Subject: RE: SUB2016-94 Briarwood Sub - final plat
Chris,
I have reviewed the plan against the “Briarwood Road Plan – Phase 4 & Portion of Phase 6” which is
currently under construction plan review by ACSA staff. I have the following comments:
• The lot numbers on the plat do not match the lot numbers on the road plan currently under
review. Please advise which is correct.
• Show the sanitary sewer easement across Lots 120-123 (lot numbers from the plat).
Let me know if you have any questions.

SUB201600094 Briarwood Phase 1A, 5, and 6—Final Plat
As you may know the above plat was recently revised and submitted to you this week. The applicant has been
calling all reviewers trying to get them to jump on the review being the revisions to the plat made most
outstanding issues go away by revising to only plat lots on existing roads. VDOT & Fire Rescue are the last
reviewers outside of CD that are left b4 the plat can be approved. I'll be away till the 23rd of Aug, in my place
please send Megan Yaniglos your comments & CC Scott Collins.

Quick status update since yall are making so much happen in one day. The items in red are the only remaining
items prior to final plat approval.
•
1) The trail appears to be built as of noon today as evident by the pictures provided from the applicant. I am
awaiting an inspection to be completed by J. Otto to assure it meets the Class B —Type 1 primitive nature trail
standards and is located within the new easement location as depicted on the plat.
2) ACSA approval came in today. The remaining approvals are required prior to final plat approval are: Fire &
Rescue and VDOT.
3) The applicant revised the plat to address the lot numbering issue.
4) Comment#3 from the 8-11-16 comment letter was not adequately addressed but can be pushed off till the
review of the next final plat as I was able to research how many lots were left in the phase 5 and the fact that
1
phase 6 just started and is allotted 31 SFDs. What I'm looking for in a master list is for all sections and phases
in the development to be depicted on the most recent phasing variation, along with a chart that tabulates how
many lots have been platted in each phase and how many are remaining in each phase. Similar to how proffer
#9 is visually represented in the rezoning proffer statement. Such a document shall be updated each time we plat
new lots.
5) Please bring in a min of 2 signed/notarized copies of the final plat for signature along with a signed/notarized
copy of the C&R docs. I assume all the above items will be completed b4 I return from vacation. This email
will serve as a guide for Megan to be able to approve the plat in my absence.

Scott,
SUB2016-94 - Briarwood- final plat for 8 lots (w/lots in phase 5 and 6)
I received your voicemail. I still need all other reviewers to actually review/approve the revised plat. Granted
this is prob a non-issue based on previous approvals but it needs to happen prior to final plat approval.
Also, yes please submit the master list of the lots as requested. Like I mentioned in the letter, it's getting very
difficult to keep track of how many lots in each phase have been platted based on the various phasing revisions.
Also, read comment#5 on page 3, it speaks to the applicant providing a revised trail exhibit for the modified
portion of the trail. Then having engineering review that, then having the applicant build it, then have the
County inspect it ... all prior to final plat approval. Same as the last Briarwood plat. This is most likely the most
time consuming item remaining. Maybe you can submit this to Max while I'm on vacation and he can do a
quick review.
Hope this helps. Seems we're nearing a wrap up of this plat very soon. I hope to come back on in a week and be
in good shape on this one ready to move it out. Provided all items are addressed.

RE: SUB201600094 Briarwood Phase 1A, 5, and 6 — Final Plat
Mr. Kean:
The County of Albemarle Planning Division will grant or recommend approval of the Subdivision Plat
referenced above once the following comments have been addressed: [Each comment is preceded by the
applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
2.
[Comment] Proposed lot numbers do not coincide with the preliminary plat (SUB2016-4) or for the
amount of lots permitted in any of the phases per proffer 9. With the numerous variations to the
phasing plan it is becoming extremely difficult to keep track of where each phase is at in the lot totals
permitted by proffer 9. The tabulation chart on sheet 2 is helpful to track open space and lot totals in
the development, but is not useful to track lot counts and unit types in each phase without pulling each
individual plat and individually counting lots.
For example: proffer 9 only permits 18 SFD lots in phase S, thus phase S should never have a lot
numbered greater than 18. On this plat there is a "lot 125" in phase S, notably after pulling all the
recorded plats for phase 5 it is clear this is the 18`h and final SFD lot permitted in phase 5. Other
examples: phase 6 is only permitted to contain 31 SFD lots, thus phase 6 should never have any lots
numbered over 31. Based on my research it appears we had 7 lots platted in 2015 and 7 lots being
platted on the plat under review. Phase 4 is only permitted 52 SFD lots, thus phase 4 should never
have any lots numbered over 52.
Revise lot numbers to coincide with lot totals in each phase. If that is not possible based on previous
numbering schemes create a master list which will keep track of the lot numbers and unit types in each
phase. Provide this to staff for their records/the official file. Rev 1. Comment not addressed.
5. [Comment] County Planning shall not approve the final plat until approvals are received from
Engineering, VDOT, and ACSA. Please work with the various reviewers to assure all their
requirements are addressed. Rev 1. Revised plat was sent to various reviewers on 8-8-16. Once
comments are received they shall be forwarded to the applicant.
Also, the following comments are generated from the Preliminary Subdivision plat Conditions of
Approval letter dated May 6, 2016. The County of Albemarle Planning Division will grant or recommend

Dear Mr. Kamptner:
The applicant of the above stated subdivision plat has submitted a generic Covenants, Conditions,

development.
This phase of the development has two items(open space and walking/jogging trails)which need to be
covered in this document per Proffer 4 of ZMA2004-14, which reads: "...the dedication of open space
with the approval of phase 4 and 5 for passive recreational area which shall include the construction of
walking/jogging trails... "
To aid in your review of these documents I have attached the plat, with highlighting on the proposed open
space and trails(see sheet 3 of the plat). Please review.

Dear Mr. Perez:
Unable to review the final plat entitled "Subdivision Plat Showing Lots 24, 25 and 72 phase I A

following comments:
I. The plat provided does not seem to be consistent with previously submitted road plans in
both phase number and lot numbers. At this time the Department requests a meeting with
the developer, engineer, and surveyor to disc}lss the plan for future submissions.
Furthermore it would be helpful if an updateemaster plan or overall layout sheet showing

RE: SUB201600094 Briarwood Phase IA,5,and 6—Final Plat
Mr. Kean:
The County of Albemarle Planning Division will grant or recommend approval of the Subdivision Plat
referenced above once the following comments have been addressed: [Each comment is preceded by the
applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [ZMA2004-14 Application plan] The phases depicted on the plat do not match the approved phasing
plan for the development, nor the phases depicted in the variation to the phasing plan being considered
by the BOS at their June 8th meeting. It is suggested that modifications to the plat be held off till the
BOS takes action on the variation request. Assuming the variation request is approved, please make
the following labeling changes:
Lots 72-78 are located in phase 4
Lots 120— 123 are located in phase 4
Lot 124 is located in phase 6
Lot 25 is located in phase 6
Lot 24 is located in phase 6
The portion of open space phase 6 above Lots 121-123 is acreage from open space phase 4
2. [ZMA2004-14 Application plan] Depending on the applicants anticipated time frame for approval of
this plat it is suggested that the plat be revised to omit all platting of lots and roads within phase 4(see
comment#1 above for the true phase of the lots depicted on this plat), as the primary recreational area
is not built or bonded(see the May 6th conditional approval comments for preliminary plat below
which discusses this issue in detail). Please communicate with Scott Collins and the developer as to
the intentions for this plat.
3. [Comment] Proposed lot numbers do not coincide with the preliminary plat(SUB2016-4)or for the
amount of lots permitted in any of the phases per proffer 9.
For example:proffer 9 only permits 18 SFD lots in phase 5, thus phase 5 should never have a lot
numbered greater than 18. On this plat there is a "lot 125"in phase 5, notably after pulling all the
recorded plats for phase 5 it is clear this is the 18`x'and.final SFD lot permitted in phase 5. Other
examples:phase 6 is only permitted to contain 31 SFD lots, thus phase 6 should never have any lots
1
Now Now'
numbered over 31.Based on my research it appears we had 7 lots platted in 2015 and 7 lots being
platted on the plat under review. Phase 4 is only permitted 52 SFD lots, thus phase 4 should never
have any lots numbered over 52.
Revise lot numbers to coincide with lot totals in each phase. If that is not possible based on previous
numbering schemes create a master list which will keep track of the lot numbers and unit types in each
phase.Provide this to staff for their records/the official file.
4. [Comment] The open space tabulations chart on sheet 2 lists this plat as having 19 lots in phase 6 and
IA;however, this is incorrect, see comment#1 above for reasoning. When revised assure phase 5 is
listed as a single lot is being platted within this phase.
5. [Comment] County Planning shall not approve the final plat until approvals are received from
Engineering,VDOT,and ACSA. Please work with the various reviewers to assure all their
requirements are addressed.
Also, the following comments are generated from the Preliminary Subdivision plat Conditions of
Approval letter dated May 6,2016.The County of Albemarle Planning Division will grant or recommend
approval of the Subdivision Plat referenced above once the following comments have been addressed:
1. [ZMA2004-14 Application plan,Proffer 4,and Proffer 1] The primary recreation area south of
Camelot shall be built or bonded prior to final plat approval of Phase 4. The recreational area shall
consist of a baseball/multipurpose field,two half basketball courts,playground equipment,and picnic
facilities. Prior to final plat approval an approved site plan and WPO plan shall be required for the
primary recreational area and the off street parking, access aisles, and commercial entrance serving
this area.Final Plat: Comment not addressed.
2. [ZMA2004-14 Application plan,Proffer 1,and 4.12.6] On the site plan provide the required
parking.
Baseball field-20 spaces per field
Basketball courts-2 spaces per basket
Playground equipment- 1 space per one hundred twenty-five(125) square feet of useable
recreation area
Final Plat: Comment not addressed. Please note: an initial site plan for the primary recreational
area is under review but it is not approved yet,nor is the final site plan.
3. [ZMA2004-14 Application plan,Proffer 1 &4,and ZMA95-20 Proffer 19] The final plat shall
depict and dedicate to the HOA the primary recreational area and its access. The alignment of the
access road is required to go through TMP 32E-2 within the area reserved for access as approved on
ZMA95-20,which is an amendment to ZMA79-32. Provide the owner signature of TMP 32E-2 on the
final plat. Final Plat: Comment not addressed.
4. [ZMA2004-14 Application plan,Proffer 4] The open space in Phase 4 shall contain a
walking/jogging trail. On the final plat depict, label("Passive Recreational Area consisting of
walking/jogging trails"),and dimension the trail. At a minimum the trail shall be platted from behind
Lot 28 on through to Lot 42 and connect to the existing trail in phase 4. Also, provide a trail
connection to either the St. Ives cul-de-sac or Sunset Drive at either the proposed SWM facility(pond
4)or in the open space area between Lots 32 and 33. Final Plat: Comment not addressed.
5. [ZMA2004-14 Application plan,Proffer 4] Prior to final plat approval the trail shall be built.
Provide a trail plan exhibit which shall be used by the County to approve the design of the trail. The
exhibit shall contain a cross-section of the trail, topography(elevation contours 50' on either side of
the trail),and a plan view of the trail. Once the trail plan has been approved provide the above
mentioned information on the amended WPO201600001 currently under review. Once approved

modified and is no longer accurate. The revised phasing plan is pending action by BOS at their
June 8th meeting.Assure the phasing plan depicted on sheet 2 is accurate and matches the latest
approved phasing plan.
24. [Recommendation] Staff has received citizen feedback concerning the proposed layout of Lot 49 in
consideration of the existing walking/jogging which is located within an easement that crosses the rear
yard of this lot. Residents are concerned that the HOA will have trouble with any future property
owner of this lot not wanting the access to remain on their property, especially so close to their home.
It is suggested that either the boundaries of Lot 49 be revised to not include the existing trail easement
on the property or to vacate this easement and relocate it within open space.Final Plat: Comment
addressed.
25. [Comment] Prior to final plat approval the phasing variation request shall be approved by the Board
of Supervisors. Planning's comments on the variation are provided below. Final Plat: Comment not
addressed. The proposed phasing plan depicted on sheet 2 has been modified and is no longer
accurate. The revised phasing plan is pending action by BOS at their June 8th meeting.Assure
the phasing plan depicted on sheet 2 is accurate and matches the latest approved phasing plan.

is kept up to date by the County Attorney's office. The Code may found on the County Attorney's website

In accord with the provisions of Section 14-229(B)of Chapter 14 of the Code if the developer fails to submit a

application shall be deemed to have been voluntarily withdrawn by the developer.

Hi Christopher-
I looked over the documents this morning and only have some minor comments/questions.
Re: SUB201600094(site plan for the next section)
1
1.the walking trail that had been cutting the corner of the lot(Lot 124)has been moved. Yay!
Yes, noted.
2. as you noted, the proposed lots were labelled as Phase 6 rather than the expected Phase 4. That needs
to be corrected(no skipping past the recreation area commitments if/until such time that the per-proffer
requirements might be changed).
I've gotten into this issue and have a bunch of comments in my comment letter about it.Notably we have
a phasing plan variation going to the BOS on June 8th(see attached), I'm recommending approval of it bc it
reverts lots back to the original phase 4 lines prior to the variation to the phases in 2013. We had them
revise the variation request 4 times to get it right. We're definitely holding them tight to this phase 4 rec
area proffer.Notably the plat does not even match the proposed phasing variation...it'll have to match,
which cuts a bunch of lots outta this plat.
Re: SDP201600025 (recreation area)- I'll be jumping back on this one Friday after 10am, and Monday
and Tuesday. Hope to have all my comments finished up by Wednesday at noon. I'll utilize these
comments in my letter.
1. The grade lines for the multi-purpose field suggest a 6' drop from one edge of the field to
another. Could you play baseball on a field that's not level? How about football? soccer? lacross? (I'll
check the grades and make a comment if applicable)PS. This is the initial site plan,a full grading plan is
not completed yet/nor required.
2. Q? shouldn't the baseball/multi-purpose field include a backstop(behind whatever would be)home
plate ?(I'll look at this in more detail and make a comment if applicable— 1St inclination is yes)
3. Q? if suggested, would exchanging one of the basketball courts for two tennis courts pass the
requirements of the proffer? No—bc the proffer specifically calls out basketball courts, without a
rezoning to change the proffer it'd have to stay. However, if they wanted to add tennis courts in addition
to the minimum requirements that would be permitted.
4. Q?I believe that the proffer states that the recreation area be dedicated to the HOA. Does that
imply/suggest that the HOA would be responsible for the maintenance and upkeep of the rec area? Yes,
absolutely. If so,would the HOA be able to limit who can use the rec area?Yes. Could we(the HOA)
block access to the parking lot such that only HOA members be allowed access to our rec area?Yes.
Could our HOA charge any outside organization a fee to use the rec area ... I don't know this answer, bc
the park is specifically for briarwood residents, parking spaces are being dictated by the use not
anticipated use of the fields being rented. especially since we'll be paying for the repair/upkeep?
The grading of the multi-purpose field is a big issue. I'll check it out. PS. This is the initial site plan, a full
grading plan is not completed yet/nor required.
Thanks for your time.
Have a great weekend.

Re: SUB2016-4 ... Briarwood Phasing Variation
I appreciate your comments re:the tot lots. Many of the residents have
asked, repeatedly, when the("a")tot lot will be constructed. Personally, I
see the developer holding off until the very last minute to start that work and
will argue that he's not required to do so until the section has been filled out.
At this time, Phase 1A has not been completed(there's an entire section of
3
townhomes that are likely years out)nor has Phase 1B been completed
(again, waiting on the completion of townhomes that's likely years out).
We're stuck waiting.
Re: some of my thoughts ...
We had our annual HOA meeting last month(yes, Wendell is the president)
and part of our discussion was about the primary recreation area and the tot
lots.
For the primary recreation area, there was some concern on our(the owners)
part about the location, who will be the primary users of the area(it's much
more a part of Camelot then Riverwood),and how our HOA would end up
being responsible for the ongoing maintenance and repair when we are
unlikely to be the primary users. Somehow I don't think anyone would think
kindly to our putting a gate up at the entrance to the parking lot with only
our HOA members being allowed to enter. I think you and I have discussed
this before with the guidance being that our HOA members would need to
decide what"we"want to have re:the recreation area and then request a
change to the proffer. But,until that happens,we should not let the
developer off the hook re:his obligations.
For the tot lots ... there are many owners who have little ones right now,
want a tot lot now, and are getting impatient with the developer.
If I were to allow the developer to delay construction of the primary
recreation area I would like like to insist that they actually complete one of
the smaller tot lots.
Thanks again for your time/e-mail.
Have a great week!

Subject: Briarwood development activity ...
Hi Christopher-
I've been watching for activity on the County View web
site re: development in our neighborhood
(Riverwood/Briarwood) and have a couple of questions.
Re: SUB201600004
It looks like there's been some activity on this item with
what appears to be two conflicting documents.
First, there is an "Action Letter 2016-05-06" that
suggests the preliminary subdivision plat had been
approved by the Board of Supervisors.
The May 6th action letter(approval w/conditions)was
issued after the applicant paid the fee which was
outstanding. The Board of Supervisors does not
approve by right subdivision plats; rather, the Agent for
the BOS does. The Agent being myself in this case.
Then, there is a "Review Comments Waiver, variation or
substitution requirement 2016-05-06" document that
the variation cannot move forward as proposed.
Yes, correct. The variation which was requested by the
applicant is to the phasing lines for the proposal. It's
mentioned in the May 6=hconditional approval letter
(Planning's comment#25, and sub 1—4).The revised
variation went beyond what was discussed and what
can be done in a variation, thus I gave the applicant two
options A) resubmit the request within the parameters
of a variation OR B)go through a rezoning to modify the
proffer for the lot mixs in the development. The
applicant said they wanted to go w/option A.Thus I'm
awaiting a resubmittal before moving it onto the BOS
for their review/approval.The item is tentatively*
placed on the BOS June 8th consent agenda.
* The item going to the BOS on that date is predicated
on a revision that staff will support and recommend
approval of. If we get the revision and do not
recommend approval the Planning Commission must
review it 1=t and then it goes to the BOS.
Is the plat and variation two different things that are
both tied to SUB2016-4 ??? Yes.They are two different
things. It's our Dept.'spolicy that variations should be
tied to either a site plan or a subdivision plat and not
the rezoning file. How can one piece be approved and
5
Noe
the other not?The May 6th conditional approval letter
(conditions#25, and Sub 1-4) mentions the variation,
if the applicant cannot get the variation approved then
the final sub plat would just need to show what was
required by the rezoning without a variation. The
phasing variation is not a major element of the project
and does not change what we reviewed at the
preliminary sub plat much at all.
SDP201600025 - Recreation area
No supporting documents :-( We have a 2
page initial site plan in our office for this proposal,
which is going through site review committee (SRC)
review meeting date:Thursday,June 9th. Notably we
were provided a supporting document, Hydrologic and
Hydraulic Analysis, by the applicant (see below). Also, I
attached is an email from staff to the
applicant identifying the need for a Special Use Permit
(SP) to fill in the floodplain for this recreation area prior
to final site plan approval. The email also covers the
applicants' dispute of this requirement and then staff's
reiteration of this requirement along with engineering
staff's guidance to the applicant.
SUB2016000094- Briarwood Sub. Plat- Phase 1A, 5, & 6
No supporting documents :-(
I have scanned this plat for your review(see attached). I
was just assigned/handed it yesterday at 4pm. We have
21 days to conduct our review. I believe we'll take the
entire 21 days on this one. Especially with the variation
pending a resubmittal and BOS review...etc. Notably
the major thing that jumps out at me is the lots on page
3 being platted are listed as phase 6 and IA; however,
they are currently in phase 4 and were in phase 4 for
the rezoning. If this is part of what the applicant plans
to request for the phasing variation I do not believe
we'd support it at all being the proffer states no lots i
phase 4 shall be platted without the primary rec a a
being built or platted prior to the first final plat r
phase 4. Merely sliding the phase lines and ling this
phase 6 will not be permitted to bypass t proffer. I
have not reviewed this plat, the above " just my quick
thoughts after scanning it for you.

For the latter two, is there any more information
available online? or should I plan a visit to your office to
look things over? or is it just too soon? Honestly, it's
pretty early in the review for staff to be able to provide
you much of anything. But you can always come in and
view the plans anytime.
Thanks,
