Mr. Collins:
The Agent for the Board of Supervisors hereby grants administrative approval to the above referenced preliminary
subdivision plat.
This approval shall be valid for a period of five (5) years from the date of this letter, provided that the developer
submits a final plat for all or a portion of the site within one (1) year after the date of this letter as provided in the
Section 14-226 of the Code of the County of Albemarle, and thereafter diligently pursues approval of the final plat.
The final plat will not be considered to have been officially submitted until the following items are received:
1. A final plat that satisfies all of the requirements of section 14-303 and sections 14-304 through 14-318 of
the Code, and the conditions attached to this letter.
2. Applicable fee outlined in the application.
Please submit 9 copies of the final plat to the Community Development Department. The assigned Lead Reviewer
will then distribute the plat to all reviewing agencies (for ACSA, please submit 3 copies of construction plans
directly to them). Once you receive the first set of comments on the final plat, please work with each reviewer
individually to satisfy their requirements.
The Department of Community Development shall not accept submittal of the final plat for signature until tentative
approvals for the attached conditions from the following agencies/reviewers have been obtained:

We are requesting a separate meeting with the design engineer to discuss
sewer options since no public pump-station will be allowed for this project.

5. An Industrial Waste Ordinance survey form must be completed.

Water and sewer construction plan review submittal is required. Submit 3 copies of the
utility plan along with water/sewer data sheets to the ACSA, Attn: Michael Vieira, PE, to
begin the review.
No public pump -station will be allowed. The ACSA suggest looking into the E1 system
(individual private grinder pumps with a public common force main).
The ACSA is requesting a meeting be scheduled with the design engineer to discuss the
sanitary sewer options for this area.

Service Authority
The Albemarle County Service Authority (ACSA) has no technical comments on the SUB
being reviewed. Engineering comments are usually reserved for the site plan review stage.
Subdivision plats should correctly show ownership of properties and existing easements. Recordation
of new easements should occur before dedication to and acceptance by the ACSA.
The ACSA can review the proposed subdivision plat and determine if it is included in the
jurisdictional area for water and/or sewer service. Water and/or sewer connections to the ACSA
system are allotted on a first come, first served basis at the time connection fees are paid. The ACSA
does not reserve capacity in its system for a specific project.

The County of Albemarle Planning Division will grant or recommend approval of the Subdivision Plat referenced
above once the following comments have been addressed: [Each comment is preceded by the applicable reference,
which is to the Subdivision/Zoning Ordinances unless otherwise specified.]

2. [ZMA2005-9, Application plan] Label the open space areas in phase 6 as Passive Recreational Area
consisting of walking/jogging trails ". Also, continue the trail and the trail easement throughout the proposed
open space for this phase. The application plan depicts the trail connecting to Sunset Drive between lots 71
and 72 (where the SWM facility drainage ties to the cul-de-sac), this exact location may be modified
provided the trail connects to the cul-de-sac.
3. [14-302(A)4&5] Easements. Provide the deed book and page references for all existing easements, including
the existing trail/access easement. Also, provide the dimension of the trail/access easement.
4. [Proffer 11 The maximum dwelling units permitted in Briarwood is 661. Proffer 9 provides a table for the
proposed lot mix. A table providing the existing and proposed dwelling units by section must be provided on
the final plat and updated with each submittal.
5. [14-303F] Identification of sections, blocks, and lots. Revise sheet 1 to correctly label Lots 57-60, as these
lots are truly Lots 34, 35, 36, and 36A in phase 6 which were approved under SUB2016-94 on 8-15-16. Also,
omit the inaccurate note over Lot 59 which states: "Lots 57-60 proposed w/ the phase 4 road plans
(SUB2016-08). "
6. [14-302(B)8] Yards. In addition to the setbacks provided on sheet 1 provide the following notes: "12'
building separation " and "No minimum lot area is specified".
7. [14-302(A)12, 30.71 Steep Slopes Overlay District. Modify the managed and preserved slope note on sheet 1,
as it currently does not meet ordinance requirements for the overlay district in relation to the last portion of
the note: "...Any preserved steep slope areas that are modified during the field survey verification process
shall be upda�e"eveloped as managed steep slopes per the design standards manual on 'hefinalp. "
County Engineer sign -off on such topographic information is required prior to approval. Regardless of
whether the County Engineer is satisfied with the new topographic information or not, the labeling of the
slopes does not change.
8. [14-302(B)10] Stream buffers. Label and depict the WPO buffer. Also add the following note: "The stream
buffers shown hereon shall be managed in accordance with the Albemarle County Water Protection
Ordinance. "
9. [14-311] Infrastructure improvement plans. Prior to final plat approval road plans and WPO plans serving
these lots shall be review, approved, and built or bonded.
10. [14-317] Instrument evidencing maintenance of certain improvements. With the final plat submit an
instrument assuring the perpetual maintenance of the stormwater management facilities, open space area and
the trails, and any other improvements that are to be maintained by the HOA in perpetuity. County Attorney
approval is required prior to final plat approval.
11. [14-303] Contents offinal plat. A plat meeting all the requirements for final subdivision plats per the
subdivision ordinance.
Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is kept
up to date by the County Attorney's office. The Code may found on the County Attorney's website which may be
found under "Departments and Services" at Albemarle.org.
In accord with the provisions of Section 14-229(B) of Chapter 14 of the Code if the developer fails to submit a
revised final plat to address all of the requirements within six (6) months after the date of this letter the application
shall be deemed to have been voluntarily withdrawn by the developer.

The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced plan as submitted by Collins Engineering, dated25
July 2016, and offer the following comment:
1. Please provide an updated master plan for Briarwood showing that connectivity has been
addressed as a whole.
Please provide two copies of the revised plan along with a comment response letter. If further
information is desired, please contact Justin Deel at 434-422-9894.
A VDOT Land Use Permit will be required prior to any work within the right-of-way. The
owner/developer must contact the Charlottesville Residency Transportation and Land Use
Section at (434) 422-9399 for information pertaining to this process.
