Waterperry Farm
Our intention is to create a venue for educational happenings, weddings, and
charity events that will serve the enjoyment and betterment of the community at large,
and contribute to the creative economics of the area.
Our property is zoned rural, just under one hundred acres in size, with twenty-five
of those acres in woods and the remainder in pasture and mowed lawn. The farms
abutting and surrounding us are also in mixed pasture and woodland, with many of them
in land use. We too are in land use, but there will be zero impact on our hayfields and
timber woods as the events will only take place on mowed lawn areas and in the gardens.
Though we have not put our property under conservation easement, we are conservation-
minded and plan to uphold the integrity of this beautiful landscape. The venue site sits
near the middle of the property, with plenty of buffer on all sides to ensure the privacy of
each neighbor.
It is custom in the industry for wedding parties to provide shuttles for their guests.
We will encourage this for all of our events to keep traffic and road wear to a minimum
and to ensure the safety of all. We will require it for events larger than one hundred
people. According to VDOT specifications, we are widening our farm entrance and
directing traffic flow with signs and/or attendants to accomodate vehicles entering and
exiting as well as parking in the designated area(see concept map). There is a distance of
seventy-five feet from the edge of the parking area to the property line, with a natural
buffer of mixed trees and shrubs. (See concept map.) After dark, lighted paths and
torches along the farm road will guide guests back to the parking lot, which will be
adequately lit by county standards.
If amplified sound is ever needed for an event, there will be a set decibel limit as
well as a ten o'clock noise curfew for amplified sound, and for all such events sound
system speakers will point toward the many acres of unoccupied woods which back up to
the mountains. We wish to arrange a test simulation with your office to better address
these concerns and determine the optimal sound conditions. Upon the recommendations
of the board, we will include in our contractual agreement the expectation that sound
requirements be met, and will be on hand to enforce such requirements and regulate as
necessary. If complaints are made, despite these measures,we will adjust accordingly.
All food and beverages will be provided by caterers and prepared off site in
approved commercial kitchens. All utensils and dishware will be properly sanitized off
site as well.
We plan on hosting a maximum of twenty-four smaller, boutique garden
weddings and gatherings with no more than one hundred and fifty people. We ask in
addition to be granted an exception to host up to five events at a maximum of two
hundred and fifty guests. It is our hope to offer the use of our pool house, built in 2008,
to the wedding party as a changing room for the groomsmen. If our venture is successful,
we are also hoping to build a small structure in the garden of approximately twenty-eight
feet by forty-eight feet, the primary use of which would be agricultural (a greenhouse),
with the option to have it double as a protected interior space for a small event. Though in
the future we would like to provide a permanent restroom with its own septic field
(perhaps as an addition to the greenhouse), for the time being each event will have
temporary restroom facilities, without access to any of our existing fields. The area is
already well screened; no grading or disturbance of ground will be necessary. (See
concept map.)
Thanks you for your consideration. We are looking forward to getting started.
Sincerely,
°P/
We would like to request the following special exceptions:
1. The use of the existing pool house (built in 2008) as a changing room for the
groomsmen.
2. The future construction of a twenty-eight by forty-eight agricultural greenhouse,
to double as a small event space.
3. The addition of a two-stall,permanent restroom facility to the aforementioned
greenhouse, with its own designated septic field to accommodate up to one
hundred people.
4. Of our permitted twenty-four events,we ask for an exception to host up to five
events at a maximum of two hundred and fifty guests.

To be paid after staff review for public notice:
Most applications for a Special Use Permit require at least one public hearing by the Planning Commission and one public
hearing by the Board of Supervisors. Virginia State Code requires that notice for public hearings be made by publishing
a legal advertisement in the newspaper and by mailing letters to adjacent property owners. Therefore,at least two fees
for public notice are required before a Special Use Permit may be heard by the Board of Supervisors. Applications
reviewed by the Board of Zoning Appeals, however, only require one public hearing and therefore require just one fee for
public notice.
The total fee for public notice will be provided to the applicant after the final cost is determined and must be paid before
the application is heard by a public body. Staff estimates the total cost of legal advertisement and adjacent owner
notification to be between$350 and$450 per hearing. This estimate reflects the average cost of public notice fees for
Special Use Permit applications, but the cost of certain applications may be higher.
> Preparing and mailing or delivering up to fifty(50)notices $200+actual cost of first-class postage
> Preparing and mailing or delivering each notice after fifty(50) $1.00 for each additional notice+actual
cost of first-class postage
> Legal advertisement(published twice in the newspaper for each public hearing) Actual cost
(averages between$150 and$250)

Memorandum
To: Scott Clark,Senior Planner
From: Amelia McCulley, Director of Zoning
Date: October 14, 2014
Subject: October 6, 2014 Mandatory Preapplication Conference Comments-Waterperry
Farm
1. Please review the applicable regulations for special events(definition and Section 5.1.43).
This ordinance provision includes restrictions on the number and size of events, setbacks and
the use of structures associated with special events.
2. As discussed in the preapplication conference, if you wish to hold events that either exceed
150 attendees at one time or 24 events per year, please include a specific written request for
special exception with your special use permit application. For example, how many events in
a year would exceed 150 attendees and how many attendees are you requesting?
3. Please revise yoconcept plan (per Section 5.1.43 (b1))to show location and setback for
u
portable toilets, p rking and any structures(including tents)that will be used for special
events. Please nfirm that the proposed parking area is sufficient to accommodate 60 cars
for guests and 1 for each employee. Please also show or explain how these features (parking,
portajohns, etc.)v011 be screened as required by these regulations. Please clarify if any
grading will be nessary to accommodate these features and if so, show the limits of grading.
If any of these fea ures cannot meet the required setbacks, please submit a specific written
request for specialexception. If lighting, even temporary lighting during events, is proposed—
please show it an describe it in your narrative. Lighting is generally subject to section 4.17)
but is held to a higher standard with Rural Areas special use permits.
4. If any of the structures that will be used for special events were built after 2005 (the date of
adoption of these regulations, please submit a specific written request for special exception.
5. You discussed the use of a shuttle to address traffic concerns. This will be difficult to enforce
for regular events but can be proposed for any larger events. If this is proposed, please
explain it in your arrative for submittal. If any other measures for traffic control are proposed,
please mention ttlem in your narrative for submittal.
6. Noise from outdoor activities, particularly amplified music, is a common impact on and concern
of neighbors. W discussed what we are recommending with the farm wineries based on our
experience and suggest that you undertake the same procedures. We recommend you
undertake the following: a)self-monitoring of sound levels during an event; b) propose a
nighttime limit of outdoor amplified sound that is no later than 10 pm (the definition of nighttime
in the zoning ordihance); c)contracts that clarify requirements and expectations with regards
to maximum sound levels, including how complaints will be handled; and d) some simulation
and testing of so rid levels at the property line. This can inform you as to whether a different
location or sound attenuation measures are necessary.
Section 5.1.43 (b 2) requires the applicant to submit written comments from the Virginia
Department of H alth with the special use permit application.
8. Please include aecorded plat with your special use permit application.
9. Please keep in ind Section 5.1.43 f which prohibits development to a more intensive use.
