The Property is subject to the Airport Impact Area Overlay ("AIA"), the Entrance Corridor ("EC") Overlay District, and the Steep Slopes Overlay as described in Section 30 of Chapter 18 of the Albemarle County Code ("Zoning Ordinance"). The Four Seasons Apartment development was built under Conditional Use permit (CU) 111, which served to rezone the property on July 17, 1969 to a Planned Community with a density not exceeding 390 units in the area designated as "apartment tracts." Our records indicate that 310 dwelling units were built. Though we have a plan that shows the development (SDP -136), our files are incomplete and we do not have an approved site plan. Therefore, the apartments may continue as they exist. Changes have been made to the site that have been approved with various site plan amendments. The addition of the pool and the community building were approved respectively with SDP1999-00144 on 4/25/2000 and SDP2007-00056 on 1/31/2008. One additional site plan SDP2008-00126 was approved for some minor landscaping changes near the community building on 911112008. * The site appears to be in compliance with all approved site plans. ■ There is a variance (VA1985-00055) approved for sign size and setback on 111411986. This approval is moot since the current sign size and setback meet the current regulations for signs in a PUD zoning district. a The apartment complex was built in the 1960s prior to Albemarle County having a building code, and no Certificates of Occupancy were issued at that time. Subsequent renovations have been done that have not required Certificates of Occupancy. In 2001 and 2008 permits were issued for a swimming pool, pool equipment building and the community buildinglleasing office, respectively. 0 This office has no record of an open zoning of Building code violation for this Property. Are there any open code violations (Zoning, Building and Fire Code violations) on file? If so, please provide copies. 4. Were there any special permits, variances or site plans issued? If so, please provide copies. 5. Please attach any site plans, ordinances, or final building permits on file. 6. Please attach copies of the Certificates of Occupancy that have been issued for the property. If there are none available, please explain and state the number of approved units. Final permits will suffice if copies of Certificates cannot be found. 7. Please state in the letter how many units that were approved to be constructed. Are there any known illegally built units?
