Subject: TMP 76-24,Granger Pre-Application Meeting Date: 6/13/2016
The following are County staff comments regarding the above noted pre-application meeting.This meeting may
satisfy the requirements for the mandatory pre-application.The purpose of for the meeting is summarized
below:
The purposes for a pre-application meeting are to:(i)provide the applicant and the county a common
understanding of the proposed project;(ii)inform the applicant about the proposed project's consistency with the
comprehensive plan, other relevant policies, and county regulations;(iii)broadly identify the planning,zoning and
other issues raised by the application that need to be addressed by the applicant;(iv)inform the applicant about
the applicable procedure;and(v)allow the director to identify the information the applicant must submit with the
application, including the supplemental information delineated in subsection(c). Receiving the relevant
supplemental information will allow the application to be comprehensively and efficiently reviewed
(i)Common understanding of the proposed project
• The applicant is proposing to rezone TMP 76-24 to allow for a mixed use development consisting of
attached and detached units and some office uses with a proposed density of up to 6 units per acre.
• The property submitted two special use permits for the stream crossings in 2010(SP201000044 and
SP201000045)which have since been withdrawn.Those requests also included a worksession with the
Planning Commission at that time. Comments and recommendations from those applications should be
reviewed.
(ii)Consistency with the Comprehensive Plan
• The majority of the property is designated Neighborhood Density Residential in the Southern and
Western Neighborhoods Master Plan which recommends a density between 3 and 6 units per acre.
Additionally,this property is shown with a Center designation.A mixture of neighborhood scale uses
should be provided within the development in accordance with the recommendations in the Master Plan.
• Large portions of the property are designated as Greenspace and should be preserved.
• The Plan shows a connector road through the property,the Sunset Ave- Fontaine Ave Connector.This
road should be shown on the submitted plan in the general location as shown within the Master Plan.This
road will require a special use permit for fill in the floodplain.
(iii)Broadly identify the planning,zoning or other issues raised by the application that need to be addressed by
the applicant. Important items for consideration with your SP application are as follows:

Planning
• The developable acreage on the site should correspond to the area shown for Neighborhood Density
Residential in the Master Plan.Areas of Greenspace shown in the Plan should be subtracted from the
developable acreage.
• As stated above, a special use permit will be required for fill in the floodplain for any stream crossing.The
Sunset/Fontaine Ave connector road will require a stream crossing.
• The Sunset/Fontaine Ave connector road should meet the standards outline in the Master Plan on page
61 and be in the general location shown on the plan.
• Depending on the size of the development, a bridge over the railroad may be needed to provide
connectivity,as well as for Fire and Rescue purposes.
• The application plan should show proposed amenities such as parks and open space.
• Private lots should be kept out of preserved slopes.
• A traffic study may be required. Not enough information was submitted during the pre-application
meeting to make the determination at this time.This may result in additional fees and an extended
review before public hearing due to multiple resubmissions of the proposed rezoning.
VDOT
• A second connection will be required for the public roads in the development.
• Provide entrance analysis/turn lane warrants for entrance(s).
Engineering
• Not enough information was submitted during the pre-application meeting to make a determination that
any additional information should be provided.This may result in additional fees due to multiple
resubmissions of the proposed rezoning.
ACSA
• This property is within the water and sewer jurisdictional area.There is an existing 20" RWSA water main
along Sunset Ave. Ext. Permission would be required from RWSA to tap this main.This main will
adequately serve development area#1. It appears that development area#2 would need to be served by
boring the water main under the creek. Or by extending the main, north of the property, by boring under
the railroad tracks.
• There is an existing 8"ACSA sewer line along Sunset Ave Ext.,an existing 12"ACSA sewer line on the north
side of the creek, and an existing 24" RWSA sewer line along the eastern edge of the property.
Development of this property will require RWSA sewer flow certification.
(iv)Applicable procedures
• Community Meeting:
o The applicant is required by ordinance to undertake a community meeting process within 30 days
of the submittal as part of the review of the ZMA request.
o Please coordinate with staff,the PC, and BOS member the community meeting location and time.
Staff will attend the meeting to answer questions, but the applicant is responsible for facilitating
the discussion.
o Notification to all owners within a1/4 mile radius should be sent for the community meeting.The
County is no longer requiring these notices to be certified mail, however a copy should be
provided to the County with the list of recipients. Since Staff is unsure of the HOA

participation/notification for nearby neighborhoods, notification should be to all the property
owners.
o Samuel Miller District Board and Planning Commission members should also be notified via email
of the community meeting.
o Since the property is adjacent to the City of Charlottesville, coordination with the City Planner will
need to occur for notification the city property owners.
(v)Identify the information the applicant must submit with the application,including the supplemental
information.
• A ZMA application along with the application fee($3763 for ZMA of more than 50 acres), plus the cost of
public notice requirements when the application is being processed.
• A concept plan that is consistent with Zoning Ordinance requirements for Zoning Map Amendments (see
attached checklists).
• A narrative addressing elements listed on the ZMA application.
• The latest recorded plat(s).
• The completed ZMA checklist(attached). Make sure all necessary boxes are checked and you have
provided the information noted on the application by that checkbox.
• A recorded plat of the property with the Deed Book&Page#.
• Please note that all real estate taxes, nuisance charges,stormwater management utility fees,and any
other charges that constitute a lien on the subject property,which are owed to the County of Albemarle
must be paid prior to accepting the application.
• The appropriate signature of the owner,the owner's agent,or a contract purchaser. If either the owner's
agent or a contract purchaser signs the application then include the owner's written consent that the
agent or contract purchaser may file the application on their behalf.See below for applicable signature
requirements for ownership not in the name on an individual person or persons.
o Limited liability companies ("LLCs")
o Authorized signatories:The authorized signatories are: (1) if the LLC is not a manager-managed LLC,
any member; (2) if the LLC is a manager-managed LLC,the manager or any member unless the articles
of organization limit the members' authority(Virginia Code§ 13.1-1021.1(A));or(3) unless otherwise
provided in the articles of organization or an operating agreement,the members have the power and
authority to delegate to one or more other persons, including agents,officers and employees of a
member or manager of the LLC, members' rights and powers to manage and control the business
affairs of the LLC, and to delegate by a management agreement or other agreement with,or
otherwise to, other persons(Virginia Code§ 13.1-1022(D)).
o Supporting documentation:The supporting documentation is the articles of organization (Virginia
Code§ 13.1-1021.1(A)and when the power is delegated to someone other than a manager or a
member,also the operating agreement and, if applicable, any other agreement(Virginia Code§ 13.1-
1022(D)).
