Would the obligation only kick in if construction at Northtown were to cease before receipt of the first CO? The owner of Rivanna Plaza also wants the ability to meet MS-19 by other methods should the obligation fall to him. His site is much smaller than Northtown and other methods permitted under state regs would likely be more cost effective. How can we add that to the language? The condition will be in effect for a period beginning with the first Certificate of Occupancy and ending at expiration time of the Northtown Center obligation.
