The County of Albemarle Planning Division will recommend approval of the plan referenced above once the
following comments have been satisfactorily addressed (The following comments are those that have been identified
at this time. Additional comments or conditions may be added or eliminated based on further review.): [Each
comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise
specified.]
[32.7.2.1, 32.5.1(c), 32.5.2(1), 32.5.2(m)] Vehicular access to the site. The access road, access easement, and
grading outside of the access easement are proposed on TMP 32E-2, which is owned by Ray Beard. Prior to final
site plan approval the easements required to construct the road shall be obtained from Mr. Beard and platted.
Easement plats shall be reviewed by the County and then recorded in the Clerk's Office. The DB page
information of this action shall be provided on the final site plan. Rev 1: Comment not completely addressed,
as the easement plat has not been approved/recorded vet. Comments on the easement plat were sent to the
applicant on Dec 12, 2016, pending a resubmittal.
2. [32.7.2.1, 4.6.1, ZMA95-20, ZMA79-32] Prior to final site plan approval the road plan (SUB2016-8) for the new
section of St. Ives Road shall be approved and built/or bonded. Rev 1: Comment not completely addressed, the
road plan appears to be nearing an end as most approvals have been received; however, it is suggested that
the approval of the road plan be held off till the easement plat across Ray Beard's property be approved
(as this is the document which locks down the entrance location as nronosed). Comments on the easement
plat were sent to the applicant on Dec 12, 2016, pending a resubmittal.
[32.7.2.1] Vehicular access to site. The entrance onto the public street shall be designed and constructed as
required by the standards of the Virginia Department of Transportation. VDOT approval of the entrance to the
site shall be required prior to final site plan approval. Rev 1: The road plan for phase 4 which includes the
portion of St/. Ives fronting the rec area is not approved/bonded vet - this road plan needs to be finished up
be it is needed to provide access to the recreational area. Notably VDOT has provided an approval letter
for the entrance as currently designed.
4. [Comment] The WPO application must be approved prior to final site plan approval. Rev 1: comment still
relevant. Per conversations with Engineering the plan's approval awaits the easement plats being
approved and recorded and then bonding of the WPO plan. For complete list of required WPO plan
changes see WPO plan comments from Engineering.
5. [ZMA2005-09 Proffer #4] The primary recreational area shall be built or bonded for its construction prior to
final plat approval ofphase 4. This recreational area shall be built prior to completion of Phase 4...
Rev 1: comment still relevant. The primary recreational area can be bonded once the final site plan is
signed/approved by the County. Currently there are numerous large items still outstanding (see below)
prior to final site plan approval.
(1) The easement plat into the site across Ray Beard's property is not vet approved/recorded vet — this is
needed prior to final site plan approval otherwise they don't have access to the recreational area over
Ray's property
(2) The road plan for phase 4 which includes the portion of St. Ives fronting the rec area is not
approved bonded yet - this road plan needs to be finished up 1St be it is needed to provide access to the
recreational area.
(3) The subdivision plat for the recreational area (subdividing it off of the rest of the parcel) is not yet
approved — this matters be this plat also records required SWM easements required for the final site plan.
This plat also dedicated the land to the HOA and divides it so it's it's own parcel.
(4) WPO is not vet approved and requires the two plats mentioned above and bonding prior to it being
approved.
I also want to make sure you understand that the primary recreational area must be built before the 26nd
certificate of occupancy (which is 50% of the units in phase 4 subdivision plat) [requirement based on Sec.
4161.
Staff has provided references to provisions of Chapter 18 of the Code of the County of Albemarle. The Code is kept up to
date by the County Attorney's office. The Code may found on the County Attorney's website which may be found under
"Departments and Services" at Albemarle.org.
In accord with the provisions of Section 32.4.3.5 of Chapter 18 of the Code if the developer fails to submit
a revised final site plan to address all of the requirements within six (6) months after the date of this letter
the application shall be deemed to have been voluntarily withdrawn by the developer. If you have any

Section, has reviewed the above referenced plan as submitted by Collins Engineering, most
recently revised 6 October 2016, and find it to be generally acceptable.
This office will sign the plans upon review of the appropriate signed and sealed approval copies.
Please allow for this office to obtain two signature copies.
A VDOT Land Use Permit will be required prior to any work within the right-of-way. The
owner/developer must contact the Charlottesville Residency Transportation and Land Use
Section at (434) 422-9399 for information pertaining to this process. If further information is

Conditions of initial site plan approval (June 7, 2016)
[32.7.2.1, 32.5.1(c), 32.5.2(1), 32.5.2(m)] Vehicular access to the .site. The access road, access easement, and
grading outside of the access easement are proposed on TMP 32E-2, which is owned by Ray Beard. Prior to final
site plan approval the easements required to construct the road shall be obtained from Mr. Beard and platted.
Easement plats shall be reviewed by the County and then recorded in the Clerk's Office. The DB page
information of this action shall be provided on the final site plan. Final: Comment not addressed. Please work
with Mr. Beard to assure all proposed improvements and grading on his property are acceptable to him.
Also, on the site plan provide deed book page reference information for a temporary easement which
allows grading on his property outside of the 50' access easement. Also, it appears the entrance to the site
requires sight distance easements on his property as well. Notably a draft easement plat was provided in
the final site plan package for informational purposes; however, an application and review fee was not
submitted. Please officially submit this easement plat for County review/approval, and if applicable assure
the above mentioned items are depicted on that plat.
Additional questions: on the plat why is the access easement labeled as "New 50'public access easement—
hereby dedicated to public use "? Is the access road/travelwa sig the park proposed to be a public roadway
accepted and maintained by VDOT? During a recent phone call with VDOT (Justin Deel) he stated that they did
not review this roadway as a public road and would not accept the roadway in its current design. If the applicant's
intention is to continue with a public road serving the park, please clearly label the roadway as such and discuss
this with VDOT prior to a resubmittal. Otherwise on the plat relabel the access easement as "New 50' Access
Easement to Serve Briarwood's Prima7y Recreation Area" and revise the site plan to appropriately label it as an
access road or travelway.
5. [32.7.2.1, 4.6.1, ZMA95-20, ZMA79-32] Prior to final site plan approval the road plan (SUB2016-8) for the new
section of St. Ives Road shall be approved and built/or bonded. Final: comment not addressed.

10. [32.5.2(n), 4.16.2.11 Existing and proposed improvements. Due to the park's proximity to the river, for the safety
of park users, provide fencing along the new 100 year floodplain. Chain link or metal bar fencing is appropriate
(provided ARB does not object). Depict, label, dimension, and provide a detail for the proposed fencing.
Final: comment not addressed. At a minimum provide fencing (chain link or metal bar fencing) along the
southern limits of clearing and grading.
12. [32.5.2(a)] Gene7-al information. On the final site plan assure that the zoning of TMP 32E-2 includes PRD,
ZMA1995-20 w/ proffers. Final: comment not addressed.
13. [32.6.20)] Landscape plan. A landscape plan that complies with section 32.7.9 is required with the final site plan.
Final: comment still relevant. See additional landscape comments below.
13a) [32.7.9.6(b)] Landscaping within parking area. The amount of required parking lot landscaping is 3 trees.
Revise the plant legend, currently it lists 2 required. Also, of the 5 London Plane trees listed on the site plan, only
4 were found. Revise.
13b) [32.6.20) & 32.7.9.4(b)] Depict and label the location of the tree protection fencing. Provide a cutsheet for
the type of tree protective fencing being used. Also, have the property owner sign the tree conservation plan.
13c) [32.7.9.7(a)3] Screening. The recreational facility shall be screened from adjacent residential lots, specifically
the abutting lots to the north and the lots to the east. It appears that you intend to utilize existing vegetation to meet the
screening requirements. In order for the existing landscaping to count towards screening requirements, please label and
dimension a 20 foot undisturbed buffer area along the entire expanse of the shared property lines to the north and the
east.
13d) [32.7.9.8] Tree Canopy. The site shall have a tree canopy covering the minimum percentage of the site as
determined by the density of the development. Provide the required calculations as follows.
If the site is to be developed for residential uses at a gross density of twenty (20) dwelling units per acre or more, the
minimum tree canopy is ten (10) percent. If the site is to be developed for residential uses at a gross density of more
than ten (10) but less than twenty (20) dwelling units per acre or more, the minimum tree canopy is fifteen (15)
percent. If the site is to be developed for residential uses at a gross density of ten (10) dwelling units per acre or less,
the minimum tree canopy is twenty (20) percent.

19. [32.5.2(n)] Proposed improvements. Depict, label, and dimension the trash receptacles. Final: comment
addressed; however, for maintenance purposes it is recommended/suggested that the recreation area not
contain individual trash receptacles but instead utilize a single dumpster.

21. [ZMA2005-09 Proffer #41 Prior to final site plan approval provide a trail detail. Utilize the design standards for
a Class B —primitive trail (see below). Also, depict the entire network of trails within this portion of the primary
recreation area. Currently the trail ends in an arrow below the stormwater management facility. Clarify where this
portion of trail is connecting. Final: Comment addressed. It is recommended/suggested that the pedestrian
trail not be continued around the stormwater management facility.
22. [Comment] The WPO application must be approved prior to final site plan approval. Final: comment still
relevant.

24. [ZMA2005-09 Proffer #41 The primacy recreational area shall be built or bonded.for its construction prior to
final plat approval of phase 4. This recreational area shall be built prior to completion of Phase 4...

25. [Comment] Revise the title of the site plan to include SDP2016-45.

RWSA has reviewed the Final Site Plan for the Briarwood Recreational Area as prepared by Collins Engineering and dated
8/1/2016, and consents to the proposed construction as shown. All changes to the proposed work from that shown in
the drawings shall be approved by RWSA in writing prior to construction. RWSA reserves all rights associated with its
easements, including but not limited to its rights to access, construction, operation, maintenance, and repair of its
facilities within the easements, and such consent shall not be construed to modify or prohibit any existing easement
rights held by the RWSA, nor modify or increase its obligations, if any, to repair or restore.
