The Agent for the Board of Supervisors hereby grants administrative approval to the above referenced site plan.
This approval shall be valid for a period of five(5)years from the date of this letter,provided that the developer
submits a final site plan for all or a portion of the site within one(1)year after the date of this letter as provided in
section 32.4.3.1 of Chapter 18 of the Code of the County of Albemarle,and thereafter diligently pursues approval of
the final site plan.
The final site plan will not be considered to have been officially submitted until the following items are received:
1. A final site plan that satisfies all of the requirements of section 32.6 of Chapter 18 of the Code.
2. A fee of$1,613.
Please submit 10 copies of the final plans to the Community Development Department.The assigned Lead
Reviewer will then distribute the plans to all reviewing agencies. Once you receive the first set of comments on the
final site plan,please work with each reviewer individually to satisfy their requirements.
The Department of Community Development shall not accept submittal of the final site plan for signature until
tentative approvals for the attached conditions from the following agencies/reviewers have been obtained:

The County of Albemarle Planning Division will recommend approval of the plan referenced above once the following
comments have been satisfactorily addressed(The following comments are those that have been identified at this time.
Additional comments or conditions may be added or eliminated based on further review.): [Each comment is preceded by
the applicable reference,which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
2. [32.5.2(a)]The owner information provided for the parcel does not match that shown in County real estate records;
verify that accurate owner information is provided.
3. 132.5.2(i), 14-233(A)3] When private streets in development areas may be authorized. Two private streets(Varick
Street&Marin Court)are proposed to serve 14 single family detached residential lots.While streets(public or private)
are not reviewed or approved with site plan applications,it should be noted that a private street request must be
submitted with the preliminary subdivision plat application. The Agent is not able to authorize these private streets;
rather,they require Planning Commission authorization. Submit the required private street request along with the
required justification.In anticipation of the request I've reviewed the ordinance and find no applicable justification
which would support why these two streets should be approved as private streets.It is advisable they be revised to
public streets.
4. 14.6.3(a)]Shared Driveways. Lots which utilize a shared driveway easement shall establish the primary structure at
least ten(10)feet from the edge of the shared driveway easement. Depict,label,and dimension this setback from the
shared driveway easement.
5. 132.5.2(b)]Proposed use. On sheet 1,under general notes,land areas provided only add up to 7.67 acres,what is
happening to the other 0.88 acres of the site?Revise the land areas to account for acreage of the entire site.
6. 132.5.2(d),30.7]Steep Slopes Overlay District. Throughout the plan label the slopes onsite(preserved and managed
slopes).
7. 132.5.2(d),30.7.4(b)(h)]Slopes less than 25%based on new topographic information.Any use or structure allowed by
right or by special use permit in the underlying district,provided that the owner submits new topographic information
that is based on more accurate or better technical data demonstrating, to the satisfaction of the county engineer, that
the slopes are less than twenty-five(25)percent. The site plan provides a note on sheet 1,which states that new
topographic information shall be provided.County Engineer sign-off on this topographic information is required prior
to final site plan approval.
8. [4.7(c)3] Open Space.A minimum of twenty five(25)percent of the site shall be open space.Not more than eighty
(80)percent of the minimum required open space shall consist of the following:preserved slopes and land devoted to
stormwater management facilities.The open space provided does not appear to meet this requirement. Prior to final site
plan and/or subdivision plat approval provide a chart on the plans to verify the amount of open space outside of

preserved slopes and land devoted to stormwater management facilities is at least 20%of the required open space
provided.
9. [32.5.2(a)] General information. Revise the zoning to include Airport Impact Area(AIA). Also,revise the zoning
provided on the existing conditions sheet to R-4&AIA.
10. [14-302(A)3]Existing or platted streets. Provide the State Route Number 1177 for Dunlora Drive.
11. [14-428]Dedication of open space. Provide the following note: "Open Space is hereby dedicated to the HOA."
12. [32.5.1(c), 15.3,4.19]Setbacks.Non-infill lots-Include the side setbacks and garage setbacks on sheet 1.They are:
"Side setback—none(see Building separation)".Garage Setbacks: "Front loaded garage:minimum 18 feet setback
from R/W. Side loaded garage:minimum 5 feet setback from R/W."
13. [32.5.1(c),15.3,4.19]Setbacks.The setbacks for the development,even the 2 lots currently proposed on Rio Road,are
non-infill setbacks. Remove the"infill setback"label from the plan.
14. [32.5.2(n),32.7.2.3,14-422]Sidewalks&planting strips. Provide sidewalks and landscaping strip along the entire
frontage of the property(along Dunlora Drive and Rio Road).
15. [32.5.2(i),32.5.2(n),32.7.2.3, 14-422]Sidewalks&planting strips. Provide the required planting strip and sidewalk on
the Marin Court cul-de-sac.To request a variation or exception to this requirement please make the official request
with the subdivision plat pursuant to Section 14-422(E), 14-422(F)& 14-203.1.Be advised that I find no justification
in the ordinance which would support these required improvements to be omitted.
16. [32.5.2(i),32.5.2(n),32.7.2.3]Planting strips. Revise the labeling of the planting strip fronting Lot 26.It currently is
pointing to the front setback of the property.
17. [4.12]Parking. Depict, label,and dimension all required parking spaces.Additionally,assure the guest parking spaces
are striped/or signed.
18. [32.5.1(c)]An offsite sanitary sewer easement is required on TMP 62F-C owned by Robert Hauser Homes,Inc.to
serve the development.Prior to final site plan and/or final subdivision plat approval the required offsite easement shall
be platted.The DB page information of this action shall be provided on the final site plan.
19. [32.7.4.2]Easements for stormwater management facilities. Provide access to the stormwater management facility.
Also provide an easement over the facility and the access.
20. [32.5.2(a)] General information. Label all adjacent properties with TMP,owner name,current zoning and use of the
property.The adjacent properties of TMP 62F-C and TMP 62F-AI are not labeled on the plan.Also,none of the
abutting properties are provided with current uses.
21. [32.7.2.1] Vehicular Access to Site. Each entrance onto any public street shall be designed and constructed as required
by the standards of the Virginia Department of Transportation.VDOT approval of the proposed entrances to the site
shall be required prior to final site plan and/or final subdivision plat approval.
22. 114-302(A)3]Existing or platted streets. Provide the right-of-way width of State Route 631.
23. 114-302(A)4&5]Private&public easements. Label all new easements as`proposed'.
24. [14-302(3)10]Stream buffers. Add the following note: "The stream buffers shown hereon shall be managed in
accordance with the Albemarle County Water Protection Ordinance."
25. [32.5.2(j),(k),(1)] Verify that the location(s)and dimensions of all existing and proposed utilities and utility easements
including water,sewer,drainage,telephone,cable,electric and gas are shown on the plan. Also,label all existing
easements with the Deed Book and Page Number.

26. [32.5.2(n),32.5.1(c)]Dimensions. On the plan depict and dimension all proposed improvements,including buildings,
driveways,and garages.
27. 132.5.2(n)]Proposed Improvements. Provide the maximum footprint for all proposed buildings.
28. [32.5.2(n)]Proposed improvements. How is daily household trash going to be disposed of for these units?If each lot is
going to have its own trash container for curbside pickup,where are these containers going to be stored when not in
use?If stored behind the units,how are the middle attached units going to gain access over surrounding lots?Provide a
note on the plan.
29. 132.5.2(n)]Existing and proposed improvements. Clearly depict and label limits of disturbance and show areas where
existing vegetation will be removed.
30. [14-311]Infrastructure improvement plans. Road plans and WPO application must be approved,all required
improvements must be built or bonded,and all required deeds and declarations must be reviewed and approved prior to
final plat and/or final site plan approval.
31. [32.6.2(j)]Landscape plan.A landscape plan that complies with section 32.7.9 is required with the final site plan.
32. [32.7.9.4(b)] Existing trees may be preserved in lieu of planting new plant materials in order to satisfy the landscaping
and screening requirements of section 32.7.9,subject to the agent's approval. If you intend to use existing trees to
satisfy any of the landscape plan requirements,please include the following:
1. Areas and other features shown on landscape plan.The landscape plan shall show the trees to be preserved,
the limits of clearing,the location and type of protective fencing,grade changes requiring tree wells or walls,
and trenching or tunneling proposed beyond the limits of clearing.
2. Conservation checklist.The applicant shall sign a conservation checklist approved by the agent to ensure that
the specified trees will be protected during construction.Except as otherwise expressly approved by the agent
in a particular case,the checklist shall conform to the specifications in the Virginia Erosion and Sediment
Control Handbook,pages III-393 through III-413,and as hereafter amended.
33. [32.7.9.4(c)]Existing landscape features.On the landscape plan identify whether existing wooded areas are evergreen,
deciduous,or a mix thereof.
34. [32.7.9.5] Street Trees. Street trees are required along all existing and proposed streets;provide street trees on the
Dunlora Drive,Rio Road,Marin Court,and Varick Street.
35. [32.7.9.8] Tree canopy.The minimum required tree canopy for the site is 20 percent.
36. [32.5.2(p)&32.7.9.7]Screening. The proposed SWM Facility shall be screened from the adjacent residential lots.
Provide the required screening.

Dear Mr. Perez:
We have reviewed the preliminary plat and initial site plan for Dunlora Overlook, dated May 9,
2016, as submitted by Collins Engineering, and offer the following comments.
1. Please show correct intersection sight distance lines for the Dunlora DriveNarick Street
intersection. The speed limit on Dunlora Drive is 35 mph, therefore requires 390 sight
distance lines.
2. The CG-12's at the intersection with Dunlora Drive should be perpendicular to the
Varick Street. They can be in the radii, but should be directed across Varick Street, not
towards Dunlora Drive.
3. Please provide more detail/additional survey along Dunlora Drive; need to show existing
sidewalk/curb & gutter tying into the proposed sidewalk\ CG-6. Additionally please
show more detail regarding storm drainage at the entrance.
4. VDOT would like to shift the entrance to Dunlora Drive off Rio Road further from the
Rio/John Warner Pkwy intersection, and would like to discuss incorporating this into this
plan.
5. Is the intention for Lots 30 & 31 to construct entrances onto route 631 Rio Road? If so
please provide more detail,e.g. entrance design, sight distance.
6. Please add Road name, route number, speed limit and right of way width to all public
roads shown in the plans.
7. Please add the VDOT standard WP-2 to plans and show the required mill and overlay on
Dunlora Dr.
8. Please add right and left turn lane warrant analysis to the plans.
9. Please add a sight distance profile to the plans.

RWSA wishes to review future submissions of the initial site plan (if any)and the final site plan submission for this
development before any connections will be allowed. I can pass this along to the developer if you like, unless you'd

After further review this weekend of my photos and notes from my initial field visit, and after speaking this morning with
Mr. Cross, a resident located at 900 Charter Oaks Drive, I have decided the current intermittent designation is
appropriate. My scores were higher than the consultant's scores but were still below the 25 point threshold for a
perennial designation.The applicant's offer to provide buffers as noted on the plan submitted Friday is acceptable in my
opinion, in combination with the steep slope restrictions,to provide protections for the stream.
I am on vacation until July 11 and can provide a written determination upon my return. However, please accept this
email in the meantime as a formal determination in this matter.

Without a deferral of the above projects I need to take an action by Friday, July 8th. Please advise
how you wish to proceed. Notably the stream determination by Frank Pohl has yet to be
finalized. He has reviewed the stream study you provided on June 28th and it does not match up
with his own review of the stream, thus prior to making his official determination of the streams
he plans to do another site visit the week of the 11th
Once you pay the SRC notification fee of$215 for SUB2016-97 I can conditionally approve the
plat and initial site plan with the following condition: "f32.5.2( J Per the June 28, 2016 letter by
Bradley J. Petru, Senior Wetland Scientist, which was submitted to staff on June 28, 2016, the
two streams have been categorized as intermittent streams. The stream classification study was
reviewed by the County Engineer and compared against his own assessment of the stream, the
two assessments are in conflict. At the time of this conditional approval letter an official
determination has not been made of the stream type. Based on discussions with the applicant
they have agreed to accept this conditional approval letter with this item remaining unknown.
Prior to early lot/mass grading on the site the stream determination shall be completed by the
County Engineer. Also,prior to final site plan/subdivision plat approval the stream
determination shall be made and the required buffers (if any) shall be provided. "

As discussed at SRC, the above project is pending a stream determination from the County
Engineer, which he hopes to have complete by the end of the week. Also, the road type may be
switching from private to public, of which VDOT said they'd need to review the proposal again
to provide revised comments be previously they only focused on the entrance vs the entire road
as currently is proposed as private. Notes: The applicant has decided to revise the roads in the
development from private to public but does not want to resubmit to get VDOT's review at the
preliminary/initial plan stage of the proposal. All of the above may have the effect of three or
four lots being lost, Marin Court being omitted and Varick Street being relocated, as well as
redesign of all the proposed lots, which may cause additional or modified comments to be
generated. As such, I request you defer the proposal to allow for the above determination and
required revisions to be made based on SRC comments. Once you have revised the proposal I'll
redistribute it to the applicable SRC reviewers, 14 days later I'll take an action on the proposal
based on the new comments.

I met with Christopher Perez, Senior Planner,today at the county community development office. He had preliminary site
plans available for the new development behind charter oaks dr.
At the time that Dunlora forest was in the development stage there was much talk about"critical slopes" and I think some
of that prevented the developer from coming too far down the hill and has preserved an adequate buffer between the
developments. Now, however,the slopes are considered either"preserved" or "managed".
The current sight plan does contain some small slivers of"preserved" slope. Can these be expanded? Who makes that
call?No,these slopes cannot be expanded. How are they determined?The County adopted an overlay district(the steep
slopes overlay district)to categorize all the slopes within the development area and assigned them as either preserved
slopes or managed slopes based on their general characteristics(see below section 30.7.3 of the County Code which
speaks to these characteristics). The overlay district was adopted by the Board of Supervisors in 2014.
30.7.3 CHARACTERISTICS OF STEEP SLOPES
The characteristics of the steep slopes within the overlay district are as follows:
a.Managed slopes. The characteristics of managed slopes are the following: (i)the contiguous area of steep slopes is
limited or fragmented; (ii)the slopes are not associated with or abutting a water feature, including, but not limited to, a
river, stream,reservoir or pond; (iii)the slopes are not natural but, instead, are manufactured; (iv)the slopes were
significantly disturbed prior to June 1, 2012; (v)the slopes are located within previously approved single-family
residential lots;or(vi)the slopes are shown to be disturbed, or allowed to be disturbed, by a prior county action.
b.Preserved slopes. The characteristics of preserved slopes are the following: (i)the slopes are a contiguous area of ten
thousand(10,000)square feet or more or a close grouping of slopes, any or all of which may be less than ten thousand
(10,000)square feet but whose aggregate area is ten thousand(10,000)square feet or more; (ii)the slopes are part of a
system of slopes associated with or abutting a water feature including,but not limited to,a river, stream, reservoir or
pond;(iii)the slopes are part of a hillside system; (iv)the slopes are identified as a resource designated for preservation in
the comprehensive plan; (v)the slopes are identified as a resource in the comprehensive plan; (vi)the slopes are of
significant value to the entrance corridor overlay district; or(vii)the slopes have been preserved by a prior county action,

including, but not limited to, the placement of an easement on the slopes or the acceptance of a proffer or the imposition
of a condition, restricting land disturbing activity on the slopes.
Additionally,there is a term for a protected water feature "W.P.O.". Same questions; how are these determined?Can they
be expanded? Why doesn't the entire length of the two adjacent steams require protection?The plan currently depicts both
streams. Engineering staff and I went out to the site to investigate the streams in more detail to determine if a buffer is
required to be established per chapter 17 of the County Code. I am awaiting a determination from the County Engineer as
to whether the County will establish the buffers on the two streams, as he is the person who would determine this. Notably
if the buffer is established it would be on both sides of the stream, I wonder how this will affect the existing homes within
your neighborhood and/or improvements that are built(homes,pools,decks, garages/sheds)within the would be buffer.
I'll keep you posted once I get a decision.
Applicable sections of the County Code for the WPO are Section 17.
Sec. 17-600 Extent of stream buffers; retention and establishment.
Except as provided in section 17-602, each erosion and sediment control plan and each VSMP permit shall provide for
stream buffers for the purposes of retarding runoff, preventing erosion, filtering nonpoint source pollution from runoff,
moderating stream temperature, and providing for the ecological integrity of stream corridors and networks, as provided
herein:
A.Development within a development area. If the development is located within a development area, stream buffers shall
be retained if present and established where they do not exist on any lands subject to this chapter containing perennial
streams, contiguous nontidal wetlands, or both. The Stream buffer shall be no less than one hundred(100)feet wide on
each side of any perennial stream and contiguous nontidal wetlands,measured horizontally from the edge of the
contiguous nontidal wetlands, or the top of the stream bank if no wetlands exist.
I encourage the community to meet with Mr. Perez if possible at the county office building on McIntire and all those
concerned to attend the Site Review Committee meeting on June 23 at 10am.

As I mentioned today when you discussed the site plan and the process to me, there is in fact a stream on the southern
border of the property that is not indicated in the site plan. There are at least two fresh springs that run into the stream. I
would be happy to show them to someone. Will the plan need to reflect this? The plan currently depicts both streams.
