Elevation form (FEMA Form MT -1 Form 2) indicates lowest lot elevation is lower than base flood elevation (BFE) for three lots (46-18, 46-18A, 46-19). BFE at each lot is listed as 360.0, while lowest lot elevations are 351.6, 343.7, and 343.8, respectively. This may not pose an issue for FEMA but poses an issue for Albemarle County since the Community Acknowledgment Form (MT -1, Form 3) stipulates that the community official (Floodplain Administrator) must provide signature stating that review of Conditional LOMR-F request finds: the proposed project meets all of the community floodplain management requirements; all necessary Federal, State, and local permits have been obtained; the applicant has or will document Endangered Species Act (ESA) compliance to FEMA prior to issuance of the Conditional LOMR-F determination; proposed structures are or will be reasonably safe from flooding as defined in 44CFR 65.2(c); and that "we have available upon request by DHS -FEMA, all analyses and documentation used to make this determination." Collins Engineering should provide data to show that the lowest floor elevation of structures proposed to be (or that may be) built on these three lots is higher than base flood elevation, and should address each element listed in FEMA MT -1 Form 3, Section A. (Rev. 1) Partially Addressed. Asefollow-up, Albemarle County accepts TNT Environmental, Inc (TNT) 7 - June 2016 * recommendation; letter states: "Due to the fact that the James spinymussels' preferred habitat includes perennial, free-floating streams, and that it has been observed within Ivy Creek, as well as the fact that there may be potential habitat for the green floater within the South Fork Rivanna River, it is TNT's opinion that a species-specific survey for both mussels may be warranted. TNT recommends a habitat study, which can be done any time of year, be conducted in order to evaluate the portions of onsite streams to be impacted for potential habitat for each of the aforementioned species." Given scope of proposed Brookhill Development, Albemarle County Engineering Review Comments Page 2 of 2 concurs with TNT recommendation. Please provide habitat study for County review (or TNT review of study field data) as prerequisite to Community Official's signature (MT -1 Form 3). * 2-p. letter, Sophie Swatzendruber /Avi M Sareen to Scott Collins; ref. p. 2, ¶ 2) b. 10 of 11 (river station) cross-sections predict proposed grading will yield identical W.S. Elevation to existing condition (difference =0.00'). Hydrologic and Hydraulic Analysis lists no change from existing conditions yet plan sheet 4 indicates substantial change, with, in every case, proposed base flood elevation less than 4 Feb 2005 FEMA FIRM (effective Map) Panel 51003CO280D/FIS BFE. Revision is based upon updated topography, improvements to Polo Grounds Road, and modeling. Sheet 4 shows an approximate three contour interval drop in proposed BFE at river station 4307, for example. Please provide information that explains identical existing v. proposed W.S. Elevations in Hydrologic & Hydraulic Analysis report, Appendix A, d. 18 -Dec, 2015. (Rev. 1) Addressed. c. Provide PE -seal `No Rise' certificate for Brookhill /Polo Grounds Rd. Improvements, CLOMR-F. (Rev. 1) Not Addressed. 2 items: Plan requires seal /signature. County prefers Gregor Patsch, PE, sign Brookill Special Use Permit & CLOMR Plan (6/15/16), but recognizes logistics of such request. County will accept Scott Collins, PE, seal /sign. /date, on this 8-p. SP /CLOMR-F Plan. Second: Request for PE -seal `No Rise' certificate is restated –please provide `No Rise' certificate. d. Provide H&H report author's name (Waterways Consulting, Inc.); professional /technical qualifications and credentials. (Rev. 1) Addressed. e. Existing contours, sheet 4, are unreadable. Revise so existing contours are readable. (Rev. 1) Addressed. f. Albemarle County will not sign FEMA MT -1 Form 3 prior to Applicant signing this form. (Rev. 1) Addressed. g. Examine existing culverts, Polo Grounds Rd. It may not be possible to lower culvert at Sta. 15+75, as proposed. Albemarle County cannot endorse CLOMR-F if vertical roadway design, Polo Grounds Road, appears unrealistic, impractical, or unbuildable. (Rev. 1) Addressed. h. Although need to avoid fill within floodway was discussed 19 -May, it was not possible to appreciate every detail of vertical alignment during this meeting. Design avoids fill within floodway, but please examine proposed grade against VDOT standards /depth of cover for culverts. Compare streambed elevations against design. The FEMA application is requesting the lowest elevation on the (3) lots within the metes and bounds of the property,which has been provided. The elevation is lower than the Base flood elevation. However,this area will not be within a development lot when the property is developed. This comment is pre-mature, in that the lowest elevation of the property will not be within a future development lot on the property. B. The water surface elevation between the existing and proposed is unchanged for the project. However, what has changed is that the property has been flown, and updated contour elevations have been provided. We have graphically shown the existing floodplain on the property,and have updated this floodplain based on new and current topography(better topography than what was used for the existing floodplain). Therefore,with this new topography,the floodplain has been updated to match the topography of the property, therefore,altering the floodplain on the property. C. The application is included and is sealed. D. The report was completed by Gregor Patsch. He is a licensed civil engineer who worked for Albemarle County,Timmons Group,WW,and other firms for the past 10 years. He now works for a company out in California,which specializes in this field of civil engineering. E. The contours have been updated to be legible. F. The FEMA application has been signed. G. The vertical elevations of Polo Grounds road have been updated to match the existing roadway as close as possible, while still adhering to VDOT design guidelines. H. The roadway has been shifted over to allow for the shoulder to start at the existing roadway edge. This practice eliminated all impacts to the floodway with the proposed improvements to Polo Grounds road. I. Polo Grounds road will go through a review and approval process with VDOT. This is just a CLOMR-F application and this process is independent of the review and approval process for the roadway. J. This cross section XS1 is included with the other cross sections.
