Next image: contiguous wetlands (WP0201200062/sheet E-1). Please note WP0201200062 dashed
stream buffer does not coincide with GIS layer. Plat should match GIS stream buffer layer, should include
pond and continguous wetlands. It is not immediately clear whether Lots 59, 60, or 61 contain build sites.
Code 17-600.A. requires stream buffers to be "retained if present and established where they do not exist on
any lands subject to this chapter containing perennial streams, contiguous non -tidal wetlands, or both. The
stream buffer shall be no less than one hundred (100) feet wide on each side of any perennial stream and
contiguous nontidal wetlands, measured horizontally from the edge of the contiguous nontidal wetlands, or
the top of the streambank if no wetlands exist." Sheet E-1 shows existing contiguous non -tidal wetlands.
Article VI, Stream Buffers (17-602, -603, -604) lists tpes of structures, improvements, or activities that are
exempt, authorized, or that may be allowed in stream buffers. The lists do not include sole build sites for
lots created on or after February 11, 1998, as Lots 59-61 would be. Planning and Engineering will discuss
effect of ordinance, Ch. 17, on proposed Final Plat, whether development within the landward 50' feet
would be sufficient to create build sites, Lots 59-61. Applicant is encouraged to consider this, as well.

(attached), it was determined in the field with Glenn Brooks the point along the stream at which the stream

Thanks for the email. I believe the attorney has submitted the dedication information for the open space, I think it went
through JT, because he commented on the receipt of the plat a couple of weeks ago. I will follow-up with the attorney,
but I am pretty sure it did to him about 2 weeks ago, and it was submitted to the county attorney's office.
For comment#5,VDOT had a conflicting comment from planning. They did not want this 0.065 acres of property
adjacent to Mill Stone lane at the intersection of Jarman's gap road to be open space and create a spite strip between
TMP55-78A. In addition, my clients have just acquired this property and will close on it 8/4. We also have requested a
pre-app meeting on 8/1 to Francis to set up to discuss future development on that parcel and another
parcel. Therefore,this was left as future right of way dedication on the plat and within the chart (which did not
change). However, I could update the note and just call it reserved for future development, if that is easier.
I think that should take care of all the remaining comments on the plat. Let me know, and we will get this wrapped up
and resolved.

The County of Albemarle Planning Division will grant or recommend approval of the
Final Plat referenced above once the following comments have been addressed: [Each
comment is preceded by the applicable reference, which is to the Subdivision/Zoning
Ordinances unless otherwise specified.]
1. [14- 302(A)4] Private easements. If any improvements (greenway, etc) are
proposed within Lots 56- 61 or any stormwater facility is proposed within open
space to be dedicated to the County, please provide the appropriate easements
(or separate parcel in the case of SWM) and deed( s) as has been done with
previous phases.

2. [14- 302(A)9] Building sites on proposed lots. Demonstrate that Lot 58 has the
required building site.

3. [14- 302(A)I 1 ] Instrument creating the property for subdivision. It appears the

seems that, for some phases, the Real Estate office didn't properly note all of the

1. The source of title note/date has been updated.
The attorneys are working with the Real Estate department to correct the ownership of the
open space property.
3. The open space area between the right of way and the Mary Shifflett parcel has been re-labeled
as future right of way dedication. This parcel is in the process of being acquired and will be
developed by Creekside as an additional phase. Access will be needed from Mill Stone Drive.
4. The attorneys have submitted the documents to the County attorneys.

Dear Ms. Ray:
We have reviewed the final Plat for Creekside III, Phase IIID dated January 15, 2016 as submitted by
Commonwealth Land Surveying, LLC, and we offer the following comments:
1. Curve C4 and lot L4 as shown on the plat do not match what is shown on the approved road plan.
2. Culvert easement as shown on the road plans needs to be shown on the plat as well.
3. Drainage easement is required for structures DI -112 and DI -114.
4. Drainage easement is required for the ends of Culvert #2 to be installed across Mill Stone Lane.

Thank you for your comments dated December 9, 2015 on the above-referenced project. The
following are responses to the items raised in your letter and the engineering meeting:
Planning Comments:
1. No proposed greenway trails or stormwater management facilities are proposed on this plat
within this area.
2. A dimension has been added for Lot 58 to show that it has a buildable area deep enough for a
house.
3. The ownership information has been updated accordingly.
4. The open space labels have been updated,and the attorneys are working on the dedications of
any outstanding open spaces.
5. This area has been revised as open space.
6. The attorneys are putting together a deed for the open space dedication.
7. The tax map numbers have been updated.
8. All stream buffers have been correctly shown on the plat, per the approved preliminary plat.
9. The statement of consent to divide has been updated.
10. There is a remaining portion of the TMP55-78 property(east of TMP55-78C along Jarmans gap
road—see attached) This portion of the property is the remaining 2.14 acres. The applicant will

property, pulling the sidewalk into the r/w along the portion of the property that is in open
space. The transition started with the other plat, and has been carried through this plat, in
accordance with the approved construction plans.
3. The sight line at the intersection of Birchwood Hill Road and Mill Stone Lane is still within the
r/w(just barely—see attached exhibit). In addition,this intersection and these lots were platted
and recorded under a different plat, and the intersection is not part of this plat.
Engineering Comments
1. A road plan amendment has been submitted to revise the roadway in this location per the field
changes to avoid a conflict with an existing telephone pole and culvert under Jarman's Gap road.
The plans are under review for final approval.
2. This comment is acknowledged.

buffer is what is being used as the approved stream buffer for the project.

pond and continguous wetlands. It is not immediately clear whether Lots 59. 60, or 61 contain build sites.
Code 17-600.A. requires stream buffers to be "retained if present and established where they do not exist on
any lands subject to this chapter containing perennial streams, contiguous non -tidal wetlands, or both. The
stream buffer shall be no less than one hundred (100) feet wide on each side of any perennial stream and
contiguous nontidal wetlands, measured horizontally from the edge of the contiguous nontidal wetlands, or
the top of the streambank if no wetlands exist." Sheet E-1 shows existing contiguous non -tidal wetlands.
Article VI, Stream Buffers (17-602, -603, -604) lists tpes of structures, improvements, or activities that are
exempt, authorized, or that may be allowed in stream buffers. The lists do not include sole build sites for
lots created on or after February 11, 1998, as Lots 59-61 would be. Planning and Engineering will discuss
effect of ordinance, Ch. 17, on proposed Final Plat, whether development within the landward 50' feet
would be sufficient to create build sites, Lots 59-61. Applicant is encouraged to consider this, as well.

As you know,the last phase of Creekside is under review. I have tried several times to get a copy of the recorded
declaration, but haven't received it. As with previous times this has happened, I just wanted to let you all know that
until the supplemental declaration for the previous phase is recorded, that phase is technically in violation of the
subdivision ordinance. If the declaration doesn't get recorded soon, and an official subdivision violation notice is issued,
no further approvals for the project can be granted. So, if you want to get the next phase approved in a timely manner,
you may want to get that declaration recorded and provide a copy for the file as soon as you can.

4. [14- 302(A)l4] Land to be dedicated in fee or reserved. Label the adjacent open space parcels (from
previous phases) with the appropriate TMP number. It also appears that many of the open space parcels
from previous phases have not been properly conveyed to the County; all open space approved to support
the overall density in Creekside must be conveyed prior to approval of this plat.
5. [14- 302(A)14] Land to be dedicated in fee or reserved. The area noted as "Area Reserved for Future Right
of Way Dedication" was shown as open space to be dedicated to the County on the plat that was reviewed
by the Board of Supervisors for approval of the open space; revise the plat to show this area as dedicated
open space.
6. [14- 302(A)14] Land to be dedicated in fee or reserved. For any land intended to be dedicated to the
County, provide a Deed of Dedication for review and approval by the County Attorney's Office. This deed
must be recorded with the plat.
7. [14- 303(B)6] Tax map and parcel number. The TMP for this parcel is 05500- 00 -00- 07800; revise all TMP
references to this number.
8. [14- 303(B)l0] Stream buffers. Show all stream buffers on the property.
9. [14- 303(A)] Statement of consent to division. Revise the TMP reference in the consent statement.
10. [14- 303(D)] Acreage of lots. The acreage of TMP 55 -78 is 7.24 acres and Phase HID is noted as being 5.10
acres; clarify the acreage and location of the residue.
11. [14- 303(H &I)] Monuments, Bearing and distance ties. Provide the location and material of all permanent
reference monuments. At a minimum, a definite bearing and distance tie between not less than two
permanent reference monuments must be provided.
12. [14- 303(0)] Signature panels. Revise the signature line to indicate the new owner.
13. [14 -311] Infrastructure improvement plans, computations and documents. All Road Plan and WPO related
improvements for Phase HID must be built or bonded prior to approval of this plat.
14. [14 -317] Instrument evidencing maintenance. A maintenance agreement for the proposed landscape and
sidewalk easements shall be submitted for review and approval; as with previous phases, a supplemental
declaration should be sufficient. This supplemental declaration must be recorded with the plat.
15. [Comment] This plat cannot be approved until VDOT, ACSA, Inspections, Fire Rescue and Engineering
complete their reviews and grant their approval. E911 has reviewed the plat and has no objection.
16. [Comment] The Deed of Dedication must be reviewed by the County Attorney's Office. Once the plat is
deemed approvable, the Deed must be modified with the latest revision date and resubmitted for County
Executive signature. The supplemental declaration must also be reviewed by the County Attorney's Office,
but no County signature is required. The approved plat cannot be released until all associated documents
are approved and signed.
