HomeMy WebLinkAbout1978-05-22NMay 17, 1978 (Regular-Night Meeting) Ma~ 2~ 1978 (Night-Adjourned from May 17, 1978) Mr. Massey Jarman, a resident of Crozet near the proposed site, expressed his concern for the amount of sight distance. He suggested some of the money saved on the parking area be placed into widening the road for a left-turn lane. Mr. Conway Stanley asked if the internal road will be accepted by the State Department of Highways and Transportation even if it does not meet sight distance standards. Mr. Roosevelt said it would not be accepted by the State if it does not meet all requirements, as in the case of any other road. Mr. Richard Moyer said a left-turn lane would help save lives, especially for the older citizens who would be living there. Mr. David Kudravetz, representing the Jordan Development Corporation, said his client felt sure this new site was the proper location. They also had minimum funds for site improvements, and felt this was the best use of the funds. Mr. L. C. Staley said the opinion of a State Trooper should be sought in this situation. Mr. Fisher replied that since the County does not have a Highway and Transportation Depart- ment, they depend on the Virginia Department of Highways and Transportation for opinions in all road matters. Mr. Roosevelt said he wished to clarify his opinions for the Board and citizens. He noted that many improvements could be made to the area which would improve the safety aspect at the entrance. He added that such improvements would be far in excess of the requirements set as standards by the Virginia Department of Highways and he would not be able to require those type of improvements. No one else from the public wished to speak. Mr. Fisher noted that in order to change the approval set by the Planning Commission, it requires affirmative action by the Board. If no such motion is approved, the conditions of the Planning Commission wil~ s~and as approved. Mr. Lindstrom said based on the expert opinions of the State Department of High- ways, he sees no reason to change the conditions as adopted by the Planning Commission. Mr. Dorrier said he also supported the Planning Commission. Mr. Henley said he was in favor of a third, turning lane, but felt there was no such support among ~he Board members. No motion was offered by any Board member, therefore the conditions of approval set by the Planning Commission stand approved. At 9:26 P.M., motion was offered by Mr. Lindstrom, seconded by Dr. Iachetta, to adjourn this meeting to May 22, 1978, at 7:30 P.M. in the Albemarle County Courthouse. Lindsay G. Dorrier, Jr., Gerald E. Fisher, F. Anthony Iachetta and C. Timothy Lindstrom. Absent: Messrs. J. T. Henley, Jr. and W. S. Roudabush. Officers present: Messrs. Guy B. Agnor, County Executive and George R. St. John, County Attorney. Agenda Item No. 1. Call to order. The meeting was called to order at 7:35 P.M., by the Chairman, Mr. Fisher. Agenda Item No. 2. Public Hearing: Leash Law in Oakhill Subdivision. (Advertised in the Daily Progress an May 8 and May 15, 1978.) Mr. Fisher reported receipt of two petitions, one containing 48 signatures, and the other containing 16 signatures, request- ing the leash law be applied to Oakhill Subdivision. Mr. Fisher opened the public hearing, requesting those in favor of the leash law to speak first. First to speak was Mr. Hugh Underwood who said he ~as been a resident of Oakhill since 1969. He said the dogs have been damaging his property and annoying his small child. He also said many animals have been killed on the highway which is only a few hundred yards from his home. Mrs,. Dorothy Underwood said she took the petitions around. She said the ~ogs have been ruining gardens and destroying shrubs. Mr. John Critzer said he had a cat killed by a pack of dogs~ and it could have been a child. Mr. Don Harper said he was opposed to the enactment of the ordinance because he moved to the County so his animals could run free. May 22, 1978 (Night-Adjourned from May 17, 1978) No one else from the Oakh~ll Subdivision wished to speak either for or against th~s petition, and Mr. Fisher declared the pubIic hearing for 0akhill Subdivision closed. Agenda Item No. 2. Public Hearing for~ ~eash Law at Westgate and Solomon Court Apart- ments. (Advertised ~n the Daily Progress on May 8 and May 15, 1978.) Mr. Fisher requested people in £avor of the leash law to speak first. Mr. Scott Brown said many dogs are attack trained. He noted that he is the resident manager of the Solomon Court Apartments and he cannot even get into the buildings because of these dogs~. Ms. Gail Tenhoopen said she is a resident of Westgate Apartments, and agrees with Mr. Brown that many of the dogs running free are very dangerous. Ms. Earleen Anthony said she was afraid of most of the dogs, but w~shed to note that many of the dogs running free are not owned by residents of the Westgate Apartment complex. Ms. Garnett G. Ogden said she could not remember ever seeing a pack of dogs running loose in the apartment complex. She said the county would put their money to better use if they enforced the purchase of tags and rabies shots. Mr. Fisher noted receipt of a letter from Mrs. Ogden not to enact the leash law in the Westgate, Solomon Court areas. No one else wished to speak, and Mr. Fisher declared the public hearing closed for the Westgate, Solomon Court areas. Mr. Agnor reported that for the 750 square mile area of Albemarle County there are only two Dog Enforcement Officers. H~ said their priority of enforcement is to first appre- hend a dog that has maimed or killed an animal; second is the leash law area; and finally enforcement of the rabies program. He noted that the fees for licensing do not support the operation of animal control. Mr. Agnor said the State controls the limit for fees charged for licensing of dogs. Mr. Fisher said the possibility of hiring an additional dog wa~den or increasing the fee for licensing would have to be taken up at some later time. Mr. Lindstrom asked how many homes are in the Oak~ill Subdivision and how many were in favor of adoption of the law. Mrs. Underwood said there are 52 houses, and approximately 60% w~re in favor of enacting the law. Motion was then offered by Mr. Dorrier to adopt the following ordinance: BE IT ORDAINED by the Board of Supervisors of Albemarle County, Virginia, that Chapter 4, Article II, Division 2, Section 4-19 of the Albemarle County Code be amended and reenacted by the addition of the following area as one of those areas where dogs are prohibited from running at large: (17) Oak Hill Subdivision as platted and recorded in the office of the clerk of the circuit court in Deed Book 360, page 105; Deed Book 362, page 22; Deed Book 391, page 483; Deed Book 396, page 291; Deed Book 398, page 317; Deed Book 401, page 228; Deed Book 405, page 433; Deed Book 441, page 299; Deed Book 468, page 85. The motion was seconded by Dr. Iachetta and carried by the following recorded vote: AYES: NAYS: ABSENT: Messrs. Dorrier, Fisher, Iachetta and Lindstrom. None. M~ssrs. Henley and Roudabush. Mr. Lindstrom and Dr. Iachetta asked if residents of Westgate and Solomon Court Apart- ments w~re notified of the 'management's request to have th~s Ordinance adopted. Ms. Gall Tenhoopen said a notice was circulated throughout the comple~es, the wording of which was received from the C~rk to the Board. She also noted that of those tenants she spoke to, most were in favor of its enactment. Motion was offered by Mr. Lindstrom, seconded by ~. Public Hearing: Six-Year Highway Plan, (Notice of public hearing for the purpose of presenting a budget for the expenditure of improvement funds for the Secondary Highway System for the 1978-79 Fiscal Year was given in the Daily Progress on May 8 and May 15, 1978.) Mr. Fisher said Mr. Dan Roosevelt of the Virginia Department of Highways and T~ns- portation was present. He has prepared a budget priority list of secondary road improvements in cooperation with Mr. Robert Tucker, County Planner. Mr. Roosevelt said the presented budget totals $1,425,352. Mr. Roosevelt then proceeded to describe roads on the list and funds required to complete the projects. Mr. Fisher declared the public hearing opened, and first to speak was Mr. Wilson Croft who lives on Route 608, He requested that the three mile section between Route 729 and 705 be improved. Mr. Dorrier ~mted receipt of a letter from Mr. Walter L. Rice, a reSident of Richmond, requesting this same stretch of road be paved. Mr. Roosevelt said if all the right-of-way can be obtained, then it will be placed on the priority list ~or paving. Mr. Goode Love said the present roads should be better maintained by the Highway Department before more roads are built. ROute 627 Mr. Wade Cromer requested that the road/be completely finished between Routes 7~ and 7@$~ beyond Carters Bridge. He said the traffic count on Route 727 is greater than on Route 708 and should be completed first. Ms. Jane Patterson said Route 727 is very dusty and is a health and traffic hazard. Mr. Roosevelt said this road has been on the priority list for about four years, and he has not been able to obtain the necessary right-of-way to.~egin the project. He added that there is about $38,000 reserved for this road project, and that he will continue trying to convince landowners to donate the needed right-of-way. Dr. E. Richard Browntee requested Dr. Iachetta to read the following letter: "May 22, 1978 The residents of the Bedford Hills Subdivision respectfully request that the Albemarle County Board of Supervisors approve the proposed sight distance improvements as suggested by the Department of HighWays, in order to create a safe and adequate intersection onto State Route 743. The residents of the subdivision are willing to make the necessary improvements to the extension of the existing median, which is off of the state right-of-way. We, the residents, feel that this is a very critical safety requirement. Critical to the extent that there have already been several accidents, but no deaths, and the cost of these improvements seems very small compared to a human life. We appreciate your consideration and trust you will look favorably upon our request. Very sincerely, RESIDENTS OF BEDFORD HILLS (signed) Dr. E. Richard Brownlee (signed) O. W. Smith, Jr." Dr. Iachetta said he spoke with Mr. Roosevelt, and after his investigation of the site, Mr. Roosevelt agreed that most of the trees causing the obstruction were located within the State owned right-of-way. He estimated the cost 02 this.~mp~e~e~ to be approximately $3,000. Mr. Dorrier said he endorsed the maintenance of Route 727 and Route 717. He said on Route 717, right-of-way has been obtained on the southern half. Mr. RooseVelt said this could be a valid project if the traffic count jumps to a higher level, or if some other project falls through. Dr. Iachetta requested the traffic count on Route 743 near Bedford Hills. Mr. Roosevelt said it was approximately 1,555 per ~ay. ~. Brownlee presented some photographs showing the sight distance problemnon this road. Mr. Roosevelt suggested this be included ink,he six-year plan as possibly number 25A for spot improvements. Dr. Iachetta offered motion formally making this request for improvements. Mr. Fisher said this would be part of the six-year plan, and could not be adopted separately. Dr. Iachetta then offered motion to adopt the first year's budget of the Six-Year Highway Plan as presented this evening, said budget to include the Bedford Hills sight distance problem (Route 743); bringing the total cost of the budget to $1,428,352. May 22, 1978 (Night-Adjourned from May 17, 1978) 1978-79 Secondary Budget Priority List Albemarle County 1. Route 795 from Route 53 to 1.05 miles south of Route 53; $21,000. Route 601 from Rmute 676 to Route 654; $55,400. Route 743 from Route 660 to Route 663; $12,100. These three locations are to be plant mixed this year. The three routes have been advertised and bi.ds were received in early April. The allocations are necessary to finance this work. 2. Slurry Seal Schedule; $54,000. This allocation covers the resurfacing of approximately 6.20 miles of road. The roads are located in the Canterbury Hills Subdivision, Hessian Hills Subdivision, Westmoreland Subdivision, Woodbrook Sub- division, Berkeley Subdivision, and the Four Seasons Subdivision. The appli- cation of a slurry seal is characterized by the Department as an improvement when placed on a surface treated roadway. An advertisement of the roads to be surfaced in the above subdivisions has been made by the Department. This allocation will finance this work. 3. New Traffic Service; $6,000. This allocation matches the current year's allocation and will be used to finance the installation of new signs, and traffic signals which are installed during the coming year. 4. InsSallation of New Pipe; $10,000. This allocation is an increase over the current year's allocation of $7,000. This money will be used for the installation of new pipes in driveway entrances and across roadways. This allocation will allow us to increase the amount of this work we do during the coming fiscal year. 5. Seeding and Fertilizing; $10,000. T~ii allocation is an increase over the current year's allocation o~'$3,000. With the County's emphasis on the protection and improvement of the 'Rivanna Watersha~,[~ an increased emphasis on seeding and fertilizing of highway cut and fill slopes will be undertaken. 6. Surveys and Preliminary Engineering; $1,000. This allocation is the same as set up in the current year's budget. This money will be used for surveys or other preliminary work on projects not budgeted during this fiscal year. Such projects are usually financed in the next fiscal year. 7. New Additions; $20,000. This ~mount of money has been set up each year for the past few years to finance improvement of new additions to the secondary system in accordance with the Code of Virginia. 8. Route 621 at the C & 0 Railroad; 1.4 miles south of Route 29; $40,000. This allocation will finance the installation of flashers 'and gates at this railroad crossing. Thi's work has been completed by the''railr0ad and this allocation will cover thi's cost. 9. Route 689 from Route 250 to Route 688; $117,000. This project is under construction and was partially financed in the 1976-77 fiscal year. This allocation will complete financing on this project. The project should be completed during the current construction season. [U10.~,~oRoute 631 from Route 29 to Route 743~ $10,000. This is the improvement of Rio Road from Route 29 to Hydraulic Road. This is the initial allocation to this project and will allow preliminary engineering work to begin. 11. Route 656 from Route 743 to R~m~e 654; $10,000. This is Georgetown Road from Hydraulic Road to Barracks Road. This is the initial allocation'to this project and will allow preliminary engineering work to begin. 12. Route 651 over the Southern Railroad tracks; .05 miles east of Ro. ute 1428; $10,000. This is the initial allocation to this project and will allow work on the preParation of bridge plans to begin. 13. Route 631 at Meadow~zCreek and the north corporative limits of Charlottes- ville; $70,'.697.' T~s proj.'e.ct ~i~ the ~eplacement of the' Park Street bridge. Route 631 from the no~th corporative limits of Charlottesville to the Southern Railroad ~racks; $25,00.0. This is the' improvement of Rio Road popularly known as the McIntire Extension. This allocation will allow prelimi- nary engineering work on this project to continue. 15. Route 601 at the intersection with ~Route 658; $8,000. This allocation will be used to improve this intersection probably by the' addition of a turn lane along Route 601. 16. Route 1309 from Rmute 6 to Mink ~reek; $5,00.0... Surface treat this street at its current width and alignment. This street acts. as a connection betWeen Route 6 and Route 20 in the Town of Scottsville and is heavily used during flooding situations. 17. Route 811 at Watts Branch; $10,000. Place additional pipe in the creek and construct a concrete apron to form a low water bridge. Surface treat the approaches. 18. Route 672 from Route 810 to 0.2 mile east of Route 810; treat the approaches to the creek at this location. $4,000. Surface May 22, 1978 (Night-Adjourned from May 17, 1978) 284 19. Route 614 from the end of hard surface to Route 674; $12,000. This 0.3 of a mile section of road is difficult to maintain in a gravel state. This improvement will reduce maintenance cost and improve surface. 20. Route 697 from Route 29 to 0.2 miles west of Route 29; $10,000. Stabilize and surgace treat this section of road. The steep grade on this road as it approaches Route 29 makes it difficult to keep this roadway adequately maintained. This work will reduce maintenance cost and improve service. 21. Route 810 from Route 674 to the Moormans River; $12,000. This section of roadway is rough and needs additional stabilization. This improvement will add base atone to this section and finance resurfacing of the roadway. 22. Route 640 at .4 miles south of Route 641 and at .5 miles west of Route 20; $7,000. This allocation will finance the installation of additional pipes at two locations wh~re flooding frequently occurs. 23. Route 746, 0.4 miles east of Route 807; $5,000. This section of gravel road remains in an mnstable condition due to lack of adequate drainage. This allocation will allow the construation of a ditch along the edge of the road. A section of roak will be encountered and will require blasting. 24. Route 668 - 0.2 miles east of Route 671; $3.000. This allocation will allow the installation of an additimnal pipe at a location which frequently floods. 25. Route 734 - 0.1 miles west of Route 795; $2,000. This allocation will allow the installation of an additional pipe at a location which frequently floods. 26A. Route 743 at the entrance to Bedford Hills Subdivision; To improve sight distance at this intersection. $3,000. 26. Route 708 from Route 710 to 1.3 miles north of Route 710; $154,000. This allocation will finance the widening and hard surfacing of a gravel road. This improvement is dependent upon obtaining donated right of way. 27. Route 643 from .5 miles west of Route 29 to 1.3 miles west of Route 29; $37,500. This allocation will complete financing of this improvement. Previous financing is sufficient to allow the Department to begin construction. 28. Route 601 from Route 810 to the Greene County line; $122,500. This allocation will complete financing on this project. Previous financing is sufficient to allow the Department to begin construction on this project. 29. Route 731 - .2 miles south of Route 22; $40,000. This allocation will finance the installation of a flashing signal and gates at the rail- road crossing at this location. 30. Route 719 from Route 715 to Route 716; $107,000. This allocation will finance the construction of this improvement. The improvement is the hard surfacing of a gravel road. Right of way has been obtained. 31. Route 708 from 1 mile east of Route 795 to Route 795; $125,000. This allocation will finance the completion of the hard surfacing of this route between Route 627 and Route 795. This improvement is dependent upon donated right of way being obtained. 32. Route 665 Bridge and approaches to Buck Mountain Creek; $69,155. This allocation will complete financing on this project. Sufficient allocations have previously been made to finance the start of this construction. The project was advertised for construction in April 1978. 33. Route 633 - Bridge and approaches over the Hardware River; $70,000. This allocation will finance the construction of this bridge and the approach work. This work is dependent upon obtaining donated right of way. 34. Route 601 - Bridge and approaches over Mechum River; $150,000. This allocation will complete financing for this improvement. Sufficient allocations have been made previously to finance the start of construction. It is anticipated that this project will go to construction in late 1978. Agenda Item No. 5. Authorize Chairman to sign Subdivision Plat for The Meadows. Mr. St. John presented the plat for The Meadows property, located on State Route 240, north of U. S. Route 250, dated May 11, 1978, certified by R. W. Snow; and requested a motion authoriz ing the Chairman or County Executive to sign same. Motion was offered by Mr. Dorrier authorizing the Chairman to sign the plat for the County as owner. Not Docketed: Mr. Fisher said he has been unable to attend meetings of the Area V Manpower Planning Council and requested that Mr. Rona~d C. Gordon be nominated to fill his position. Mr. Dorrier presented a petition, with 56 names, stating "We, the undersigned, tax- paying citizens of the Esmont community of Albemarle County, request that lights be installed on the north and south sections of Route 627. We feel certain that you will approve this request, as the central part of our community has already been supplied, and hope that you will give this your immediat~ attention." Mr. Fisher suggested a recommenda- tion be obtained from the Engineering staff. Mr. Agnor took the petition, and said he would pass it along to the County Engineer for his study and recommendation. Dr. Iachetta reported that Mrs. Mary Jo Ayres has tendered her resignation from the Board ~ffThe Piedmont Virginia Community College because she is moving from the County into the City of Charlottesville.
