This deed is exempt from taxation under Virginia Code§58.1-811(A)(3)and from the Circuit Court Clerk's fees under
Virginia Code§ 17.1-266.
DEED OF DEDICATION
THIS DEED OF DEDICATION is made this 5th day of January 2016 by and between
GWENDOLYN MAGRUDER, (hereinafter, the "Grantor"), and the COUNTY OF
ALBEMARLE,VIRGINIA, a political subdivision of the Commonwealth of Virginia (hereinafter,
the "Grantee"). •
WITNESSETH:
WHEREAS,the Grantor is the owner in fee simple of the real property located in Albemarle
County that is described below and hereinafter referred to as the "Property;"
WHEREAS, the Grantor offers to grant, convey and dedicate the Property to the County in
fee simple for public use, namely, a public right-of-way and other public purposes; and
'WHEREAS, the Grantee is willing to accept the Grantor's offer of dedication.
NOW,THEREFORE,in consideration of the mutual promises,the Grantor hereby grants,
conveys, and dedicates for public use to the Grantee, its successors and assigns, with GENERAL
WARRANTY and ENGLISH COVENANTS OF TITI.F, the following real property, to wit:
All that certain lot or parcel of land situated in the County of Albemarle, Virginia, located
on Hydraulic Road, containing 359 square feet, more or less, shown as "Proposed Right of
Way `Hereby Dedicated to Public Use" on a plat by H&B Surveying and Mapping, LLC,
dated December 7, 2015,titled "A Plat Showing a New Temporary Construction Easement
& Right of Way Dedication Across Tax Map 61 Parcel 41H, Located on Hydraulic Road,
Albemarle County,Virginia,"a copy of which is attached hereto and to be recorded with this
deed (the "Plat"). Reference is made to the plat for a more particular description of the
location of the described lands.

This Parcel is a portion of Albemarle County Parcel ID 06100-00-00-041HO, conveyed to
Herbert Magruder and Gwendolyn Magruder, as tenants by the entirety, with the right of
survivorship, by deed from Ethel Magruder and Richard Magruder, by deed dated April 16,
1965, recorded in the Clerk's Office of the Circuit Court of the County of Albemarle,
Virginia,in Deed Book 409,page 3,as corrected in Deed Book 414,page 306. Said Herbert
Magruder died on February 15, 1998 and by operation of law, title passed solely to
Gwendolyn Magruder.
The Grantor does further GRANT and CONVEY unto the Grantee those certain temporary
construction easements shown and labeled "New Temp. Constr. Esmt. For Driveway" and "New
Temp. Constr. Esmt." on the Plat. The conveyance of these temporary construction easements
includes the right of ingress and egress for the above-mentioned purpose. The temporary
construction easements shall expire upon completion of construction. The improvements
constructed shall be the property of the Grantee.
This conveyance is made subject to all easements, reservations, restrictions and conditions,
if any,contained in duly recorded deeds,plats and other instruments constituting constructive notice
in the chain of title to the above-described property which have not expired by a time limitation
contained therein or have otherwise not become ineffective.
The Grantee, acting by and through its County Executive, duly authorized by resolution
adopted by the Board of Supervisors of the County of Albemarle,Virginia, accepts the conveyance
of this property pursuant to Virginia Code § 15.2-1803, as evidenced by the County Executive's
signature hereto and the recordation of this Deed.
Consent of trustee and beneficiary to subordinate lien. By deed of trust dated December
10, 2007 and recorded December 14, 2007 in the Office of the Clerk of the Albemarle County
Circuit Court in Deed Book 3528, pages 121-128, the Grantor conveyed the subject Property to
Alison Detuncq,Trustee,to secure outstanding obligations owed to UVA Community Credit Union,
Inc. (also known as the University of Virginia Community Credit Union,Inc.),Beneficiary. Pursuant

to the authorization of the Beneficiary, as evidenced by its signature hereto,the Trustee joins in this
deed to subordinate the lien of such deed of trust to the conveyances herein.

APPOINTMENT OF SUBSTITUTE TRUSTEE
THIS APPOINTMENT OF SUBSTITUTE TRUSTEE, made this 25th day of May 2016,
by the UVA COMMUNITY CREDIT UNION, INC.,Lender,Grantee for the purpose of indexing,
and GWENDOLYN MAGRUDER, Borrower, Grantor for the purpose of indexing.
WHEREAS,by a certain deed of trust dated December 10,2007,and recorded in the Office
of the Clerk of the Circuit Court of the County of Albemarle, Virginia, in Deed Book 3528, Page
121, Gwendolyn Magruder conveyed to Alison DeTuncq, Trustee, the following described real
estate,to-wit:
ALL THAT certain piece or parcel of land,lying and being in Albemarle County,Virginia,
consisting of one (1) acre, more or less, and being more particularly described by metes
and bounds in an instrument recorded in the Clerk's Office of the Circuit Court of
Albemarle County,Virginia, in Deed Book 409,page 3.
BEING the same property conveyed to Herbert Magruder and Gwendolyn Magruder, as
tenants by the entirety, with the right of survivorship, by deed from Ethel Magruder and
Richard Magruder, by deed dated April 16, 1965, recorded in the Clerk's Office of the
Circuit Court of the County of Albemarle,Virginia,in Deed Book 409,page 3,re-recorded
in Deed Book 414, page 306. Said Herbert Magruder died on February 15, 1998 and by
operation of law,title passed solely to Gwendolyn Magruder.
Said conveyance being in trust to secure the payment,with interest,of Ten-Thousand Four-
Hundred Dollars($10,400.00)as evidenced by a deed of trust note made by Gwendolyn Magruder
• payable to the order of the UVA Community Credit Union, Inc.; and
WHEREAS, the said deed of trust allows for the substitution of the trustee; and
WHEREAS,the Lender desires to appoint a substitute trustee.
NOW,THEREFORE,the UVA Community Credit Union, Inc., as sole Lender and owner
of the aforesaid note, still unpaid, hereby appoints PAMELA L. TURNER, its Senior Vice
President and Chief Financial Officer, as successor in trust to Alison DeTuncq in accordance with
the provisions of Virginia Code § 55-59.
IN WITNESS WHEREOF,the UVA Community Credit Union,Inc.,acting by and through
Alison DeTuncq, its President, has caused this instrument to be signed and sealed on its behalf.
