Dear Messrs. Goodall and Stone,
As previously discussed by phone and via email, it is my opinion that the proposed Starr
Hill Hops Festival is permitted as an accessory or subordinate retail use. The purpose
of this letter is to create an official record of this determination.
The Starr Hill Hops Festival (aka IPA Jambeeree) was described for staff by Starr Hill in
a Community Development Department preapplication conference on February 22,
2016. The preapplication submittal includes a "preliminary site plan" and a written
description of the event overview (attached). This determination is made in reliance on
that description. As discussed, if the event expands or changes beyond what was
proposed, we should discuss whether it remains an accessory use or becomes a use
available only by special use permit.
The proposed Starr Hill Hops Festival is generally described as follows:
The purpose of the event includes education about IPAs as well as featuring and
showcasing the Starr Hill IPAs.
It will take place at Hangar Park across the street from the Brewery and Tap
Room;
It will feature over 40 different IPAs from 10-15 breweries;
• It will involve live music;
While tastings from the other breweries are available, only Starr Hill brews are
available for purchase;

All of the properties proposed to be involved in this use are: a) zoned to allow the use
and b) currently used in some way for Starr Hill brewery. The brewery use (active and
passive) currently crosses property boundaries to involve multiple parcels. While the
definition of primary and accessory use in the Albemarle County Zoning Ordinance
refers to activity occurring "upon the same lot," that is not the case here and we can
consider the property collectively as the brewery.
Subordinate retail sales are allowed in association with an industrial use such as
manufacturing beer (Section 26.2(a)). A festival involving retail sales is not listed as a
prohibited use (Section 26.2 (d)). Accessory uses (defined in Section 3.1) are allowed
in conjunction with primary uses such as manufacturing. This proposed accessory use
is consistent with the accessory use regulations found with Section 26.2 (c).
It is my opinion that the proposed Festival is permitted as an accessory use to the
brewery. This decision is. based on the following:
• Retail sales and tastings occur during regular business hours at the brewery.
This event is an extension of that (sales and tastings) and helps "grow" the
brand.
• As noted, only Starr Hill brews are available for sale. This is a critical distinction
between this festival and other larger festivals that wouldn't be considered an
accessory use.
• Based on research into usual and customary activities in the region, we have
found this type of event to commonly occur. Examples are Lickinghole's Despot
Day, Brothers Brewering's Resolute Day, Hardywood's Gingerbread Stout Day
and Blue Mountain's Dark Hollow Release.
• This event falls within the Starr Hill ABC manufacturing license as a banquet
license. This license covers all activities. This event is sponsored and run by
Starr Hill. This is another distinction between this festival and other larger
festivals that wouldn't be considered an accessory use.
• The scale of the festival is reasonably consistent with the scale of traffic during
this timeframe. The anticipated number of attendees (1600) is no more than the
number of visitors on a typical weekend.
• This temporary use can be accommodated within the property proposed. It is
subject to a zoning clearance for public health and safety review.
In rendering this opinion, we carefully considered how this proposed Festival is distinct
from a general brew fest. In addition to the reasons cited above, this is a Starr Hill
promotion. It is not a commercial event drawing multiple breweries, all selling their own
beer.
If the event should change substantially in character, scale, purpose or operation,
please contact the Zoning Administrator well in advance of any future intended festival
date. This is to allow sufficient time to a) for a determination of whether a special use
permit is required and b) if required, time necessary to go through the more involved
special use permit process. Be advised that a special use permit approval takes 4-6

months.
Because this is an official determination, it is eligible for appeal. Therefore, I will provide
the standard appeal language.
If you are aggrieved by this determination, you have a right to appeal it within ten (30)
days of this notice, in accordance with Virginia Code § 15.2-2311; provided, however,
that a ten (10) day appeal period applies to appeals of decisions pertaining to temporary
or seasonal commercial uses, and such appeals shall be filed within ten (10) days after
this decision. If you do not file a timely appeal, this determination shall be final and
unappealable.
An appeal may be taken only by filing an appeal application with the Zoning
Administrator and the Board of Zoning Appeals, in accordance with Albemarle County
Code § 18-34.3, along with a fee of $240 plus the actual cost of advertising the appeal
for public hearing.
Applications for Appeal of the Zoning Administrator's Determination are available at the
Department of Community Development located at 401 McIntire Road, Charlottesville,
Virginia 22902 or online at www.albemarle.org/cd_a-pps. This form applies to appeals of
decisions of the zoning administrator or any other administrative officer pertaining to the
Zoning Ordinance.

outlined in Albemarle County Code § 18-34.3, which may be reviewed online at

EVENT DESCRIPTION
A one -of -a -kind new festival that celebrates crafting great times, india Yale Ales and live
music in Virginia. The proposed date and location is Saturday, June 25 at the Hangar Park,
across the street from the Starr Hill Brewery & Tap Room at 5931 Three Notch'd Road in
Crozet, Virginia, The Hangar Park is a unique event space combining the industrial grit of
the area with scenic views of the Blue Ridge Mountains. Expected attendance for the first
year event is approximately 1,500 people with capacity being as high as 2,500-3,000
Craft beer fans will sample over 40 different IPAs from more than a dozen Virginia
breweries, featuring the release of numerous rare and exclusive offerings from Starr Hill, as
well as partake in educational sessions and interactive exhibits with local hop growers. A
show -stopping lineup of live music performances round out the ultimate Starr Hill
experience alongside local food trucks, fun recreational games, and proceeds to benefit a
local charity.
