Dear Ms. Bennifield:
In response to your request for a Letter of Zoning Compliance for the above referenced
Property, please be advised of the following:
The Property is zoned Planned Unit Development (PUD) (See attachment). Section
20.3.1 of the zoning ordinance allows multi -family development as a by -right use. The
Property is subject to the Airport Impact Area ("AIA") and Steep Slopes Overlay Districts
as described in Section 30 of Chapter 18 of the Albemarle County Code ("Zoning
Ordinance"). The Property was rezoned to a planned development community from
Residential (R-1) on May 8, 1972, prior to the current Zoning Ordinance adopted in
1980, and given this Planned Unit Development (PUD) classification in the new zoning
map of December, 1980. The PUD zoning has remained on the Property since that
time.
• Development of the Property has occurred per SDP1988-00113 Final, SDP1989-00045
Minor Amendment, and SDP1997-00123 Minor Amendment and is subject to applicable
use, site plan and water protection ordinance regulations. The Property is improved with
16 multi -family buildings with a total of 144 units.
• The adjacent properties are as follows: parcels to the Northwest, West and South are
zoned PUD, parcels to the East are zoned Residential (R-1), parcels to the Northeast
are zoned Planned Residential Development (PRD), and parcels to the North are zoned
Residential (R-4).
• This office has no record of any open building or zoning violations for the Property.
• The site plans are in a large format and not in a form to copy with this letter. Copies of
any approved site plans and certificates of occupancy or other documents may be
obtained from this office with a request through the department's Records Manager,
