This variance approval allows relief from Section 4.15.3.5 of the Albemarle County Zoning Ordinance to allow an existing 8 square foot identification sign to be increased to 18 square feet, a variance of 16 square feet. Also, allows relief from Sections 20.8.6 & 16.3 to allow an identification sign to remain in its present location within the required setback of 25 feet, a variance of 25 feet. STAFF REPORT - VA -85-55 APPLICANT: Four Seasons Apartments Limited Partnership TAX MAP/PARCEL: 61X(2)/lA ACREAGE: 7.86 acres ZONING: PUD - R-6 LOCATION: 146 Four Seasons Drive, + 900 feet west of Commonwealth Drive VARIANCE REQUEST The applicant requests relief from Section 4.15.3.5 of the Albemarle County Zoning Ordinance to allow an existing 8 square foot identification sign to be increased to 18 square feet, a variance of 16 square feet. Also, requests relief from Sections 20.8.6 & 16.3 to allow an identification sign to remain in its present location within the required setback of 25 feet, a variance of 25 feet. AREA CHARACTERISTICS The Four Seasons Apartments are located on the west side of Four Seasons Drive within the Planned Development. Four Seasons Drive connects the access from Rio Road to the one from Common- wealth Drive. Across from the apartment section is the Recreation Area which includes the Club House, Swimming Pool, and Tennis Courts. This has been purchased by a private party and in the foreseeable future will open as a Health/Sport facility. The apartment area of the development spans from the townhouse section of Woodlake Drive to a location just opposite Lakeview Drive, which is a portion of the patio house area. ZONING HISTORY Four Seasons (PUD) development was approved in the late 1960's and early 1970's. COMPREHENSIVE PLAN The Urban Land Use Plan has the immediate area designated Medium Density Residential. STAFF COMMENTS Four Seasons (PUD) development was established in the late 1960's and early 1970's, at which time setbacks were set for the patio house, and townhouse sections. Our files do not indicate any mention to setback in regard to the apartment section. STAFF REPORT - VA -85-55 2 Having no previous setback designation, therefore, the applicant should adhere to the current PUD - R-6 zoning setback of twenty- five (25) feet. The complex has an existing eight (8) square foot sign located in a grassy area between the road and a parking area for the residency units. Majority of the parking lot areas adjacent to the complex entrance are within the required setback. Drainage ditches, stream, or water courses located within the grassy areas combined with the changes in the elevation do restrict locations for a sign. A sign with a low height as presented by the applicant does display a more harmonious effect as intended by the PUD restric- tions. Overall the staff feels that the special circumstances, and physical conditions of the property warrants relief. STAFF RECOMMENDATION The staff recommends approval subject to the limitation of the one (1) sign as presented, and sign light will will be subject to the Zoning Administrator's review aftesign is erected.
