Dear Mr. Kelsey:
In response to your request for a Letter of Zoning Compliance for the above referenced
Property, we have examined our records with respect to the parcels of land in Albemarle
County, Virginia identified above. Please be advised of the following:
The Property lies within the boundaries of Albemarle County and is zoned RA, Rural
Area (See attachment). Section 10.2.1 of Chapter 18 of the Albemarle County Code
("Zoning Ordinance") allows detached single-family dwellings and divisions of land in
accordance with section 10.3 as by -right uses. Section 10.3.3 outlines the applicable
regulation for Property to be divided as a Rural Preservation Development. The Property
is subject to the Steep Slopes Overlay Districts as described in Section 30 of the Zoning
Ordinance. See link to County Code below.
Development of the Property per the attached plat as a Rural Preservation Development
must be reviewed for compliance with Subdivision, Zoning and Water Protection
Ordinance requirements. This letter cannot state that the attached plat meets these
regulations; only review of the proposal with an official application for subdivision may
accomplish this. Review of a subdivision application must be submitted to the
Department of Community Development.
• Development of the Property with single-family dwellings will require two (2) off-street
parking spaces per dwelling unit.
• The Property is not subject to certain proffered conditions or other special limitations
imposed by the County, but is only subject to those applicable regulations outlined in the
Subdivision (Chapter 14), Zoning (Chapter 18) and Water Protection (Chapter 17)
Ordinances.
