Yes, if the sight line is within the ROW, an easement is not required.

Much appreciated, I actually have/had that comment letter but had sent out the attached follow-up question to
VDOT. I never received an answer back but eventually just dropped the issue as other plans have went through
the review process and VDOT never required the offsite easement be it was within the prescriptive right-of-
way. Thus I have since applied that same logic to this review as well.

Dear Mr. Perez:
The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced dedication plat as submitted by Roger W. Ray &
associates dated April 6, 2016 and revised May 25, 2016, and offers the following comments;
VDOT has no objection to the dedication plat.
A VDOT Land Use Permit will be required prior to any work within the right-of-way. The
owner/developer must contact the Charlottesville Residency Transportation and Land Use
Section at (434) 422-9399 for information pertaining to this process. If further information is
desired please contact Willis C. Bedsaul at (434) 422-9866.

SUB2016-108 Forge Farm-BLA, which is the plat dedicating right of way for Sunset Overlook SDP2016-3.
Who at VDOT is reviewing the above ref BLA plat?
There appears to be a need for an off-site sight distance easement on TMP 76-52E and 76-52D. I am inquired
with VDOT for final determination whether the easement is required to be platted or if it being located in the
prescriptive right-of-way negates the need for an easement.

The County of Albemarle Planning Division will grant or recommend approval of the Subdivision Plat
referenced above once the following comments have been addressed: [Each comment is preceded by the
applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [32.5.1(c)] There appears to be a need for an off-site sight distance easement on TMP 76-52E and 76-
52D. I have inquired with VDOT for final determination whether the easement is required to be platted
or if it being located in the prescriptive right-of-way negates the need for an easement. This plat shall
not be approved till VDOT has reviewed/approved the plat. VDOT review is pending, once received
staff will be forwarded the comments to you.
2. [14-302(B)(1)] General information. Provide the date of the last revision.
3. [Comment] Engineering had no objections or comments on the plat.
Staff has provided references to the County Code. The Code is kept up-to-date by the County Attorney's
office and may be found at www.albemarle.org/countycode. In accord with the provisions of Section 14-
229(B) of Chapter 14, if the applicant fails to submit a revised plat to address all of the requirements within
six (6) months after the date of this letter, then the application shall be deemed voluntarily withdrawn.
