Subject: SUB -2016-162 Zion Hill Baptist Church — Special Lot
The County of Albemarle Planning Division will grant or recommend approval of the
Final Plat referenced above once the following comments have been addressed: [Each
comment is preceded by the applicable reference, which is to the Subdivision/Zoning
Ordinances unless otherwise specified.]
[14-106] Definitions: Special Lot. Provide a note on the plat that states that the
existing cemetery within TM 65-106 existed prior to June 8, 2011. Because the
proposed Cemetery Lot had no graves within its area prior to June 8, 2011, but
both the County Attorney and Zoning have approved considering the proposed
lot an expansion of the cemetery on the adjoining lot, the addition of this note
specifies the justification for allowing the creation of the cemetery special lot.
2. [14-303 (T)] Special Lots. Provide on the plat the note specified in 14-303 (T).
3. [14-314] Identification of all interested of the County in property. As the
conservation easement for the parent parcel for the proposed special lot is co -
held by the Public Recreational Facilities Authority (PRFA) and the County, both
the PRFA and the Board of Supervisors (BOS) must determine that the proposed
cemetery use is permitted under the easement. At their meeting on 9/8/16, the
PRFA made the finding that the proposed cemetery use on this special lot is not
a commercial or industrial use and is permitted under section 2(C)(7) of the deed
of easement. However, they made that finding subject to certain provisos:
• That the proposed lot is to be used for burial purposes under the same
ownership or management as the cemetery on Tax Map 65 Parcel 106; and
• That the proposed lot may have grave markers and monuments, but not
mausoleums or other structures.
An action from the Board of Supervisors is still required before it can be
established that the proposed cemetery use is permitted under the conservation
easement. The date at which this item will be on the BOS agenda has not be
set. At this time it appears the earliest meeting date on which it might be
scheduled would be in early November.
4. [Comment] Add a note to the plat that states, "The use of this lot as a cemetery
within the existing Conservation Easement has been approved by the Public
Recreational Facility Authority and the Albemarle County Board of Supervisors.
However, cemetery uses are only allowed by Special Use Permit in the Rural
Areas. Before this lot will be able to be utilized as a cemetery a Special Use
Permit allowing a cemetery use on the parcel must be acquired."
5. [14-316] Approval of entrance onto public streets. Provide verification from
VDOT that there is adequate location for an entrance along the adjacent
public roads for te proposed "Cemetery Lot".
