Reminder-you are planning on discussing with Zoning staff on Tuesday the following:
4.1 WATER SUPPLIES AND SEWER SYSTEMS The water supply and sewer system serving either a development or any individual lot shall comply
with the following:a.Public water supply and public sewer system within the servicesareas of the Albemarle Cbunty-Service Authority. Within the
services areas o the Albemarle Coun Service Authori the "service areas" •ach development and each lot shall be serve, b the public water
supply and the public sewer system. Within the service areas, no building permishall be issued for any structure if its use re..ires increased water
consumption and/or sewage disposal, unless the structure will be connected to th• public water s pply and/or the pub!' ••wer system. Connection to
the public water supply and/or the public sewer system is not required in the following . , •• •_•...
Does the meaning/determination of"served"in section 4.1 mean built?Does mean bonded?Does it mean a sewer
easement to a public sewer line?
Your initial thought is we should only require an easement be when you look at the similar section w/regard to health
dept approval of septic fields(14-416)it says shall be served. But we do not equire septic to be bonded or built prior to
final plat approval.
Let me know what you all come up with as I need to get back to Justin some ime this upcoming week and am looking for
some Zoning guidance on this.

Chris,
I don't think the easement really changes anything. VDOT's perspective is that their access would be out on to the
existing access road that appears to cross their property. Functionally they would have to cross that road to reach Route
29 so there isn't any reason to not access 29 through that access road. I will add that when the lot goes to develop a site
plan will be required but as part of the site plan that access road could easily be ripped up, as it does not appear to truly
be platted along this property's frontage. Regardless of all that they are at a controlled intersection (light) so their access
will be there. Depending on any development that occurs, potentially improved access may be necessary.

Roger Ray just revised the plat, see the attached. In it he clarifies who has rights over the24'joint access easement.The
agreement for this easement only permits TMP 45-68A and TMP 45-68C1 to have access. It does not appear to truly
cross parcel Cl. See Roger's revised plat(attached).

I'm reviewing the above ref plat and just ran into a setback question that I am looking to you for an answer.
Side setbacks minimums in the HC zoning district when adjacent to another commercial district rely on the
building code for building separation. Section 4.20 actually states: If the abutting lot is zoned commercial, any
primary structure shall be constructed and separated in accordance with the current edition of the Building
Code. Please provide guidance on the minimum separation required in the current edition of the building code.

I received the comment letter and want to assure that this lot(parcel Cl)will be .rovided access to Rte 29. Did VDOT's
review cover this?Prior to County approval of this plat I need to assure that I have "evidence satisfactory to the agent that
the entrance of the principal means of access for each lot onto any existing public street complies with Virginia
Department of Transportation standards. VDOT approval is required prior to approval of the plat."
