VSMP Permit plan review

County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to act
on any VSMP permit by issuing a project approval or denial. This project is denied. The rationale is
given in the comments below. The application may be resubmitted for approval if all of the items
below are satisfactorily addressed. The VSMP application content requirements can be found in
County Code section 17-401.
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must
contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary.
1. Provide a SWPPP including Pollution Prevention Plan [17-401, 17-405]
B. Pollution Prevention Plan (PPP)
The PPP content requirements can be found in County Code section 17-404.
No Pollution Prevention Plan was provided in the submittal. Please provide a PPP as described in
County Code [17-404].
C. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a
SWMP. This plan is disapproved, and the reasons are provided in the comments below. The
stormwater management plan content requirements can be found in County Code section 17-403.
Plans show LOD extending onto both properties to the south of the proposed project. Please provide
TMP and owner info to application with required signatures.
Provide calculations using the VRRM New Development Compliance Spreadsheet instead of the
VRRM Re -Development Compliance spreadsheet as provided. This project is more consistent with
new development practices.
A conservation easement must be established for areas designated in the plan as forested/conserved
open space. A PLAT of these areas must be provided along with a Deed of Easement. Limit plan and
VRRM analysis to the LOD and area within the buffer, including mitigation areas, which are to be
conserved as forested/open space. Incorporating entire parcel as forested/conserved open space will

provide difficulty during future development.
4. Culvert length and invert elevations are inconsistent between driveway profile and plan views on
sheet C6, correct and clarify.
5. Provide calculations ensuring culvert is sized to pass the ten (10) and twenty-five (25) year storms
without overtopping driveway or backing water onto upstream properties [ 17-604 C. La., 14-410,
18-32.7.2.1].
6. Provide evidence of required state and federal permits for stream disturbance [17-604 C.6.].
7. Plan scaling is inconsistent with labeling. Sheet C3 is scaled to 1"=100', but noted as 1"=20'. Sheet
C5 notes scaling as 1"=30', but is scaled to 1"=20', correct this deficiency.
8. The level spreader associated with drainage area/ditch 3 is located within a critical slope area. Level
spreaders cannot be placed on critical slopes. Evaluate other options.
9. The drainage area for ditch 3 is incorrect as represented in the Modified LD -268 roadside ditch
design form; However, the correct value seems to be used in subsequent calculations, please correct
this inconsistency.
10. Display grading used to guide flow from ditches to level spreaders.
D. Erosion and Sediment Control Plan (ESOP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESOP.
This plan is disapproved, and the reasons are provided in the comments below. The erosion control
plan content requirements can be found in County Code section 17-402.
1. Provide copies of federal and state permits for any wetland or stream disturbance. (Army Corps,
VDEQ, etc.) [17-312A,B, 17-319B,D, 17-320C,D, 18-32.1.2, 14-3111
2. Identify and label existing critical slopes [18-4.2]. Note: A waver is not needed as access to back part
of lot is not possible without disturbing critical slopes; however, these areas must still be identified
on plans.
3. Identify location of soil stockpile/waste areas. Sequence of construction implies that fill would be
needed from offsite in order to fill culvert area before cut areas are reached during driveway
construction on opposite side of the stream.
4. Replace straw bales with rock check dams within swales. Straw bales are not to be used in
swales/defined ditches per the green book [Page III -15 practice 3.04].
5. Indicate areas where dust control practices will be used.
6. Provide silt fencing above pipe outlet and inlet following culvert installation. This will prevent
unnecessary sediment from entering stream channel between culvert installation and adequate
stabilization.
E. Mitigation Plan
The mitigation plan content requirements can be found in County Code section 17-406. Mitigation plans are
required for owners which seek to develop in a stream buffer.
Identify critical slopes [18-32.5.2]
Provide maintenance narrative, schedule of planting (including completion date), and typical spacing
detail for planting plan.
The VSMP permit application and all plans may be resubmitted for approval when all comments have been
satisfactorily addressed. For re -submittals please provide 2 copies of the complete permit package with a
completed application form.

Engineering plan review staff are available from 2-4 PM on Thursdays, should you require a meeting to
discuss this review.
Process;
After approval, plans will need to be bonded. The bonding process is begun by submitting a bond estimate
request form and fee to the Department of Community Development. One of the plan reviewers will prepare
estimates and check parcel and easement information based on the approved plans. The County's
Management Analyst will prepare bond agreement forms, which will need to be completed by the owner and
submitted along with cash, certificates or sureties for the amounts specified. The agreements will need to be
approved and signed by the County Attorney and County Engineer. This may take 2-4 weeks to obtain all the
correct signatures and forms.
Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded.
The County's Management Analyst or other staff will prepare the forms and check for ownership and
signature information. The completed forms will need to be submitted along with court recording fees.
