The County of Albemarle Planning Division will recommend approval of the plan referenced above once the
following comments have been satisfactorily addressed (The following comments are those that have been
identified at this time. Additional comments or conditions may be added or eliminated based on further review.):
[Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless
otherwise specified.]
1. [32.5.2.a & 32.6.2(a)] Revise the zoning note to include all information through the July 22, 2014 Code of
Development update that impacts the property. An example is variation #42 (approved 6-2-11) that
increases the build -to line for commercial buildings along Belvedere Boulevard in Block 2 in order to
accommodate utility, drainage, and site distance easements that exist along the frontage of Belvedere Blvd.
Add a revision cloud around the changed area.
2. [32.5.2.a & 32.6.2(a)] There are notes in the bottom left hand corner of the cover sheet that have
overlapped and cannot be read. Revise the coversheet and ensure that all notes are legible.
3. [32.5.2.a, 32.5.2.b & 32.6.2(a)] Include all previous Letters of Recommendations (LORs) that impact the
primary changes taking place in this minor site plan amendment. Since the footprints and the square
footage of uses is being updated in this amendment LOR #1 approved 9/30/2013, where the footprint of the
building on the corner of Belvedere Blvd and Belvedere Place was changed, should be included.
4. [32.5.2.a & 32.6.2(a)] If previous Letters of Recommendation are included in this minor site plan
amendment they must to be represented accurately. Not all items listed in the "Minor Site Plan Amendment
Proposed Changes:" have been revised in the plan. Address the following if the LOR in question is to be
included:
• In the revision cloud labeled as "1" the 8' Build -To Line does not match that shown in LOR #1 that
was approved on 9/14/2012.
• [32.5.2.b] In the revision cloud labeled as "1" the Open Space revision does not match that shown
in LOR #1 that was approved on 9/14/2012.
• [32.5.2.i] In the revision cloud labeled as "2" the curb closest to Belvedere Blvd. does not match the
curb shown in LOR #2 that was approved on 12/5/2012.
• [32.5.2.i] In the revision cloud labeled as "4" the driveway lengths, units, rear setbacks, front stairs
and decks do not match that shown in LOR #3 that was approved on 3/8/2013. Also, there is a
dimension in the southwest corner of unit #11 that needs to be included.
5. [32.5.2.a & 32.6.2(a)] If it is the intent to incorporate all past LORs in this minor amendment there is
another one that has not been included. There appears to be an LOR approved by code enforcement on
9/18/2014 for the tot lot.
6. [32.5.2.a & 32.6.2(a)] Number 5 in the "Minor Site Plan Amendment Proposed Changes:" should include
the change to the size of the other commercial buildings in the Towncenter, or add another numbered
change to cover those modifications.
7. [32.5.2.a & 32.6.2(a)] Provide the setback lines for the restaurant parcel.
8. [32.5.2.a & 32.6.2(a)] Revise the sheet numbers so that they match the previous site plan submissions.
Since not all sheets are contained in this minor amendment the sheet numbering and naming needs to still
follow those set up within the approved Final Site Plan.
9. [32.5.2(b) & 32.6.2(a)] Clarify the square footage of office on the 1 st and 2nd floors of the 3,500 & 3,600
square foot buildings. There seems to be a much larger foot print, with a 2nd floor, than is necessary in
order to have the amount of retail and office specified and both retail and office are specified on the 1st floor.
10. [32.5.2(b) & 32.6.2(a)] Clarify which building will have the 8 apartment units. They do not appear to be
listed for any of the buildings shown on the site plan, but they are part of the parking calculation. If they will
be within the commercial buildings specify.
11. [32.5.2(b) & 32.6.2(i)] An outdoor patio is shown in the restaurant lot on this minor site plan amendment.
No allowance for outdoor seating has been included in the parking calculations. Outdoor seating must be
accounted for in any parking calculation even though the area of outdoor seating will not count towards
building square footage allowed per the Belvedere Code of Development. See the comment from Zoning.
The primary contact for this project has stated that outdoor seating is not planned for the restaurant. If at
any time in the future outdoor seating is desired the parking calculations will need to be revised to include
the square footage of the outdoor patio and the amount of parking required will need to be provided.
12. [32.5.2(p) & 32.6.20)] The Plant Legend and calculations appear to be from the approved Final Site Plan
and not the previous Minor Site Plan Amendment. Therefore, they do not match the plantings shown on
sheet 4. Revise the landscape plan to show the most current plantings, schedule and calculations.
13. [32.5.2(k) & 32.6.2(a)] Provide the location of the water and sanitary sewer laterals for the modified building.
14. [32.5.2(k) & 32.6.2(a)] Provide on the plan the revised location for the FDC connection.
15. [32.5.2(1) & 32.6.2(a)] Revise the gas line easement to go its full length through the property. If the notes
shown are causing the line to not be visible relocate the notes so that they do not conflict.
16. [32.5.2(n), 32.6.2(k) & 4.17] If any additional external lighting fixtures are proposed, especially considering
the addition of the outdoor patio, provide an updated photometric plan.
17. [32.5.2(n) & 32.6.2(a)] Revise the minor amendment to show the actual location and height of the retaining
wall. The retaining wall does not appear to be in same the location shown on the approved final site plan or
previously approved minor amendment. The wall has been built and does not appears to be in the
approved location. It also appears to be taller than was approved. Represent the wall in the location and
the height as it was built on this site plan amendment and include that change in the "Minor Site Plan
Amendment Proposed Changes:".
18. [32.5.2(n) & 32.6.2(a)] Because of the change in use to restaurant, provide information on how trash will be
handled. If a dumpster is now required provide its location, dimensions, and required screening.
19. [Comment] This site plan amendment cannot be approved until Engineering, Inspections, Fire Rescue,
VDOT, ACSA and Zoning have approved the plan. See their attached comments.
Staff has provided references to provisions of Chapter 18 of the Code of the County of Albemarle. The
Code is kept up to date by the County Attorney's office. The Code may be found on the County Attorney's
website which may be found under "Departments and Services" at Albemarle.org.
In accord with the provisions of Section 32.4.3.5 of Chapter 18 of the Code if the developer fails to
submit a revised final site plan to address all of the requirements within six (6) months after the date of
this letter the applicatio shall be deemed to have been voluntarily withdrawn by the developer.
