This letter is to inform you that on September 8, 1981, during the
regular meeting of the Albemarle County Board of Zoning Appeals, your
application for VA-81-53 was granted with the condition that they would
put in adequate screening along the northwest corner to the satisfaction
of the Planning Commission. This variance allows're3ief from Section
21.7.2 of the Albemarle County Zoning Ordinance to allow a structure to
be located 34 feet from the adjoining residential distr,-ct; a variance
of 16 feet.

Zoning Ordinance Requirement
Pursuant to Section 21.7.2, Adjacent to residential and agricultural
districts: No portion of any structure except signs advertising sale
or rent of the property shall be located closer than fifty (50) feet
to any residential or agricultural district.
Staff Recommendations
Staff would have to recommend denial. The lot does not present a hardship
for development to meet the requirement of a 50-foot setback,

Under Section 4.12.6.6.2, "Schedule of Specific Requirements for
Number of Off -Street Parking Spaces - Over -the -Counter Sales: One (1)
space per fifty (50) square feet open to the public or one (1) space
per two hundred (200) square feet of gross floor area, whichever shall
be greater."
If the business provides for over--the-counter sales to the public,
this would be applicable For the applicant's 4,400 square foot floor
area, 22 parking spaces should be provided.
