The County of Albemarle Planning Division will recommend approval of the plat referenced above once the
following comments have been satisfactorily addressed (The following comments are those that have been
identified at this time. Additional comments or conditions may be added or eliminated based on further review.):
[Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless
otherwise specified.]
1. [14-301(3)] Scale. A graphical scale is shown on sheets V2 and V3 but not scale is shown in the title block.
Change the "I\/A" in the title block to specify the scale of the sheet.
Rev. 1: Comment addressed.
2. [14-302(A)(3)] Existing or platted streets. A private street in the location shown would require authorization
by the Planning Commission and would be required to meet the criteria of section 14-233(A). Staff
recommends that this be relabeled as a public street, in accordance with the approved road plans Westlake
Hills Subdivision Phase II, III, & IV Road Plans. The width of the public street right of way in this plat must be
shown as the same width and alignment as is shown on the approved road plans. The plat will not be able
to be approved until the public street in this location is built or bonded.
Rev. 1: Comment not fully addressed. As discussed with Bill Ledbetter on October 215t 2016, in
order to meet the road frontage requirement (14-403), either a private street or a public street must
be created for this subdivision. Because this parcel is within the development area a private street
for a two -lot subdivision requires approval of the planning commission (14-433(A)(2)). The creation
of a public street, as already shown in the approved preliminary subdivision plat and road plans
(SUB201200038 and SUB201400067), would subdivide the smaller lot creating a third lot. With a
third lot the review would no longer be for a two -lot subdivision and therefore the review would be
based upon 14-206 and not 14-207. In addition to changing the type of submittal it would also
increase the fee. As Mr. Ledbetter and I discussed today, these options will be forwarded to the
owner. The County will be informed as to how the owner wishes to move forward. At that time a
more detailed discussion can take place on how to move forward, the items that need to be
submitted, and notes that will need to be added to the plat depending on the choice that is made.
Please note that for both submissions, with the two different scenarios, engineering has stated in
their comments that "Plat cannot be recommended for approval until the phase 3 portion of Road
plan #SUB201400067 has been posted and approved." (see attached engineering comments).
3. [14-302(A) 4 & 5 & 14-303(L)] Private easements; Public easements; Public utility, drainage and site
distance easements. Provide all existing easements on Sheet No. V3, Subdivision Overall.
Rev. 1: Comment not fully addressed. There are existing easements shown on Sheet No. V2 that are
not shown on Sheet No. V3. such as the mitiqation easement. Provide all existing easements on
Sheet No. V3, Subdivision Overall.
4. ;14-302(A)7] Existing and departing lot lines. Provide all existing departing lot lines. The lot line between
TMP 56K.-Al and TMP 56K-02-OOA is not shown on the plat. Provide the lot line and lot information.

5. [14-302(A)9] Building sites on proposed lots. Provide the required building site note on the coversheet.

6. [14-302(A)11 & 14-303(A)] Instrument creating property proposed for subdivision; Statement of consent to
division. Provide the most recent instrument.
Rev. 1: Comment not addressed. In the Statement of Consent to Division Deed Book 2733, Page 150
is listed in the description. However, it appears that the phase 1 subdivision plat (Deed Book 4518,
Page 1) created the residue parcel that this plat is subdividing. Provide in the Statement of Consent
to Division the most recent instrument that created the property being subdivided.
7. [14-302(8)8 & 4.6.1(c)] Yards. Since the preliminary plat was approved prior to the new setback
regulations, either set of requirements may be used.

8. (14-302(B)10] Stream buffers. Show all stream buffers in sheets V2 and V3.

9. [14-303(D)] Acreage of lots. The area of the "existing" parcel is slightly different then that shown as the
residue parcel on the Westlake Hill Subdivision — Phase II (SUB201600079), which is also under review.
Ensure that the area values are consistent. Also, because there are multiple submission currently under
review for the Westlake Hills Subdivision the order of their approval will be important. Because the lot areas
shown in this subdivision plat assume that divisions shown in SUB201600079 have already happened this
plat will not be able to be approved until SUB201600079 has been approved and recorded.
Rev. 1: Comment not fully addressed. There are multiple submission currently under review for the
Westlake Hills Subdivision the order of their approval will be important. Because the lot areas
shown in this subdivision plat assume that divisions shown in SUB201600079 have already taken
place this plat will not be able to be approved until SUB201600079 has been approved and recorded.
10. [Comment] This plat cannot be approved until Engineering grants their approval. See the attached
Engineering comments. Rev. 1: Comment not vet addressed. See the attached engineering
