Amy,
Just so I am clear when I discuss this with the owner: assuming Northtown has a grading permit issued prior to
the first CO for Rivanna Plaza, and the owner of Northtown pursues the obligation as required, then the owner of
Rivanna Plaza is in more of a "wait and see" mode? Would the obligation only kick in if construction at Northtown
were to cease before receipt of the first CO?
The owner of Rivanna Plaza also wants the ability to meet MS-19 by other methods should the obligation fall to
him. His site is much smaller than Northtown and other methods permitted under state regs would likely be more
cost effective. How can we add that to the language?
Sorry to be a pain about this, but it is a large obligation and the details are very important.

Todd,
The County feels that both developers are responsible for the restoration of the Carrsbrook Channel in order to
satisfy MS-19 and is not comfortable releasing one or the other from the obligation until the work is completed.
The developers need to work together toward the solution and should keep each other, as well as the
County, apprised of the project's status.

I think the owner can probably live with the timing, but can there be some language stating that no action is
required as long as the obligation is being pursued by Northtown? This will ensure that both owners are not trying

Todd,
The County feels that to standardize the MS-19 requirements, the language should stay similar to that of the
Northtown Center agreement. The condition will be in effect for a period beginning with the first Certificate of
Occupancy and ending at expiration time of the Northtown Center obligation. Please see the attached language.

I know you had a plan in front of Rivanna Plaza, but could you take a couple of minutes just to look at the revised
language for the adequate channel provision (on Sheet 2 of ESC Plan, along with letter from owner). We want to
make sure this is acceptable to the County.
