SUBJECT: ZMA- 7S -1�6, Liberty Land Ltd.
At its meeting of October 24, 1979, and at the instance of
Dr. Prindle, the 3oard changed Condition #5 placed on the above
zoning request on June 6, 1979, to read as follows:
5. Virginia Department of Health approval of two septic
field locations on each lot. The Health Department
shall either supervise or test each lot utilizing
soil tests by a qualified soil scientist and under-
take or ,supervise percolation tests as these may
be requi-.2ed. Such tests must demonstrate that two
septic d: ^ainfields can be located on each lot without
encroaching on any slope exceeding 25 %. Septic tanks
and /or d: ^ainfields shall not be located on any slope
of 25% o:^ greater. Any lot not having adequate septic
system sate shall be combined with a building lot
and /or added to the common open space.

the following conditions:
I. Approval itcxrfor a maximum of 208 dwellings subject to conditions
contained herein. Locations and acreages of various land uses
shall comply with the Approved Plan - Sheets 1, 2 and 3.' In the
final aite plant and subdivision process, open space shall be

8. Fire Official approval of fire protection system. Such system

REVISED CONDITIONS CAI APPROVAL - ZMA- 79 -06.
1. Approval is for it maximum of 208 dwellings subject to conditions contained
herein. Locations and acreages of various land uses shall comply with the
Approved Plan - Sheets 1, 2, and 3. In the final site plan and subdivision
process, open spice shall be dedicated in proportion to the number of lots approved;
2. No grading or clearing shall occur_ within any area of the site until final
site plan and /cr subdivision plat has been obtained for that area;
3. No grading or construction on slopes of 250 or greater except as necessary for
road construction as approved by the County Engineer;
4. All lots shall be! served by one or more central water systems approved in
accordance with the regulations of the Virginia Department of Health, the
Code of AlbemarlE! County, and all other applicable law;
5. Virginia Department of Health approval of two septic field locations on each
lot. In such approval, the Health Department shall be mindful of the County's
intent to discourage the location of septic tanks and /or drainfields on slopes
of 25% or greater, since such practice has been described as questionable by
the Health Department and by the applicant's soils scientist. Any lot not
having adequate septic system sites shall be combined with a buildable lot and /or
added to the common open space;
6. County Attorney approval of homeowners' association agreements prior to final
approvals;
7. Virginia Departnietnt of Highways and Transportation approval of access to Route
250 East. Roads shown as public roads on the Approval Plans Sheet 2 shall be
designed and constructed to Virginia Department of Highways and Transportation
