the date, (ii) the time, (iii) whether or not rainfall is occurring at the time of the observation, (iv) the amount of r WWA Project No.213001.03 4-3 The Lofts at Meadowcreek SWPPP Charlottesville,Virginia May 26,2015 i.. KO accumulated rainfall in the gauge, if any, and(v) whether or not an inspection e` is required based on the amount of accumulated rainfall in the gauge. 6.• 3. If there is no rainfall occurring at the time of the observation, the observation information shall be noted in the log book and the rain gauge emptied and replaced. An inspection is required if there is 0.25 inches or more accumulation noted in the rain gauge. 4. If there is rainfall occurring at the time of the observation, the observation information is to be noted in the log book. The rain gauge is not to be emptied but left to accumulate additional rainfall until the conclusion of the rainfall event. At the conclusion of the rainfall event, an observation of the rain gauge shall be made and the observation information shall be noted in the log book and the rain gauge emptied and replaced. An inspection is required if there is 0.25 inches or more accumulation noted in the rain gauge. Stormwater Management Plan. A. Approved Plan The VSMP Plan WPO2014-00087 contains the Stormwater Management Plans and consists of Sheet Numbers 1, 3, 7, 16, 17,23, 24,25,29 and 30 of 30. An 11"x 17"copy •• of these sheets is contained in this Section of the SWPPP. A copy of the approved VSMP Plan will be issued by the Albemarle County Erosion and Sediment Control officer at the pre-construction meeting. B. Stormwater Management Plan This project is grandfathered under the IIC Technical Requirements of 9VAC25- 870. The stormwater management plan is in conformance with applicable regulations as evidenced by the signature and date on the approval stamp of the Albemarle County Program Authority. The plan consists of a closed conduit storm drain system with inlets and stormwater conveyance channels. In addition, the site grading provides substantial capture of the stormwater surface run-off and directs run-off to the conveyance channel and closed `• conduit systems. The channel and conduit system is directed to a bioretention filter facility. This facility provides both quantity and quality (BMP) controls in compliance with the IIC Technical criteria as well as MS-19. The closed conduit system drainage area and layout is shown on Sheet 16 of 30, inlet and drain computations on Sheet 17 of 30 and profiles on Sheet 29 of 30. The stormwater conveyance channel system and section are shown on Sheets 20 and 21 of 30 (see Erosion and Sediment Control Plan — +` Section 4 of this SWPPP) and the calculations are presented on Sheet 17 of 30. An easement is provided for the closed conduit storm drain system. The stormwater management quality and quantity control facility is shown in plan view on Sheet 7 of 30 to include an access easement and an easement around the facility. ir. Drainage areas pre-developed and post-developed are shown on Sheet 23 of 30, details and calculations on Sheet 24 of 30 and facility routings on Sheet 25 of 30. WWA Project No.213001.03 5-1 The Lofts at Meadowcreek SWPPP rr Charlottesville,Virginia May 26,2015 ar Was The plan denotes that water quality criteria for phosphorus reduction are met and the 2-year and 10-year post-developed discharge to the analysis point are less than the pre- developed 2- and 10-year discharge to the analysis point. The stormwater management facility outfall is equipped with VDOT Class I dry rip apron that is 10' wide by 45' and is 18" thick. The rip-rap apron dissipates energy sufficiently to render the flow non- erosive. The pipe exit velocity is 4.5 feet per second. As based on these findings, the outfall is adequate and remains adequate and the project meets the requirements of MS- 19. r. An 11" x 17"plan of the site showing pollution activities and practices is contained in this Section of the SWPPP. nil B. Sources of Pollutants and Locations.Controls and Prevention Practices rr 1. Sources and Locations a. Construction activities including paving, curb and gutter installation, concrete pouring/mortar/stucco building construction, landscaping and seeding. r,. c. See Table No. 1 on page 6-12. 2. Prevention Practices a. Good Housekeeping. Good housekeeping practices include activities that are intended to maintain a clean site and keep equipment in good working order to prevent stormwater quality problems from occurring. Daily cleanup and inspections are the most effective means of achieving good housekeeping. For the most part, good housekeeping is a day-to- day activity that does not require a large expenditure of time or expense, and should be implemented on an ongoing basis. Examples of good housekeeping practices are: air (i) Tools and materials should be returned to designated storage areas after use. WWA Project No.213001.03 6-1 The Lofts at Meadowcreek SWPPP Charlottesville,Virginia May 26,2015 r (ii) Waste materials should be collected and properly disposed after the completion of each job, shift,or day as appropriate. (iii) Indoor work areas should be neat, uncluttered, and well-ventilated to discourage outdoor work and to allow leaks and spills to be quickly detected and controlled. (iv) Outdoor work areas should be swept regularly (not hosed) and kept neat and clean. (v) Occasionally outdoor work areas may need cleaning beyond sweeping. In such cases, all wash waters should be contained, collected, and properly disposed. (vi) Outdoor waste or trash receptacles should be covered and emptied regularly and the adjacent areas inspected for misplaced or wind- blown litter. b. Proper Materials Handling and Storage. Materials handling and storage practices relate to controlling the potential for leaks, spills and losses on materials delivered, used, and stored at a facility. Spills and leaks of materials can accumulate in soils or on surfaces and be carried away in int stormwater runoff or authority non-stormwater discharges. (i) Materials Use • Only obtain the amount of materials needed to finish a particular job; • Limit waste generation by keeping good records and reviewing activities; • Recycle materials whenever possible;and arr WWA Project No.213001.03 6-2 The Lofts at Meadowcreek SWPPP Charlottesville,Virginia May 26,2015 iwo • Read and follow manufacturer directions for use of materials and review the associated Material Safety Data Sheet(MSDS). (ii) Materials Storage • Store materials indoors or in a covered area where exposure to stormwater is minimized; ,., • Store lead-acid batteries indoors and within secondary containment; • Use hazardous materials storage lockers with spill containment or flammable materials lockers when appropriate; bet • Locate storage areas away from vehicle and equipment paths to reduce the potential for accident-related leaks or spills; • Do not store drums or other containers close to storm drain inlets; • Provide informational signing, labels, restricted access, locks, inventory control, overhead coverage, and secondary containment for all hazardous material storage areas or container units; and • Conduct regular inspections for leaks and control dates. c. Proper Waste Handling. Waste handling practices relate to properly controlling, collecting, storing, and disposing of wastes that are generated at a facility. All facility personnel should be aware that disposing any waste (including wash waters) into a storm drain inlet or stormwater conveyance (e.g., streets) is considered illegal dumping. Likewise, disposing of waste (including wash waters) onto a paved or WWA Project No.213001.03 6-3 The Lofts at Meadowcreek SWPPP Charlottesville,Virginia May 26,2015 r. unpaved surface such that it may be carried to a storm drain inlet or stormwater conveyance(e.g., streets) is also considered illegal dumping. (i) Sweep or vacuum (dry methods) work areas to collect metal, wood, and other particulates and debris frequently; (ii) Limit waste generation by keeping good records and reviewing activities; (iii) Recycle materials whenever possible; (iv) Separate and segregate different types of wastes; (v) Store waste materials indoors or in a covered area where exposure ism to stormwater is minimized; (vi) Arrange for regular waste disposal; (vii) Use hazardous materials storage lockers with spill containment or flammable materials lockers when appropriate; (viii) Locate the waste storage area away from vehicle and equipment paths to reduce the potential for accident-related releases; (ix) Provide informational signage, labels, restricted access, inventory controls, overhead coverage, and secondary containment for all hazardous waste storage areas or container units; and (x) Conduct regular inspections for leaks and control dates. ONOd. Spill Prevention. Spill clean-up can be labor-intensive and costly involving expenses to contain the spill, collecting the spilled substance, proper disposal of spill materials, and report filing to regulatory WIN agencies, not to mention possible monetary fines. Spills and leaks are WWA Project No.213001.03 6-4 The Lofts at Meadowcreek SWPPP .. Charlottesville,Virginia May 26,2015 some of the most significant sources of water pollution and are, in most cases, avoidable. Spill prevention, control, and cleanup applies to all materials and wastes — not only hazardous substances. The toxic water quality effects from spills of hazardous substances (e.g., acids, oils, greases, fuels, solvents, pesticides) are commonly understood. However, non-hazardous materials — for example, sand, litter, corn oil, sweeteners, soaps, and food products, among others—can also greatly impact water quality. (i) Placing bollards, berms and containment features around structures or areas where fluids are stored, so releases can be prevented, w easily detected, and controlled; (ii) Using drip pans for maintenance operations involving fluids and under leaking vehicles and equipment waiting repair; w (iii) Placing spill kits in areas where fluids are stored or in areas where activities may result in a spill; (iv) Providing training for proper use of materials and equipment used during operations and maintenance activities; (v) Providing training for proper use of spill response equipment and supplies; and (vi) Conducting outdoor maintenance activities on gravel or paved surfaces to allow for easy detection, control, and cleanup of spills. +r. Based on my inquiry of the person or persons who manage the system, or those persons directly responsible for gathering the information, the information submitted is, to the best of my knowledge and belief, true, accurate, and complete. I am aware that there are significant penalties for submitting false information, including the possibility of fine and imprisonment for knowing violations." err L. Duty to comply. The operator shall comply with all conditions of this general permit. Any state permit noncompliance constitutes a violation of the Virginia Stormwater Management Act and the Clean Water Act, except that noncompliance with certain provisions of this general permit may constitute a violation of the Virginia Stormwater Management Act but not the Clean Water Act. Permit noncompliance is grounds for enforcement action; for state permit termination, revocation and reissuance, or modification; or denial of a state permit renewal application. The operator shall comply with effluent standards or prohibitions established under§ 307(a) of the Clean l.. Water Act for toxic pollutants within the time provided in the regulations that establish these standards or prohibitions or standards for sewage sludge use or disposal, even if this general permit has not yet been modified to incorporate the requirement. "' M. Duty to reapply. If the operator wishes to continue an activity regulated by this general permit after the expiration date of this general permit, the operator shall submit a new registration statement at least 90 days before the expiration date of the existing general permit, unless permission for a later date has been 1.• granted by the board. The board shall not grant permission for registration statements to be submitted later than the expiration date of the existing general permit. N. Effect of a state permit. This general permit does not convey any property rights in either real or . personal property or any exclusive privileges, nor does it authorize any injury to private property or invasion of personal rights, or any infringement of federal, state or local law or regulations. 0. State law. Nothing in this general permit shall be construed to preclude the institution of any legal imo action under, or relieve the operator from any responsibilities, liabilities, or penalties established pursuant to any other state law or regulation or under authority preserved by§ 510 of the Clean Water Act. Except as provided in general permit conditions on "bypassing" (Part III U) and "upset" (Part III V), nothing in this ., general permit shall be construed to relieve the operator from civil and criminal penalties for noncompliance. P. Oil and hazardous substance liability. Nothing in this general permit shall be construed to preclude the institution of any legal action or relieve the operator from any responsibilities, liabilities, or penalties to which the operator is or may be subject under§§62.1-44.34:14 through 62.1-44.34:23 of the State Water Control Law or§311 of the Clean Water Act. General Permit No.:VAR10 Page 19 of 21 Q. Proper operation and maintenance. The operator shall at all times properly operate and maintain all •• facilities and systems of treatment and control (and related appurtenances), which are installed or used by the operator to achieve compliance with the conditions of this general permit. Proper operation and maintenance also includes effective plant performance, adequate funding, adequate staffing, and adequate laboratory and process controls, including appropriate quality assurance procedures. This provision requires the operation of back-up or auxiliary facilities or similar systems, which are installed by the operator only when the operation is necessary to achieve compliance with the conditions of this general permit. R. Disposal of solids or sludges. Solids, sludges or other pollutants removed in the course of treatment or management of pollutants shall be disposed of in a manner so as to prevent any pollutant from such materials from entering surface waters and in compliance with all applicable state and federal laws and regulations. S. Duty to mitigate. The operator shall take all steps to minimize or prevent any discharge in violation of this general permit that has a reasonable likelihood of adversely affecting human health or the NMI environment. T. Need to halt or reduce activity not a defense. It shall not be a defense for an operator in an enforcement action that it would have been necessary to halt or reduce the permitted activity in order to maintain compliance with the conditions of this general permit. U. Bypass. 11110 1. "Bypass," as defined in 9VAC25-870-10, means the intentional diversion of waste streams from any portion of a treatment facility. The operator may allow any bypass to occur that does not cause effluent limitations to be exceeded, but only if it also is for essential maintenance to ensure efficient operation. These bypasses are not subject to the provisions of Part III U 2 and 3. 2. Notice. a. Anticipated bypass. If the operator knows in advance of the need for a bypass, the operator shall submit prior notice to the department, if possible at least 10 days before the date of the bypass. ""` b. Unanticipated bypass. The operator shall submit notice of an unanticipated bypass as required in Part III I. 3. Prohibition of bypass. a. Except as provided in Part Ill U 1, bypass is prohibited, and the board or department may take enforcement action against an operator for bypass unless: (1) Bypass was unavoidable to prevent loss of life, personal injury, or severe property damage. Severe property damage means substantial physical damage to property, damage to the treatment facilities that causes them to become inoperable, or substantial and permanent loss of natural resources that can reasonably be expected to occur in the absence of a bypass. Severe property damage does not mean economic loss caused by delays in production; (2) There were no feasible alternatives to the bypass, such as the use of auxiliary treatment facilities, retention of untreated wastes, or maintenance during normal periods of equipment downtime. This condition is not satisfied if adequate back-up equipment should have been installed in the exercise of reasonable engineering judgment to prevent a bypass that occurred during normal periods of equipment downtime or preventive maintenance; and (3) The operator submitted notices as required under Part III U 2. General Permit No.:VAR10 Page 20 of 21 b. The department may approve an anticipated bypass, after considering its adverse effects, if the ■. department determines that it will meet the three conditions listed in Part III U 3 a. V. Upset. 1. An "upset," as defined in 9VAC25-870-10, means an exceptional incident in which there is unintentional and temporary noncompliance with technology-based state permit effluent limitations because of factors beyond the reasonable control of the operator. An upset does not include noncompliance to the extent caused by operational error, improperly designed treatment facilities, inadequate treatment facilities, lack of preventive maintenance, or careless or improper operation. 2. An upset constitutes an affirmative defense to an action brought for noncompliance with technology- based state permit effluent limitations if the requirements of Part III V 4 are met. A determination made during administrative review of claims that noncompliance was caused by upset, and before an action for noncompliance, is not a final administrative action subject to judicial review. 3. An upset does not include noncompliance to the extent caused by operational error, improperly designed treatment facilities, inadequate treatment facilities, lack of preventative maintenance, or careless or improper operation. ims 4. An operator who wishes to establish the affirmative defense of upset shall demonstrate, through properly signed, contemporaneous operating logs or other relevant evidence that: a. An upset occurred and that the operator can identify the cause(s)of the upset; b. The permitted facility was at the time being properly operated; c. The operator submitted notice of the upset as required in Part III I; and d. The operator complied with any remedial measures required under Part III S. 5. In any enforcement proceeding, the operator seeking to establish the occurrence of an upset has the burden of proof. W. Inspection and entry. The operator shall allow the department as the board's designee, the VSMP authority, EPA, or an authorized representative of either entity (including an authorized contractor), upon presentation of credentials and other documents as may be required by law to: 1. Enter upon the operator's premises where a regulated facility or activity is located or conducted, or where records must be kept under the conditions of this general permit; 2. Have access to and copy, at reasonable times, any records that must be kept under the conditions of this general permit; 3. Inspect and photograph at reasonable times any facilities, equipment (including monitoring and control equipment), practices, or operations regulated or required under this general permit; and 4. Sample or monitor at reasonable times, for the purposes of ensuring state permit compliance or as otherwise authorized by the Clean Water Act or the Virginia Stormwater Management Act, any substances or parameters at any location. For purposes of this section, the time for inspection shall be deemed reasonable during regular business "' hours, and whenever the facility is discharging. Nothing contained herein shall make an inspection unreasonable during an emergency. UMW .,. General Permit No.: VAR10 Page 21 of 21 X. State permit actions. State permits may be modified, revoked and reissued, or terminated for cause. ... The filing of a request by the operator for a state permit modification, revocation and reissuance, or termination, or a notification of planned changes or anticipated noncompliance does not stay any state permit condition. Y. Transfer of state permits. 1. State permits are not transferable to any person except after notice to the department. Except as provided in Part Ill Y 2, a state permit may be transferred by the operator to a new operator only if the state permit has been modified or revoked and reissued, or a minor modification made, to identify the new operator and incorporate such other requirements as may be necessary under the Virginia Stormwater Management Act and the Clean Water Act. 2. As an alternative to transfers under Part Ill Y 1, this state permit may be automatically transferred to a new operator if: Imo a. The current operator notifies the department at least 30 days in advance of the proposed transfer of the title to the facility or property; .. b. The notice includes a written agreement between the existing and new operators containing a specific date for transfer of state permit responsibility, coverage, and liability between them; and c. The department does not notify the existing operator and the proposed new operator of its intent to modify or revoke and reissue the state permit. If this notice is not received, the transfer is effective on the date specified in the agreement mentioned in Part Ill Y 2 b. 3. For ongoing construction activity involving a change of operator, the new operator shall accept and maintain the existing SWPPP, or prepare and implement a new SWPPP prior to taking over operations at the site. .. Z. Severability. The provisions of this general permit are severable, and if any provision of this general permit or the application of any provision of this state permit to any circumstance, is held invalid, the application of such provision to other circumstances and the remainder of this general permit shall not be affected thereby. ion wos r 12 ISM Section 12.
