Maupin's request to rezone 73 5 acres from A-I to RPN/~:- subject to the following conditions 1. Approval is fQ)~ a maximum. of 47 lots Location and acreages of land uses shall comply with the approved plan. Open space shall be dedicated in accordance with the number of lots approved in the final subdivision process 2 No grading stall occur ur.:til final so.:.bdivision approval; 3. Compliance with Soil Erosion and Runoff control Ordin~~ces; 4 County Attorney approval of Honeowners Agreements prior to final stilidivision approval to include the use of open space for septic facilities and for private road maintenance agreements 5 Health Departmer.t approval of two septic field locations on each parcel prior to final subdivision approval; 6 Fire Official approval of hydrant locations; 7. Only those areas where a structure, utilities, road or other imp~ovement in a final plan axe to be located shall be disturbed; all other land shall remain in its natural state; 8 All units are tc be served by public water supply system and approved by the appropriate agencies prior to final subdivision approval; 9 Compli~'ce with the private road ordinance prior to final subdivision approval including County Engineer approval of road plans; La Virginia Department of Highways and Transportation approval of entrances on Routes 691 anj 684, and frontage improvements, prior to final subdivision approval; Ll The Homeowners Agreements shall contain a provision requiring that the land now in and around p01ds be protected against erosion should the dams fail and not be replaced; .L2 Lots A8, A9, a1d AIO in Area "X" may be sold as one parcel with Area "X" to remain in open space If at any tine, lots AS, A9 or AIO become subject to separate ownership, Ar,~a "X" shall becone part and parcel of the total open space provided for in the RPH and subject to all provisions of the Homeowners Agreements Sincerely, d:n~C:,:~:n:r 1- ,~ ~.
