Engineering has completed review of Application WP0201500078. County Code section 17-410 and
Virginia Code §62.1-44.15:34 requires the VSMP authority to act on any VSMP permit by issuing a project
approval or denial. This project is approved. The rationale is given in the comments below. The VSMP
application content requirements can be found in County Code section 17-401.

A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must contain (1)
a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary.
SWPPP — SWPPP —Revise SWPPP for Middle Entrance / Rt. 29 Improvements (discussed 11 -Nov). (Rev.
1) Partially addressed. Thank you for .PDFs sent 4 Jan. As follow-up: Please show grading for trap or
basin measures required to contain wash waters, vehicle wash waters, concrete wash out, and any on-site
fuel storage. Ref. Sec. 6.C. Table/Sources of Pollutants, 6.G.a./d. —Pollution Prevention Awareness. DEQ
during periodic site inspections instructs on importance of an Exhibit showing these features. Please revise
Exhibit to show: dumpster, portable sanitary (porta-john), fuel storage, if any. Areas with potential to
contaminate runoff should drain to containment/trap. For example, silt fence downstream of porta-john.
Concrete wash-out, dumpster draining to trapping device (lined, in case of concrete wash-out). On-site fuel
storage: berm with 10ml liner sized to hold fuel volume + 2 yr. storm event. .PDF examples available.
Exhibit is not intended as a detailed design but to show containment and locations which contractor is free
to change. Exhibit is a construction aid and resource protection/inspection management tool.

VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a SWMP. This plan is
approved. The stormwater management plan content requirements can be found in County Code section 17-403.

1) Addressed —Applicant response: "Ms. Falkenstein [Alb. Co.] believes that the ARB review for SWM 2 is not

2. C -1A, IV, 4.3, E&S Control (b)/Post-construction SWM: Demonstrate design meets proffer condition: 80%
annual average sediment removal rate as published by the Center for Watershed Protection in Article 64 of
The Practice of Watershed Protection (2000 edition). (Rev. 1) Addressed. Applicant response: "A study
has been prepared by Williamsburg Environmental Group, Inc, in April 2006 to evaluate the pre and post construction
sediment rates for the North Pointe Development. The study shows that the development of the North Pointe
Development including the associated SWM's could result in an estimated reduction in sediment delivered to the
Rivanna from 794 tons/year to 146 tons/year (81.6% reduction). A copy of the Sediment Loading Estimates report

The mitigation plan requirements can be found in County Code section 17-406
Stream buffer mitigation: Show stream buffer impacts/2:1 Mitigation required per Ch. 17, Article VI. [C-
SA, IV, Stormwater Management & Stream Bed Conservation, 4.4] -briefly discussed, 11 -Nov. (Rev. 1)
Addressed. Applicant response: "A stream buffer plan sheet has been added to the plan set which shows the
County defined stream buffer in relation to the overall North Pointe Property. The majority of the property for the

North Pointe development is wooded and therefore the mitigation is naturally met since there will be no place to plant
new vegetation at the required 2:1 mitigation rate. Please see Stream Buffer Mitigation plan sheet C-9."

Process:
After approval, plans will need to be bonded. The bonding process is begun by submitting a bond estimate request
form and fee to the Department of Community Development. One of the plan reviewers will prepare estimates and
check parcel and easement information based on the approved plans. The County's Management Analyst will
prepare bond agreement forms, which will need to be completed by the owner and submitted along with cash,
certificates or sureties for the amounts specified. The agreements will need to be approved and signed by the County
Attorney and County Engineer. This may take 2-4 weeks to obtain all the correct signatures and forms.
Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded. The
County's Management Analyst or other staff will prepare the forms and check for ownership and signature
information. The completed forms will need to be submitted along with court recording fees.
This project holds a valid CGP/VPDES Permit: VAR10C806.
After bonding and agreements are complete, the County can hold a pre -construction conference. Applicants will need
to request a pre -construction conference by completing a form, and pay the remainder of the application fee. The
form identifies the contractor and responsible land disturber, and the fee remaining to be paid. This will be checked
by county staff, and upon approval, a pre -construction conference will be scheduled with the County inspector. At
the pre -construction conference, should everything proceed satisfactorily, a joint VSMP and grading permit will be
issued by the County so that work may begin.

County Code section 17-410 and Virginia Code§62.1-44.15:34 requires the VSMP authority to
act on any VSMP permit by issuing a project approval or denial. This project is denied. The
rationale is given in the comments below.The VSMP application content requirements can be

A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must
contain(1)a PPP,(2)an ESCP,(3)a SWMP,and(4)any TMDL measures necessary.
1. The approved SWPPP will need to be updated with these plans.
The revised ESC plans have been included in Section 4 of the updated SWPPP included with this submittal.
B.Pollution Prevention Plan (PPP)
The PPP content requirements can be found in County Code section 17-404.
1. The approved PPP will need to be updated with these plans.
The revised PPP has been included in Section 6 of the updated SWPPP included with this submittal.
C. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a
SWMP. This plan is disapproved,and the reasons are provided in the comments below.The
stormwater management plan content requirements can be found in County Code section 17-403.
1. Please add the plant schedule to the buffer/swm/bmp landscape plans.(ARB comment)
The plant schedule has been added to the landscape details sheet C-10B(as well as the road plan sheet C-
13A).
D. Erosion and Sediment Control Plan (ESCP)
Virginia Code§62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP.
This plan is disapproved,and the reasons are provided in the comments below.The erosion control
plan content requirements can be found in County Code section 17-402.
1. Include a note on the plans that the haul road will be restored to the pre-development conditions,
including removing the stone and eliminating any channelization caused by the grading of the
road.
A note as such has been added to the Phase II ESC plan on sheet C-4.

2. Include a reference to VESCH 3.24 for the stream crossing.
A reference to VESCH 3.24(typical label)has been added to sheets C-3/C-4 next to the
stream crossing and the temporary culvert crossing detail has been added to the bottom
left of sheet C-3.
3. A new/additional bond will be required for the additional disturbance.
Note—this will be addressed following plan approval/re-approval.
The VSMP permit application and all plans may be resubmitted for approval when all comments have
been satisfactorily addressed. For re-submittals please provide 2 copies of the complete permit package
with a completed application form.
Engineering plan review staff are available from 2-4 PM on Thursdays,should you require a meeting to
discuss this review.
Process;
After approval,plans will need to be bonded. The bonding process is begun by submitting a bond estimate
request form and fee to the Department of Community Development. One of the plan reviewers will
prepare estimates and check parcel and easement information based on the approved plans. The County's
Management Analyst will prepare bond agreement forms,which will need to be completed by the owner
and submitted along with cash,certificates or sureties for the amounts specified. The agreements will need
to be approved and signed by the County Attorney and County Engineer. This may take 2-4 weeks to
obtain all the correct signatures and forms.
Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded.
The County's Management Analyst or other staff will prepare the forms and check for ownership and
signature information. The completed forms will need to be submitted along with court recording fees.
After bonding and agreements are complete,county staff will need to enter project information in a DEQ
database for state application processing. DEQ will review the application information based on local
VSMP authority approval. At this time,the DEQ portion of the application fees will need to be paid
directly to the state. For fastest processing,this is done electronically with the emails provided on the
application. DEQ should notify applicants with instructions on how to pay fees. When DEQ approves the
application,they will issue a permit coverage letter. This should be copied to the county.
After DEQ coverage is issued,via the coverage letter,the County can hold a pre-construction conference.
Applicants will need to complete the request for a pre-construction conference form,and pay the remainder
of the application fee. The form identifies the contractor and responsible land disturber,and the fee
remaining to be paid. This will be checked by county staff,and upon approval,a pre-construction
conference will be scheduled with the County inspector. At the pre-construction conference,should
everything proceed satisfactorily,a joint VSMP and grading permit will be issued by the County so that
work may begin.

Thank you for pointing that out. We are checking with the planner,Rachel Falkenstein on the
timing and process for the ARB review. Ms. Falkenstein believes that the ARB review for
SWM 2 is not required until it is time to review one of the commercial building that will be
installed upstream of SWM/BMP 2. Ms. Falkenstein is checking with the zoning team to
decide when the ARB review for SWM 2 will be required and will let us know.

A study has been prepared by Williamsburg Environmental Group, Inc in April 2006 to
evaluate the pre and post construction sediment rates for the North Pointe Development. The
study shows that the development of the North Pointe Development including the associated
SWM's could result in an estimated reduction in sediment delivered to the Rivana from 794
tons/year to 146 tons/year(81.6% reduction).A copy of the Sediment Loading Estimates report
dated April 2006 is provided in the letter of transmittal for your records.
