MacCall BACKGROUND: The subject parcel, Tax Map 60 Parcel 46B, contains .647 acres and is located on State Route 601 (Old Ivy Road) in the Jack Jouett Magisterial District, and is zoned C-1, Commercial (Attachment A). The applicant is requesting an eighteen (18)month extension of SDP-1998-137, 2222 Old Ivy Offices Building(Attachment B). The site plan was approved on September 23, 1998 and is valid for five (5) years. DISCUSSION: SDP-1998-137- 2222 Old Ivy Office Building Final Site Plan was approved by the Planning Department on September 23, 1998. Section 32.4.3.8 (a) of the Zoning Ordinance states that"An approved final site plan shall be valid for a period of not less than five (5)years after the date of approval thereof..." The five years was up on September 23, 2003. A request was made to the Planning Commission and granted back on August 19, 2003,per Section 32.4.3.8 (b), for an eighteen(18)month extension of the original approval. That approval expires on March 22, 2005. A new request is being made for an additional eighteen (18)months. There are still legal matters being worked out by the parties involved that have delayed the construction of the site (Attachment C). Part of staffs review entails reviewing the request against any changes that have occurred in the Comprehensive Plan and County Code that would affect site plan if it were submitted today for review. Staff has not identified any significant change in ordinances that would not permit the site to develop as is. Staff believes that these unforeseen legal events have impeded the applicants abilities to move forward with the site plan and that an additional eighteen(18)month extension would not be inappropriate in this case. Any additional extension will warrant further evaluation. RECOMMENDATION: Staff recommends approval of the request. Attachments: A. Tax Map/Vicinity Map B. Site Plan Reduction C. The Albemarle County Planning Commission Albemarle County Office Building Room 227 401 McIntire Road Charlottesville, VA 22902 Re: 2222 Old Ivy Road Office Building Extension of Approved Site Plan Dear Members of the Planning Commission: On July 17, 2003, I wrote to you requesting an extension of the site plan for the above office building project. The approval of the site plan was then supposed to expire on September 22, 2003. An extension until March 22, 2005, was granted at that time. I am again writing to request an extension of the approved site plan for another 18 months and am enclosing the check of Investors Management, Inc. in the amount of$45.00 to pay the fee for such request. As indicated in my earlier letter, the owner and developer of the project, Mr. Bill Heischman, had died on February 25, 2003, and the estate would take some time to settle. Because of significant litigation concerning a tree which fell in a severe wind storm on June 6, 2002, and injured a man on Old Ivy Road, there have been significant delays.in the filing of tax returns and other administrative matters. These delays will probably mean that the Estate will not be able to be settled for at least another 12 months. Therefore, in accordance with Article 32.4.3.8(h) of the Albemarle County Code, and due to unavoidable delays arising from the death of Mr. Heischman and matters arising in the administration of his estate, I request the Commission grant an additional 18 month extension of the approved site plan. The reason for the request is that the owner/developer, Bill Heischman,passed away in February of this year. No physical work on site has happened but the process was started to secure the appropriate individuals to construct the site. The executor of Mr. Heischmans estate has stated that it would take eighteen (18) months to settle the estate. Staff believes that the owner was making a considerable effort to get the development started and would be well underway with the onsite work if he had not passed away. July 17, 2003 The Albemarle County Planning Commission Albemarle County,Virginia Re: 2222 Oid Ivy Road Office Building Extension of Approved Site Plan Dear members of the Planning Commission, The approved final site plan for the above referenced project will expire September, 22, 2003. Now The Owner and Developer of this project, Mr. Bill Heischman,passed away on 2/25/2003. Wachovia Bank, the executor for the estate of Mr. Heischman, has indicated that settlement of the estate's affairs is likely to take eighteen months. In conformance with Article 32.4.3.8 (b) of the Albemarle County Code, and due to the passing of the projects Owner and Developer, I request the Commission grant an eighteen month extension of the approved site plan.
