The County Attorney and I have reviewed the title information for the above -noted property. It is
the County Attorney's advisory opinion and my official determination that Tax Map 89, Parcel 65
is comprised of eight (8) parcels of record with twenty (20) theoretical development rights. The
basis for this determination follows.
Our records indicate Tax Map 89 Parcel 65 contains 118.266 acres and zero (0) dwellings. The
property is zoned RA, Rural Areas.
The most recent deed for this property, recorded prior to December 10, 1980, the date of
adoption of the Zoning Ordinance, is recorded in Deed Book 686, page 599 and is dated
October 13, 1979.

record mentioned above, the 5.Oac and the 4.0 ac. These two parcels were not
properly identified at the time of the creation of the 2.1 acre+'- parcel thus the
exact area of each of the two parcels cannot be determined with this letter.
The 5.0 acre parcel is determined to have one (1) development rights
because the portion of the 5.0 acres that was used to create the 2.1 acres
appears to be large enough to result in a parcel below 4.0 acres.
The 4.0 acre parcel is determined to have only one (1) development right
because the portion of the 4.0 acres that was used to create the 2.1 acres
appears to be large enough to result in a parcel below 4.0 acres.
By December of 1980 the 5.0 and 4.0 acre parcels would have each been
below 4 acres thus would have been assigned one (1) development right. A
new survey would be needed to clearly identify how much of the 5.0 and 4.0
acre parcels is part of the 2.1 acre parcel for either the .5.0 or 4.0 acre .
parcels to have more than one development right.

*** One (1) development right was assigned to TMP 89-65B with the plat recorded
in DB 1712 P 449. It appears that TMP 89-65B is comprised of portions of four
parcels of record mentioned above. That being the case, it would appear that the - - --
development right would have to be derived from the 31.0 acre parcel. Without a
new survey clearly identifying where all of the property line are for these parcels
of record it will remain unclear which parcel of record the one (1) development
right assigned to TMP 89-65B comes from. The property owner is advised to
revise the plat for TMP 89-65B so that it is clear which parcel of record the
development right is coming from.
The parcels are entitled to the noted development rights if all other applicable
regulations can be met. These development rights may only be utilized within the
bounds of the original parcel with which they are associated. These development rights
are theoretical in nature but do represent the maximum number of lots containing less
than twenty one acres allowed to be created by right.
If you are aggrieved by this determination, you have a right to appeal it within thirty days
of the date notice of this determination is given, in accordance with Section 15.2-2311 of
the Code of Virginia. If you do not file a timely appeal, this determination shall be final
and unappealable. An appeal shall be taken only by filing with the Zoning Administrator
and the Board of Zoning Appeals a notice of appeal which specifies the grounds for the
appeal. An appeal application must be completed and filed along with the fee of $240.
The date notice of this determination was given is the same as the date of this letter.
