THIS IS ARRIVED AT BY CONVERTING THE 2.27 ACRES OF APPLIICANT'S ENGINEER MADE THE APPLICANT AWARE OF THIS CONFLICT DURING SITE PLANNING REQUIRED MITIGATION TO SQUARE FEET (98,881 SF) AND THEN DIVIDING BY 400 SF, WHICH IS AND -THE APPLICANT THEN MET WITH STAFF TO DISCUSS CORRECTING THE MATTER. AT THAT TIME EQUIVALENT TO ONE MITIGATION UNIT. 98,881 / 400 = 247. IT WAS DETERMINED THAT A RE—VISITATION OF THE SPECIAL PERMIT BY THE BOARD OF SUPERVISORS WOULD BE REQUIRED TO MAKE SUCH A CHANGE. THE APPLICANT DESIDED TO DEFER FROM THE PRIOR TWO PARAGRAPHS ONE CAN SEE THAT PLANTINGS BEING PROPOSED WITHIN THE APPEALING THIS MATTER UNTIL THE SITE PLAN WAS APPROVED AND CONSTRUCTION WAS 100' WPO BUFFER EQUATE TO 134 MITIGATION UNITS. THIS IS 113 FEWER MITIGATION UNITS THAN IS UNDERWAY, THIS PLAN REPRESENTS A PROPER APPLICATION OF THE MITIGATION PROGRAM REQUIRED. THE ALBEMARLE COUNTY ENGINEERING DEPARTMENT HAS SUGGESTED THAT INCLUSION OF OUTUINED IN THE MANUAL REFERRED TO ABOVE. ALTERNATIVE WATER QUALITY MEASURES, SUCH AS INSTALLATION OF FILTERRA UNITS, WILL BE UNDER TABLE B, THE 100' BUFFER IS DIVIDED INTO TWO PARTS; THE 50' SWATH OF LAND NEAREST THE STREAM AND THE 50' SWATH FURTHEST FROM THE STREAM. TABLE B REQUIRES THAT THE NEAREST 50' SWATH BE MITIGATED IN THE SAME MANNER AS THAT REFERRED TO IN TABLE A. THE FURTHEST 50' SWATH OF LAND CAN THEN BE MITIGATED IN A VARIETY OF WAYS. THIS PLAN SHOWS THE STREAM, BOTH SWATHS OF LAND AND LISTS THE MEANS OF MITIGATION PROPIOSED IN EACH. BEFORE DEFINING THE LIMITS OF THESE TWO APPLICATIONS THE FOLLOWING PARAIMETERS NEED TO BE TAKEN INTO CONSIDERATION. 1. THERE ARE AREAS OF THE SITE THAT ARE ENCUMBERED BY THE APPLICATION OF A 20' BUFFER THAT IS ASSOCIATED WITH MUCH OF ITS BOUNDARY PERIMETER. HOWEVER, THE ABOVE ACTION BY THE BOS ESTABLISHED A RE—PLANTING AREA WHICH GRAPHICALLY INCLUDES PORTIONS OF THE 20' BUFFER. NO DISTURBANCE IS PERMITTED WITHIN THE 20' BUFFER, INCLUDING PLANTING EFFORTS. THEREFORE, THIS PLAN DOES NOT PROPOSE NEW MITIGATION PLANTINGS WITHIN THE 20' BUFFER, EXCEPT IN A FEW INSTANCES WHERE THE AREA WITHIN THE BUFFER IS CURRENTLY OPEN LAND.. THOSE AREAS WITHIN THE 20' BUFFER THAT ARE WOODED AT THIS TIME ARE PROPOSED TO BE PRESERVED. FIELD OBSERVATION INDICATES THAT THESE EXISTING WOODED AREAS HAVE NATIVE CANOPY, UNDERSTORY AND GROUNDCOVER AND ARE NOT GOOD CANDIDATES FOR MITIGATION. THE GOAL IS TO PRESERVE, RATHER THAN COMPROMISE, EXISTING VEGETATION. 2. THERE ARE AREAS OF THE SITE THAT FALL WITHIN THE 100' WPO BUFFER THAT ARE TO BE DISTUJRBED, BUT ARE BEYOND THE BOS—APPROVED REPLANTING AREA LIMITS. THIS APPLICATION PROPOSES TO REPLANT THESE AREAS AS WELL. 3. THERE ARE AREAS OF THE SITE THAT FALL WITHIN THE 100' WPO BUFFER THAT ARE NOT PROPOSED TO BE DISTURBED. THESE AREAS WERE INVESTIGATED AS POTENTIAL LOCATIONS FOR ON—SITE MITIGATION, THESE AREAS DISPLAYED NO NOTEWORTY EROSION AND WERE FOUND TO SUPPORT NATIVE CANOPY, UNDERSTORY AND GROUNDCOVER AND, AS SUCH, ARE ALSO NOT GOOD CANDIDATES FOR MITIGATION. ACCEPTABLE IN MEETING THE BALANCE OF THE MITIGATION REQUIREMENT. THESE FILTERRA UNITS AND ANY OTHER MITIGATION MEASURES INTENDED AS PART OF THE MITIGATION PROGRAM ARE INCLUDED ON THE FINAL SITE DEVELOPMENT PLANS AND WPO SUBMISSION FOR THIS PROJECT, REFER TO THE PLANT LIST ON THIS SHEET FOR THE TYPE AND SIZE OF PLANTS CONSIDERED SUITAIBLE FOR THIS PROGRAM. DUE TO THE VERY LARGE QUANTITY OF PLANTS REQUIRED AND THE REAL POSSIBILITY OF ENCOUNTERING ISSUES RELATED TO AVAILABILITY THIS PLAN PROVIDES FOR PLAN1T OPTIONS WITHIN EACH CATEGORY OF PLANT TYPE REQUIRED. A MIX OF NUMEROUS PLANT SPECIES WITHIN EACH CATEGORY IS CONSIDERED MOST DESIRABLE. AREAS WHERE TREES OR WOODED AREAS ARE SPECIFIED FOR PRESERVATION SHALL BE CORDONED—OFF WITH SAFETY FENCE PRIOR TO COMMENCEMENT OF SITE WORK, SILT FENCE MAY TAKE THE PLACE OF SAFETY FENCE WHERE ITS USE FUNCTIONS FOR EROSION CONTROL. ALL EQUIPMENT SHALL BE KEPT AWAY FROM THE DRIPLINE OF TREES THAT ARE TO BE PRESERVED. ALL GRADED AREAS TO REMAIN AS LANDSCAPE SHALL RECEIVE TOPSOIL, LIME, FERTILIZER, PERMANENT SEEDING AND `.STRAW MULCH. SLOPES OF UP TO 3:1 SHALL RECEIVE SURFACE ROUGHENING AFTER TOPSOIL APPLICATION, AS WELL AS PERMANENT SEEDING AND STRAW MULCH AT TWICE THE NORMAL APPLICATION RATES. SEE EROSION CONTROL PLAN AND SPECIFICATIONS FOR SEED TYPE. SLOPES GREATER THAN 3:1 SHALL ALSO RECEIVE LANDSCAPE NETTING APPLIED ATOP THE STRAW MULCH, WHICH SHALL BE STAPLED TO THE GROUND. ALL SITE PLANTINGS OF TREES AND SHRUBS SHALL BE ALLOWED TO REACH, AND BE MAINTAINED AT, MATURE HEIGHT; THE TOPPING OF TREES IS PROHIBITED.
