On April l!>, 1981, the Albemarle County Board of Supervisors
approved your request for rezoning, ZMA-81-11 for Earlysvllle
Forest P.U D
Due to a clerical error in our staff report, a condition
of approval was lnadvertently left out The conditions of
approval, as they appear in the official mlnutes of the Board
of Supervisors are as follows

"he Albemarle County Board of Supervisors at its meeting on April 15, 1981,
uoted to approve th2! above-referenced request, as recommended by the Planning
Commission, subject to the following conditions
II. General
1. No final si_e plan or subdivision approvals shall be given until three
(3) copies of a revised preliminary plan for the entire development,

submi tted to .the Department of Planning. Such plans shall be

6. County Fn9incer approval of dam specifications; County Engineer and
Zoning Dcpartmcnt inspection of dam construction;
7. The public recreation area shall be dedicated prior to any site plan
or subdivision approval;
8. Only those areas where a structure, utilities, streets, pedestrian
ways, lakes, or other improvements are to be located shall be disturbed;
all other lclnd shall remain in its natural state;
9. Developer will provide sedimentation control provisions to protect
Chris Greene Lake until the lakes are constructed, subject to approval
of the County Engineer.
B. Commercial Area
1. No commercial use shall be approved until 100 residential lots have
been approved and recorded;
2. Uses permitted within the commercial area may be established as follows

(2) Clothing, apparel and shoe shops;

(10) NE!W::; tands, magazines, pipe and tobacco shops;
(11) Optical goods;
(12) Pho.tographic goods;
(13) Vtsual and audio appliances;
(14) Sporting goods; I
(15) RE!tail nurseries and greenhouses.
b. The following services and public establishments
(1) Administrative, professional offices;
(2) BClrber, beauty shops;
(3) Cburches, cemeteries;
(4) Clubs, lodges - civic, fraternal, patriotic;
(5) Financial institutions;
(6) Fire and rescue squad stations;
(7) F\:.nera1 homes;
(8) Health spas;
(9) Indoor theaters;

multi-legged tower structures and including poles, lines,
transformers, pipes, meters and related facilities for
distribution of local service and owned and operated by a
public utility. Water distribution and sewage collection

by the Albemarle County Service Authority;
Public uses and buildings such as schools, ott~ces, parks,
I>laygrounds and roads funded, owned or operated by local,

main or trunk lines owned or operated by the Rivanna Water
,md Sewer Authori ty;
Temporary construction uses;
'l'emporary events of local non-profit organizations;

c. By sfec:ial use permit
C. Roads
(1) Commercial recreation establishments;
(2) Electrical power substations, transmission lines and related
t:owers; gas or oil transmission lines, pumping stations and
Clppurtenances; unmanned telephone exchange centers, micro-
~'ave and radio-wave transmission and relay towers, substations
,lend appurtenances;
(3) Eospitals;
(4) Fast food restaurant;
(5) Veterinary office and hospital.
1. County Engineer approval of private road plans.
2. Virginia Department of Highways and Transportation approval of public
road plans prior to any final site plan or subdivision approvals. In
such revie"., Virginia Department of Highways should be mindful of the
County's in.tent to limit encroachment of the public road on Earlysville
Heights to the maximum extent practical.
3. Prior to any final approval, the applicant shall propose a method of
buffering adjacent lots in Earlysville Heights from the public road.
If practical, such buffer shall be installed prior to any grading and/or
constructicn.

D. Uti 1i ties; Fire Protection
1. Virginia D~partment of Health approval of two (2) septic field locations
wi thin e.3.ch lot prior to Planning Commission approval of any such lot.
Any lot not having adequate septic field location shall be combined with
a build~)le lot and/or added to the common open space. In addition,
Homeowne:rs' Association agreement shall include provision for use of open
space fo'" residential septic drainfields, if necessary;
2. All uses shall be served by one or more central water systems in
accordanee with the regulations of the Virginia Department of Health,
the Code of Albemarle County, and all other applicable law. Water lines
and appuJ:tenances shall be sized and designed in accordance with Albemarle
County Sl~rvice Authority specifications for possible future acceptance;
3. If a cen_ral well system is employed, Fire Official approval of appurtenances
for futUJ=e possible fire hydrant installations. Fire Official approval of
appurtenan:::es for future possible fire hydrant installations. Fire Official
approval of dry hydrant system prior to issuance of any certificate of occupancy;
4. If a public: water system is employed, Fire Official approval of hydrant
location!> .3.nd fire flow prior to issuance of any certificate of occupancy;
5. A building separation of 100 feet shall be maintained for dwellings.
