NOTE TO CLERK: THIS DEED IS EXEMPT FROM TAXATION PURSUANT TO THE PROVISIONS OF VIRGINI.4 CODE §§ 58.1-811(Ax3} DEED OF DEDICATION THIS DEED OF DEDICATION is made this 310 day of 65Y2016, by and between BONDSTONE VENTURES, LLC, a Virginia limited liability company that is successor by virtue of change of name and by conversion of entity to Robert Hauser Homes, Inc. (hereinafter "Grantor"), and the COUNTY OF ALBEMARLE, VIRGINiIA, a political subdivision of the Commonwealth of Virginia (hereinafter "Grantee"), the address of which is 401 McIntire Road, Charlottesville, Virginia 22902. WITNESSETH: WHEREAS, the Grantor is the owner in fee simple of the real property located in Albemarle County that is described below and hereinafter referred to as the "Property"; WHEREAS, the Grantor offered to grant, convey, and dedicate the Property to the County in fee simple for public use as an emergency access easement; and WHEREAS, the Grantee is willing to accept the Grantor's offer of dedication. NOW, THEREFORE, in consideration of the mutual promises, and subject to the condition that the dedication over a portion of the Property will be released as hereafter provided, the Grantor grants, conveys, and dedicates for public use as an emergency access easement to the Grantee, its successors and assigns, all of the portion of the following real property that is owned by the Grantor (being the western 25 feet): That certain 50-foot wide strip of land, shown and designated as "50' Emergency Access Ease." on the plat entitled "Plat Showing Boundary Line Adjustment and Plat of Correction Phase 3A Rivercrest Dunlora Albemarle County, Virginia," made by B. Aubrey Huffman and Associates, Ltd., dated January 18, 2000, a copy of which has been previously recorded Book. 4830 Page: 20 FileNumber: 2016-00011993 Seq:2 Page 3 of 5 in the Clerk's Office of the Circuit Court of Albemarle County, Virginia, attached to a Certificate of Corrected Plat recorded in Deed Book 2015, page 3 (the "Plat'). Reference is made to the Plat for a more particular description of the location of the emergency access easement. By accepting this Deed of Dedication and subject to approval by the Albemarle County Board of Supervisors or the Albemarle County Subdivision Agent, as applicable, the Grantee acknowledges and agrees to vacate and release any portion of the Property that is no longer needed for the emergency access easement upon acceptance by the County of a dedication of a different alignment of this emergency access easement. This conveyance is made expressly subject to all restrictions, conditions, rights -of -way and easements, if any, contained in duly recorded deeds, plats and other instruments constituting constructive notice in the chain of title to the Property conveyed hereby, insofar as the same affect the Property, which have not expired by a time limitation contained therein or have not otherwise become ineffective. The Grantee, acting by and through its County Executive, duly authorized by resolution adopted by the Board of Supervisors of the County of Albemarle, Virginia, accepts the conveyance of this property pursuant to Virginia Code § 15.2-1803, as evidenced by the County Executive's signature hereto and the recordation of this Deed.
