The Property is zoned Residential, R-6 (See County Code link) and is subject to the use restrictions generally applicable to that classification which are contained in Chapter 18 of the Albemarle County Code (the "Zoning Ordinance"). Copies of the Sections of the Zoning Ordinance applicable to the Property and existing buildings (including parking, setback and height and bulk requirements) are noted below and can be accessed via the County Code link below. Applicable Sections of the Zoning Ordinance may include but are not limited to, Section 4 - General Regulations (includes parking, setbacks, etc.), Section 5 - Supplemental Regulations, Section 16 - Residential R-6 Residential (includes permitted uses, building heights, minimum lot sizes, etc.), Section 32 - Site Plan and Section 30 - Overlay Districts, specifically, Flood Hazard and Steep Slopes Overlay Districts. • The proposed use of the Property for multifamily rental apartments, and accessory uses related thereto, are permitted uses under Zoning Ordinance Section 16 without the necessity of any rezoning, special exception, use permit or variance. • If the Property is developed in accordance with a site plan approved by the County of Albemarle, the Property will comply with the Zoning Ordinance. A proposed development is being reviewed under SDP2016-00049 The Vue — Final. The current setback requirements for the Property are noted in Section 4.19 of Section 4 of the Zoning Ordinance. (See County Code link) Setbacks are measured from the existing right-of-way or property lines. November 30, 2016 LZC-201600041 Page 2 • The required number of parking spaces for the Property are noted in Section 4.12 of Section 4 of the Zoning Ordinance. The Building Code requires the handicap spaces. The number of required spaces depends on the number of bedrooms and buildings. The current proposal being reviewed shows 218 regular 9'X18' spaces and 7 handicap spaces. (See County Code link) • Ingress and egress to and from the Property is to and from publicly dedicated roadways. • No application for rezoning of the Property, or for a special or conditional use permit or variance in connection with the Property, is now pending. • Above, the Property is noted to collectively be two parcels of land and each is recognized as a separate parcel of land under the subdivision ordinance of the County of Albemarle. Each may be conveyed, leased or mortgaged as a separate parcel. Any subdivision application including boundary line adjustments must comply with such subdivision ordinance and other applicable subdivision laws. The Property is not subject to any conditions or special limitations imposed by the County of Albemarle in connection with any subdivision approval of the Property. • The Property is currently in compliance with the Zoning Ordinance and any applicable proffers or conditions, including but not limited to all regulations regarding setbacks, dedications, parking and height. • The Property is not subject to an approved rezoning, special exception, special use permit or variance application, nor are there any of the noted applications pending review/action by the County. • This office has no record of any past or pending zoning violations having been filed with respect to the Property, and the undersigned is unaware of any violations of the applicable portions of the Zoning Ordinance. • Copies of any approved site plans or other documents may be obtained from this office with a request through the department's Records Manager, Paul Bjornsen, at pbiornsen(a)-albemarle.org Please contact me if you have questions or require additional information.
