Perez, Senior Planner Division: Planning Date: July 14, 2016 Subject: SUB201600104 Inglewood Terrace — Road Plans Fax 434-972-4126 [4.6.1, 4.6.6, 32.7.2.1, 32.7.2.2, 32.5.2(m)] Access. The private street serving the development is proposed within an existing publicly dedicated right-of-way, this is not approvable. VDOT never accepted the portion of the right- of-way labeled as `Unimproved Inglewood Drive' into the State Secondary System and the County still owns it. Either pursue vacation of the right of way pursuant to State Code 15.2-2272 prior to final site plan and/or final subdivision plat approval OR revise the proposed road to be public and upgrade the existing roadway to meet current VDOT standards from the point where VDOT maintenance ends. This will include a suitable turn around at the new proposed end of state maintenance, removal of the existing parking area, continuation of curb and gutter, tie in of the existing driveway of TMP 061 KO-05-OD-00400, and the dedication of right-of-way or easements as necessary. Please show these improvements and easements or right-of-way prior to final site plan and/ or subdivision plat approval. 2. [4.6.1, 4.6.6, 32.7.2.1, 32.7.2.2, 32.5.2(m)] Access. The roadway proposed within the existing 50 foot publicly dedicated right-of-way is labeled as "public road"; however, numerous conversations with the applicant and the last comment response letter for the final site plan insist that this section is to be a private driveway not to be accepted and maintained by VDOT. On the road plan assure the labeling of this roadway matches up with the applicant's true intent. Without a vacation of the right-of-way the road shall be a public road to be accepted into the State's Secondary System. A private road within the publicly dedicated right-of-way will not be approved. 3. [14-233(B)1, 14-233, 14-234(C), 14-2341 Private streets in the development areas. If the development insists on a private street to serve the development, submit a private street request and all of the required justification mentioned in section 14-234 of the Subdivision Ordinance. This private street request will be reviewed administratively due to the presence of attached dwellings, as provided for in Section 14-233(B)1; however, without a vacation of the existing public right-of-way mentioned in comment #1 & #2 above, staff will either deny the request or approve the request with the vacation as a condition of approval. 4. [14-422(E) & (F), 14-203.1, 14410(H)] Exception to sidewalk and planting strip requirements. Sidewalks and planting strips shall be established on both sides of each new street. It is suggested that the exception request submitted for the above mentioned requirements not move forward to the Planning Commission for action till after the access issues mentioned in comment #1 and #2 are resolved. 5. [14-422(E) & (F), 14-203.1, 14410(H)] Exception to sidewalk and planting strip requirements. Sidewalks and planting strips shall be established on both sides of each new street. The exception request submitted for the above mentioned requirements is incomplete and needs to be revised prior to the item moving forward for Planning Commission review/consideration. A subdivider requesting an exception shall submit to the agent a written request stating the reasons for the request and addressingthe he applicable findings in Section 14-203. 1 (B)3. Please revise the request to also provide the following required findings: 3. Findings required for an exception. The agent or the commission may approve a request for an exception from any requirement of the applicable regulation upon finding that: (i) because of an unusual situation, including but not limited to, the unusual size, topography, shape of the site or the location of the site; or (ii) when strict adherence to the requirements would result in substantial injustice or hardship by, including but not limited to, resulting in the significant degradation of the site or to adjacent properties, causing a detriment to the public health, safety or welfare, or by inhibiting the orderly development of the area or the application of sound engineering practices. 6. [32.7.2.2, 14410(H)&(I), 14-422, 14-203.11 Streets and travelways. Each public street and travelway within a development shall be designed and constructed to the standards of MOT. Also, each private street and travelway within a development shall be designed and constructed to the standards for private streets in chapter 14. Regardless of how the access issue mentioned in comment #1 and #2 are addressed provide curb or curb and gutter, sidewalks and landscape strips on both sides of the proposed street that is depicted within the existing 50 foot public right-of-way to the existing end of state maintenance. Otherwise revise the applicable exception request and justifications required pursuant to section 14-422(E)&(F) and 14-203.1 to include this portion of roadway for consideration, and provide the required exception request and justifications required to seek an exception to the requirement for curb or curb and gutter pursuant to section 14-410(H)&(I) and 14-203.1 7. [Comment] The existing asphalt parking fronting TMP 061KO-05-OD-00400 is depicted as remaining in the 50 foot public right-of-way; however, these spaces shall be removed unless VDOT approves their location on the road plan and is willing to maintain them. 8. [32.7.9.41 Street trees. The required street trees are proposed outside of the right-of-way due to conflicts with easements. Thus they have been provided on individual lots. These trees shall be within landscape easements, which shall be depicted on the final subdivision plat and recorded with a maintenance agreement approved by the County. 9. [Comment] VDOT approval of the proposed entrance is required. Please contact Christopher P.
