Dear Ms. Havrilla:
In response to your request for a Letter of Zoning Compliance for the above referenced
Property, please be advised of the following:
• The Property is zoned LI, Light Industry ("LI"). The Property is subject to the Airport
Impact Area Overlay ("AIA"), the Flood Hazard Overlay ("FH"), the Entrance Corridor
("EC") Overlay District, and the Steep Slopes Overlay as described in Section 30 of
Chapter 18 of the Albemarle County Code ("Zoning Ordinance").
The use described in your letter dated 3/24/2016 (attached) is considered a primary by
right use in the LI zoning, identified as Storage/Warehousing/Distribution/Transportation.
The LI zoning district also allows by right, subordinate retail sales for any use permitted
by right, provided the use does not exceed 25% of the gross floor area of the primary
industrial use. See Section 3 of the Zoning Ordinance for a definition of
Storage/Warehousing/Distribution/Transportation and Section 26 for the list of by right,
special use or prohibited uses in the Industrial zoned districts. With the Property being in
the EC, outdoor storage is also permitted but may require a special use permit if
determined that any portion would be visible from the EC street to which it is contiguous
or from any other EC street which is located within five hundred (500) feet. You can
contact Margaret Maiiszewski, ARB Design Planner, for discussions on visibility of the
outdoor storage from the EC street.
Development of the Property requires review and approval by the County of an initial site
plan and then a final site plan before any building permits or zoning clearances may be
applied for. If outdoor storage is determined to be visible from the Entrance Corridor then
a special use permit will also be required. Compliance with supplemental regulations for
outdoor activities and storage in industrial districts is required as well, see Sections
5.1.51 and 5.1.52 of the Zoning Ordinance for the specific requirements.
The Property does have an approved Variance (VA2009-00004) for the setback from the
road right-of-way to be reduced from 50' to 10'. This action was made in conjunction
with a proposed subdivision to establish a new road and 10 lots. The subdivision that
included the road never went forward for final approval. The setbacks for industrial
properties have since changed, via a Zoning Text Amendment, to allow buildings to be
10' from the road right-of-way which make the need for the variance no longer required.

• This office has record of an open violation for this Property. The violation is for operation
of a business without an approved zoning clearance.

reference above for Chapter and Sections.

RE: REQUEST FOR ZONING CONFIRMATION

Dear Sir/Madam:
1 am writing on nenad of Ferguson Enterprises, inc. anti its suosiclianes and affiliates (collectively,
"Ferguson") to request a letter for our files to confirm that the subject property is zoned for wholesale
distribution and ancillary retail sales of plumbing, HVAC, waterworks, and other building materials and
related building supplies together with the outdoor storage of materials.
Ferguson is the largest distributor of plumbing products, fixtures and supplies in the United States. In
addition, Ferguson distributes HVAC, pipes -valves -fittings (PVF), waterworks, fire suppression, lighting,
appliances and other related building products. Ferguson's primary sales focus is directed toward the
construction industry — developers, general contractors, professional tradesmen, municipalities and
manufacturers (for mill supplies). The Internal Revenue Service classifies Ferguson's principal business
activity as "wholesale trade" (421700 1997 NAICS), (423700 2002 NAICS) and (50701987 SEC).
Ferguson is considering purchasing the land located at parcel #0700-00-00-008130 for the above purpose.
The facility will be marketed to developers, contractors and professional tradesmen or industrial and mill
supply customers or waterworks contractors and municipalities.
Please confirm in writing, on official municipality letterhead, that our proposed use is permitted under the
zoning designation applicable to the facility as a matter of right, without the requirement of any special or
conditional use permit, variance, "grandfathering" or other special exception. If possible, I would appreciate
a copy of the relevant zoning ordinance for our files. I have enclosed a sample zoning confirmation letter for
your use should it prove acceptable.
