Charlottesville VA 22902 SDP201600025 Briarwood Recreational Area - initial site plan Mr. Collins, The Agent for the Board of Supervisors hereby grants administrative approval to the above referenced site plan. This approval shall be valid for a period of five (5) years from the date of this letter, provided that the developer submits a final site plan for all or a portion of the site within one (1) year after the date of this letter as provided in section 32.4.3.1 of Chapter 18 of the Code of the County of Albemarle, and thereafter diligently pursues approval of the final site plan. In accordance with Chapter 18 Section 32.4.2.8 Early or Mass Grading may be permitted after the following approvals are received: 1. Approval from the ARB 2. Approval of the Special Use Permit (SP) to fill in the floodplain 3. FEMA approval of the CLOMR-F The final site plan will not be considered to have been officially submitted until the following items are received: 1. A final site plan that satisfies all of the requirements of section 32.6 of Chapter 18 of the Code. 2. A fee of $1,613. Please submit 10 copies of the final plans to the Community Development Department. The assigned Lead Reviewer will then distribute the plans to all reviewing agencies. Once you receive the first set of comments on the final site plan, please work with each reviewer individually to satisfy their requirements. Perez, Senior Planner Division: Planning Date: June 7, 2016 Subject: SDP201600025 Briarwood Recreational Area - initial site plan Fax 434-972-4126 The County of Albemarle Planning Division will recommend approval of the plan referenced above once the following comments have been satisfactorily addressed (The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated based on further review.): [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] 1. [30.3.11] The proposal requires a Special Use Permit (SP) to fill in the floodplain. Prior to final site plan approval this item shall be applied for and acted on by the Planning Commission (PC) and Board of Supervisors (BOS). Per discussions with County Engineering the SP shall not be approved until FEMA approves the CLOMR-F. 2. [32.7.2.1, 32.5.1(c), 32.5.2(1), 32.5.2(m)] Vehicular access to the site. The access road, access easement, and grading outside of the access easement are proposed on TMP 32E-2, which is owned by Ray Beard. Prior to final site plan approval the easements required to construct the road shall be obtained from Mr. Beard and platted. Easement plats shall be reviewed by the County and then recorded in the Clerk's Office. The DB page information of this action shall be provided on the final site plan. 3. [32.5.2(n), 32.7.2.31 Sidewalks. Sidewalks shall be provided on one or both sides of the proposed access road from St. Ives Road to the parking lot. 4. [32.5.2] General. On the cover sheet revise the tax map parcel information to include TMP 32E-2, which is owned by Mr. Beard. 5. [32.7.2.1, 4.6.1, ZMA95-20, ZMA79-321 Prior to final site plan approval the road plan (SUB2016-8) for the new section of St. Ives Road shall be approved and built or bonded. 6. [32.7.2.1] Vehicular access to site. The entrance onto the public street shall be designed and constructed as required by the standards of the Virginia Department of Transportation. VDOT approval of the entrance to the site shall be required prior to final site plan approval. 7. [4.12.15(a)] Surface material. Label the surface material for the access road, the parking area, and the trails throughout the park. 8. [32.5.2(n), 32.5.1(c)] Dimensions. Dimension all proposed improvements, including parking spaces, drive aisles, trails, sidewalks, picnic shelter, basketball courts, fencing and the multi-purpose field. 9. [32.5.2(1)] Watercourses and other bodies of water. On the plan depict and label the North Fork Rivanna River. 10. [32.5.2(n), 4.16.2.11 Existing and proposed improvements. Due to the park's proximity to the river, for the safety of park users, provide fencing along the new 100 year floodplain. Chain link or metal bar fencing is appropriate (provided ARB does not object). Depict, label, dimension, and provide a detail for the proposed fencing. 11. [32.5.2(a)] General information. For TMP 32G-1 the zoning provided on sheet 2 is not correct. Revise or omit such information from sheet 2. Also, revise the zoning provided on sheet 1 for TMP 32G-1 to include Entrance Corridor (EC) zoning. 12. [32.5.2(a)] General information. On the final site plan assure that the zoning of TMP 32E-2 includes PRD, ZMA1995-20 w/ proffers. 13. [32.6.2(j)] Landscape plan. A landscape plan that complies with section 32.7.9 is required with the final site plan. 14. [32.5.2(e)] Existing landscape features. Show the existing landscape features (as described in 32.7.9.4) on the existing conditions sheet. 15. [32.5.2(e), 32.7.9.4(c)] Existing landscape features. On the landscape plan identify existing wooded areas as either evergreen, deciduous, or a mix thereof. 16. [32.5.2(n)] Existing and proposed improvements. Clearly depict and label limits of disturbance and show areas where existing vegetation will be removed. 17. [32.5.2(b)] Proposed use. List the minimum square footage occupied by the tot lot/recreational area. 18. [32.5.2(b)] Proposed use. Provide the maximum height of the picnic shelter. 19. [32.5.2(n)] Proposed improvements. Depict, label, and dimension the trash receptacles. 20. [32.5.2(j)] Existing sewer and drainage facilities. Depict the location and size of existing water and sewer facilities and easements. 21. A specific section of code was discussed. Code 18-30.3.11 -Permitted and Prohibited Uses and Structures (Table, p. 18- 30- 12.4, online .PDF); Stream Crossings and Grading Activities, provides the following impermissible use in the regulatory floodway, but by -right use in the floodway fringe: "Grading activities in compliance with the Water Protection Ordinance; provided that it is demonstrated, in a floodplain impact plan that the grading will have no impact on the elevations or limits of the floodplain and furtherprovided that any cut or fill shall be only to Icvel areas for playfields, correct erosion problems, build trails, or other itne grading activities which will have no impact on the floodplain." May 19 discussion /proposal to maintain current limits of floodplain by placing 14'f fill in the floodplain to a final (recreational field) elevation slightly lower than (FIRM Panel 51003C00145D) base flood elevation —in effect, a design that may submerge the recreational area during the I% statistical event —was discussed with Departmental Director and Zoning Administrator on May 26. Please accept that any proposal to place approximately 14' of fill within the floodplain to final elevation slightly lower than current effective FEMA FIRM Map panel base flood elevation does not meet the intent of italicized text above. That is: "to level areas for playfields" intends fine grading that removes surface irregularity or variation; it does not intend substantial cut (export) or fill (import). Applicant is directed to series of emails, April 27, 2016 3:13 PM through 5/9/2016 2:31 PM, attached to this note for guidance and direction on floodplain issues. Further, Applicant may appeal determination of meaning of level areas for playfields or other fine grading to the board of zoning appeals. Show the existing RWSA 14" cast iron water main throughout the entire project area (currently ends at the property line between TMP 32G-1 and TMP 32E -1A). 2. The western boundary of TMP 32G-1 does not match RWSA records. Please confirm the location of the property line and whether the RWSA 14" water main continues onto the property from TMP 32E -1A (owned by RWSA). 3. No grading will be allowed on RWSA property (see above comment). If possible, grading over the water main should be avoided to minimize impacts to the high pressure main. 4. If grading over the RWSA water main cannot be avoided, grading shall not cause cover over the water line to exceed 8' or be reduced to less than 3.5'. Care shall be taken during grading to protect the existing main. 5. The proposed drainage swale adjacent to the RWSA water main should be moved away from the water main (min 10' separation).
