I will need to run this by the County Attorney's office.
This piecemeal approach to all of these deeds is problematic and will probably cause some delay in review.
Especially since I already sent on the HOA documents to Greg for review, and now it looks like some language
needs to be added. I know you are anxious to get your approvals, but the best approach here would be to
submit the deeds and/or HOA docs all together with a plat highlighting the easements and the HOA docs
highlighting the relevant sections, so that I can send it up to the attorney's for review, and so it is clear to Greg
the portions he needs to focus on.

Megan,
It looks like the landscape/sidewalk easement language is not currently in the HOA declaration. I'd
like to proposed (with Stanley Martin's approval) to insert the following language into Article X of the
declaration:
Section 11. Sidewalk and Landscaping Easements. The Association shall have a nine (9) foot
easement, within the area depicted on the Plat as "9' Sidewalk&Landscape Easement", for the
purpose of installing landscaping and to install, maintain and repair all sidewalks located on the
Property. The Association shall have a landscape easement abutting Crozet Avenue, within the area
depicted on the Plat as "20' Landscape Easement", for the purpose of installing and maintaining all
landscape features.
Please let me know if this is acceptable to you.

2. The acsa easement was reviewed and approved--I'll get that to you. The VllOT easement has been w them
for 2 months. I followed up on it yesterday.
3. For the landscape and sidewalks, typically the HOA declaration has language that states somethings like "we
create all the easements shown on the attached play," so I'll confirm that as well.

not the County.

The Planner for the Planning Services Division of the Albemarle County Department Community
Development will recommend approve the plan referred to above when the following items
have been satisfactorily addressed. (The following comments are those that have been
identified at this time. Additional comments or conditions may be added or eliminated based
on further review.) [Each comment is preceded by the applicable reference to the Albemarle
County Code.]
Requirements•
1. [14-302(A)(4)] The notation for the landscape easement is only shown along Watervale
Drive, add a notation for the "9' sidewalk and landscape easement" along Oxbow Drive
for clarification.
2. [14-302(A)(5)] The roads only state "hereby dedicated", add "to public use" for the
dedication.
3. [14-302(A)(14)] Note the open space that is being dedicated for public use on the plat.
Also, break the open space acreage note into two, one that is being dedicated, and the
other.
4. [14-302(B)(8)] The setbacks shown and noted are incorrect. See Section 4.19 for latest
setback information for R-1 and revise plat to reflect correct setbacks. This subdivision
would be considered non -infill.
5. [14-302(8)(10)] Show the stream buffers and flood plain on the plat.
6. [Section 2.2.3 Open Space; 4.7 Open Space Requirements] Cluster developments (Lots
less than 30,OOOsf) require a minimum of 25% open space. Not more than eighty
percent of the open space can be located within the flood plain. If open space is not
provided, lots must be a minimum of 30,OOOsf and have a minimum frontage of 100
feet. The stream buffers and flood plain are not shown on the plat and this information
needs to be verified. Provide the area and the calculations, if not on the plat, on an
exhibit for verification that the open space proposed meets this requirement.

have asked engineering if they had any comments, and John said he will get something today. I still have not

We have reviewed the Final Plats for Chesterfield Landing, as submitted by Roudabush, Gale &
Associates, dated January 21, 2016 and offer the following comments:
Sheet V6:
1. the 20 foot public storm drainage easements (1,96 & L60) should be labelled
2. the 20 foot private storm drainage easement shown on the following lots should be public
drainage easements:
a. Lot 17, Lot 8, Lot 18, Lot 19, Lot 23, Lot 2, Lot 25 and Lot 1
3. Please label sight distance easements on Oxbow Drive

Re: Chesterfield Landing
Dear Mr. Shimp:
The plan, entitled "Final Construction Plans for Chesterfield Landing" dated
June 18, 2015, last revised, November 3, 2015, is hereby approved for
construction. One set of the approved plan is enclosed for your records. Any
previously approved plans are voided with this approval. This approval is for basic
compliance with the General Water & Sewer Construction Specifications of the
Albemarle County Service Authority (ACSA) and does not relieve the contractor
from responsibility for his work as it relates to the plan and specifications.
The ACSA requires that a copy of the approved construction plan be on the
job site. The contractor is responsible for marking up a copy of the approved
construction plan showing as-built information and providing this data to your client
at the completion of utility installation. The final as-built plan shall be submitted in a
format of one paper copy and one mylar copy.
A preconstruction conference shall be scheduled with the project manager to
ensure coordination and answer any questions. This will be a short meeting to
review the project, materials, test methods and schedule, in order to expedite
construction. Please have the proper party call me at 977-4511 to schedule the
meeting.
This approval is valid for a period of 18 months from this date. If
construction is not in progress at the end of this time period, the approval shall be
void.
The contractor shall be responsible to comply with the no-lead regulation
regarding brass fittings that is effective on January 4, 2014 (Senate Bill 3874 which
amends the Safe Drinking Water Act).
