Ellie—B2/ B4 are already subjected to the Declaration... The documents you are referencing are already recorded
(except for B2/B4 plat)and Greg has already reviewed them (when B1 was recorded). I am not sure if we can change
anything at this point...
The purpose with sharing the information is to address the comment that the B2/B4 parcel needed to be subjected to
the Declaration. We have provided proof that the recorded Supplemental Declaration covers the area.

Hi Greg,
I am currently reviewing SUB201600057 Whittington Phase B2 & B4 final plat. I requested that the application submit a
supplemental declaration (as was done for the previous phase) to address maintenance of open space, trails, pedestrian
bridges, facilities within open space(picnic shelter), temporary turnaround, etc. The amenities are tied to
ZMA200600011. The applicant claims the previously recorded declaration (attached) subjects the current phases to the
original declaration (see below), so no further review should be required. Can you let me know if this is sufficient or if
they need to submit something additional? I have also attached the plat currently under review and the approved plat
for Phase 131 (referenced below).
If you need paper copies, let me know and I'll send them up.

The County of Albemarle Planning Division will approve the plat referenced above once the following comments
have been satisfactorily addressed (The following comments are those that have been identified at this time.
Additional comments or conditions may be added or eliminated based on further review.): [Each comment is
preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise
specified.]
Conditions of Preliminary Plat Approval (from approval letter dated 9/3/14):
1. A plat meeting all the requirements for final subdivision plats per the subdivision ordinance.

2. [14-302(A)3] Existing or platted streets. Provide the right-of-way width of State Route 631.

4. [14-302(A)9] Building sites on proposed lots. Building sites are required to be the size of the anticipated
dwelling footprint plus the area of setbacks/yards. While critical slope disturbance was addressed in the
proffers for ZMA200600011, several of the proposed lots are significantly impacted by stream buffer (lots 5,
13, 23, 27, 28, 29 & 76 in particular). Adequate building sites must be provided outside of the stream buffer.
Provide a "typical" minimum building site diagram with the resultant required square footage (as indicated
above) and show that lots limited by stream buffer in fact provide this minimum required building site.

5. [14-302(A)11] Instrument creating property proposed for subdivision. Provide the most recent instrument in
addition to the information shown on sheet 2.

8. [14-302(B)10] Stream buffers. Add the following note: "The stream buffers shown hereon shall be managed
in accordance with the Albemarle County Water Protection Ordinance."

9. [ZMA200600011 Proffer 1] Prior to Final Plat approval, Phase B must be added to the Covenants and
Restrictions of the homeowner's association (assuming CCRs were created for Phase A). This document
should include maintenance responsibility for all open space and other privately owned improvements, and
must be reviewed and approved by the County Attorney's Office.

10. [ZMA200600011 Proffer 2] Each lot is required to be a minimum of 40,000 square feet. Provide the

meets all requirements listed in Proffer 4 for Engineering review and approval. This review may result in a
reduction of the number of approvable lots.

12. [ZMA200600011 Proffer 7] The Application Plan approved with ZMA200600011 shows a picnic shelter
within Open Space J and two trails leading from Open Space J and connecting to the larger trail system
within the subdivision. One of the trails goes through Open Space H connecting to the trail system in Open
Space F, and the other goes between lots on Street B and Kendra Street to connect to the trail system in
Open Space E. These amenities should be provided as shown on the Application Plan; show the trail
system as indicated and note that the picnic shelter will be provided. Prior to Final Plat approval, a
performance bond will likely be required for the picnic shelter.

13. [ZMA200600011 Proffer 8] The 25' screening and landscaping easement must be shown and labeled on
the plat. A landscaping plan that meets current regulations for screening must be provided, either with the
road or WPO plans or as a separate submittal. Maintenance and responsibility of the screening within the
easement should be addressed in the Covenants and Restrictions mentioned above. A note alerting
affected owners to this easement restriction on their property shall be stated on the Final Plat.

the plan itself has not been scanned into RMS. It is considered a working/construction document and isn't archived in
the same way as plats. If you would like to see the plans,you can request that they be scanned and a link provided,or

Greetings Ellie,
I am a resident of Mosby Mountain and member of their Board of Directors. At our meeting last night there were
several questions raised about the Whittington subdivision and its impact on the Mosby Mountain community. Below
are the two primary questions that came up.
1. What is the plan for the Whittington subdivision where it closely approaches Singleton Lane? They have clear
cut all the way down to Singleton Lane and made at least one underground connection. What else is planned
for that area and is there a plan of the development available?
2. There had been talk about a fire road connecting to Ridgetop. Is that still planned and if so,what kind of road is
planned? Will it be a paved road with full access or something along the lines of a gravel road with barriers?
Are there any approved or preliminary plans you can point me to regarding Whittington?

I am currently reviewing SUB201600057 Whittington Phase B2 & B4 final plat. I requested that the application submit a
supplemental declaration (as was done for the previous phase)to address maintenance of open space,trails, pedestrian
bridges, facilities within open space(picnic shelter),temporary turnaround, etc. The amenities are tied to
ZMA200600011. The applicant claims the previously recorded declaration (attached) subjects the current phases to the
original declaration (see below), so no further review should be required. Can you let me know if this is sufficient or if
they need to submit something additional? I have also attached the plat currently under review and the approved plat
for Phase B1 (referenced below).
If you need paper copies, let me know and I'll send them up.

All,
We were ahead of the game here. To avoid continued back and forth with our lender, when we put B1 to
record, we subjected the entire balance of the neighborhoods to the Declaration. This avoided going back
and forth with lender for approval—especially if we needed something in a pinch.
Pursuant to the attached supplemental declaration, all of Residue A and Residue B on the B1 plat were
subjected. B2 and B4 come out of Residue B, so nothing further is required.
Please let me know of any questions. Declaration is attached as recorded.

The County of Albemarle Planning Division will approve the plat referenced above once the following comments
have been satisfactorily addressed (The following comments are those that have been identified at this time.
Additional comments or conditions may be added or eliminated based on further review.): [Each comment is
preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise
specified.]
Conditions of Preliminary Plat Approval (from approval letter dated 9/3/14):
1. A plat meeting all the requirements for final subdivision plats per the subdivision ordinance.
Final: See Final Plat comments below.
2. [14-302(A)3] Existing or platted streets. Provide the right-of-way width of State Route 631.
Final: Comment addressed.
3. [14-302(A)4&5] Private & public easements. Label all new easements as `proposed'.
Final: Comment addressed.
4. [14-302(A)9] Building sites on proposed lots. Building sites are required to be the size of the anticipated
dwelling footprint plus the area of setbacks/yards. While critical slope disturbance was addressed in the
proffers for ZMA200600011, several of the proposed lots are significantly impacted by stream buffer (lots 5,
13, 23, 27, 28, 29 & 76 in particular). Adequate building sites must be provided outside of the stream buffer.
Provide a "typical" minimum building site diagram with the resultant required square footage (as indicated
above) and show that lots limited by stream buffer in fact provide this minimum required building site.

5. [14-302(A)11] Instrument creating property proposed for subdivision. Provide the most recent instrument in
addition to the information shown on sheet 2.

6. [14-302(B)5] Zoning classification. Add Entrance Corridor (EC) to the zoning note.

7. [14-302(8)8 & 18-19.9.1] Setbacks. The plat indicates that lots 30-36 will have a 35' rear setback as they
are adjacent to RA zoning. Lot 87 also adjoins RA property; please add lot 87 to the list of lots that will have
a 35' rear setback.

8. [14-302(B)10] Stream buffers. Add the following note: "The stream buffers shown hereon shall be managed
in accordance with the Albemarle County Water Protection Ordinance."

9. [ZMA200600011 Proffer 1] Prior to Final Plat approval, Phase B must be added to the Covenants and
Restrictions of the homeowner's association (assuming CCRs were created for Phase A). This document
should include maintenance responsibility for all open space and other privately owned improvements, and
must be reviewed and approved by the County Attorney's Office.
Final: Comment not addressed. The lots in Phases B2 and B4 must be added to the Covenants and
Restrictions of the homeowner's association; please submit a supplemental declaration covering
these phases for review and approval by the County Attorney's Office.
10. [ZMA200600011 Proffer 2] Each lot is required to be a minimum of 40,000 square feet. Provide the
square footage calculations for each lot rather than the acreages.

11. [ZMA200600011 Proffer 4] Prior to Final Plat approval, an overlot grading plan must be submitted that
meets all requirements listed in Proffer 4 for Engineering review and approval. This review may result in a
reduction of the number of approvable lots.

12. [ZMA200600011 Proffer 7] The Application Plan approved with ZMA200600011 shows a picnic shelter
within Open Space J and two trails leading from Open Space J and connecting to the larger trail system
within the subdivision. One of the trails goes through Open Space H connecting to the trail system in Open
Space F, and the other goes between lots on Street B and Kendra Street to connect to the trail system in
Open Space E. These amenities should be provided as shown on the Application Plan; show the trail
system as indicated and note that the picnic shelter will be provided. Prior to Final Plat approval, a
performance bond will likely be required for the picnic shelter.
Final: Comment addressed; however, verification of posted bond for the current phases is required.
13. [ZMA200600011 Proffer 8] The 25' screening and landscaping easement must be shown and labeled on
the plat. A landscaping plan that meets current regulations for screening must be provided, either with the
road or WPO plans or as a separate submittal. Maintenance and responsibility of the screening within the
easement should be addressed in the Covenants and Restrictions mentioned above. A note alerting
affected owners to this easement restriction on their property shall be stated on the Final Plat.
Final: Comment not fully addressed. The Covenants and Restrictions should include maintenance
of the required landscaping shown on the road plans. Please also include a note alerting affected
owners to this easement restriction as required by the proffer.
14. [ZMA200600011 Proffer 9] Trail locations and construction details should be provided on the Road and/or
WPO Plans.

15. [ZMA200600011 Application Plan] The lot numbers within the subdivision do not match the lot numbering
provided on the application plan. To eliminate confusion, please revise the lot numbers on this plat to match
the application plan.

16. [Comment] Road Plans and WPO application must be approved, all required improvements must be built
or bonded, and all required Deeds and Declarations must be reviewed and approved prior to Final Plat
approval.
Final: Comment not fully addressed. Verification that all subdivision and WPO bonds for the
current phases have been posted is required.
Final Plat Comments:
17. [14-303(H)] Monuments. Provide the location and material of all permanent reference monuments.
Monuments found or installed prior to plat recordation may be referred to if they are permanent and

undisturbed. If any monument required by this chapter will be installed after recordation of the final plat, the
certification of the professional engineer or land surveyor shall so note.
18. [14-303(1)] Bearing and distance ties. Provide a definite bearing and distance tie between not less than two
(2) permanent monuments on the exterior boundary of the property and further tie to existing street
intersection where possible and reasonably convenient.
19. [14-303(M)] Street names. Refer to E911 comments for guidance on street names.
20. [Comment] This plat cannot be approved until VDOT and ACSA complete their reviews and grant their
approval; comments will be forwarded upon receipt. Fire Rescue and Inspections have completed their
reviews and have no objection. E911 and Engineering comments have been provided.

Yes, I see where the email says B1, but the spreadsheet includes 8 bridges(it seems like that covers the whole
development, not just B1),the scenic overlook(which is in B3) and over 12,000 linear feet of trail. To me, it seems like
