1. Development of the use shall be in accord with the conceptual plan titled "Faith Christian Center
International Special Use Permit — Concept Plan" prepared by Brian P. Smith Civil Engineering,
Inc., and dated May 13, 2010 (hereafter "Conceptual Plan"), as determined by the Director of
Planning and the Zoning Administrator. To be in accord with the Conceptual Plan, development
shall reflect the following major elements within the development essential to the design of the
development:
• building orientation;
• building mass, shape, and height;
• location of buildings and structures;
• turn lane design;
• location of parking areas;
• relation of buildings and parking to the street.
Minor modifications to the plan which do not conflict with the elements above may be made to
ensure compliance with the Zoning Ordinance.
2. The area of assembly shall be limited to a maximum three hundred ninety nine (399)-seat sanctuary.
3. Side and rear setbacks shall meet commercial setback standards, as set forth in Section 21.7 of the
Albemarle Zoning Ordinance, of fifty (50) feet for structures (excluding signs) and twenty (20) feet
for parking lots and loading spaces adjacent to residential uses or residentially zoned properties.
4. All outdoor lighting shall be only full cut-off fixtures and shielded to reflect light away from all
abutting properties. A lighting plan limiting light levels at all property lines to not greater than 0.3
foot candles shall be submitted to the Zoning Administrator or their designee for approval prior to
approval of the final site plan.
The area labeled "Re -planting Area" on the Conceptual Plan shall be replanted (where tree cover
does not already exist) according to "Restoration/Establishment Table B", option B, in Appendix D
of the "Riparian Buffers Modification & Mitigation Manual," published by the Virginia Department
of Conservation & Recreation's Chesapeake Bay Local Assistance program. This area shall be
replanted with species listed in the brochure titled "Native Plants for Conservation, Restoration, and
Landscaping: Piedmont Plateau," published by the Virginia Department of Conservation and
Recreation.

6. The hours of operation for the day care shall not begin earlier than 7:00 A.M. and shall end not later
than 6:00 P.M., each day, Monday through Friday, provided that occasional day care -related events
may occur after 6:00 P.M.

b. All such uses shall conform to the requirements of the Virginia Department of Health Bureau
of Tourist Establishment Sanitation and other applicable requirements.
5.1.06 DAY CARE CENTERS
Each day care center shall be subject to -the following:
a. State licensure. Each day care center shall acquire and maintain the required licensure from
the Virginia Department of Social Services. The owner or operator of the day care center shall
provide a copy of the license to the zoning administrator. The owner or operator's failure to
provide a copy of the license to the zoning administrator shall be deemed to be willful
noncompliance with the provisions of this chapter.
b. Inspections by fire official. The Albemarle County fire official is authorized to conduct
periodic inspections of the day care center. The owner or operator's failure to promptly admit
the fire official onto the premises to conduct an inspection in a manner authorized by law
shall be deemed to be willful noncompliance with the provisions of this chapter.
c. Relationship to other laws. The provisions of this section are supplementary to all other laws
and nothing herein shall be deemed to preclude application of the requirements of the Virginia
Department of Social Services, Virginia Department of Health, Virginia State Fire Marshal, or
any other local, state or federal agency.

c. Off-street parking or storage lanes for waiting patrons shall be available to accommodate not
less than thirty (30) percent of the vehicular capacity of the theatre unless at least six (6)
entrance lanes, each with a ticket dispenser, are provided, in which case the amount may be
reduced to not less than ten (10) percent;
d. The screen shall be located as to be reasonably unobtrusive to view from any major street,
public area or scenic look -out;
e. A wall or fence of adequate height shall be provided to screen the patrons and cars in
attendance at said theatre from the view of the surrounding property. The perimeter of said
fence shall be landscaped with suitable plants and shrubbery to preserve as far as possible
harmony with the appearance of the surrounding property;

I was able to complete the fire inspection today, no fire code violations where found during the inspection.
We did discuss storage in several locations in the building, along with evacuation plans showing two ways

Dear Dr. Frye:
Faith Christian Academy, operated by Faith Christian Center International and located at 221 Carlton
Road, Suites 4-7, Charlottesville, Virginia 22902, has filed the required documentation for exemption as a
child day center that is operated or conducted under the auspices of a religious institution pursuant to
Section 63.2-1716 of the Code of Virginia, This exemption is effective 8/12/16 through 8/11/17.
According to the documentation provided to us by the Building Official for the City of Charlottesville,
your maximum occupancy for Educational Use (Suite 5) shall not exceed 50 people with no more
than 10 children in care under the age of 2 % years; your maximum occupancy for Assembly area
(Suite 6) shall not exceed 90 people; and the maximum occupancy for Church Day Care (Suite 4)
shall not exceed 66 people with no more than 13 children in care under the age of 2 % years.
According to the Staff -Child Ratio Information Sheet you filed with us, you are currently providing
services for a maximum of 98 children at any one time, birth through 12 years of age.
Pursuant to the information you have filed with us, your operation is in compliance with the staff -child
ratios required in the law. The exemption law requires that you maintain these staff -child ratios throughout
the year. Any significant changes in the number of staff or children should be documented on a new
Staff/Child Ratio Sheet (along with the supporting health staternent for any new employees) and be
submitted to this office in order that we may update our records for your facility. Please be sure to get
both the Criminal History Record Check and Central Registry Search on all new employees.
The exemption law requires that you file the renewal documentation annually. You will be notified
approximately 90 days before the expiration date. Please distribute the health forms to your staff and
schedule the necessary inspections to facilitate the timely filing of the renewal documentation. If you have
