Merrill's Residence - Rural Subdivision The County of Albemarle Planning Division will grant or recommend approval of the Final Plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] 1. [14-302 (A)(1)] Name of subdivision. The name of this subdivision plat is identical to the one used in SUB2016-100. Revise the title of this plat to be unique. Rev. 1: Comment Addressed. 2. [14-302 (A)(10)] Right of further division of proposed lots. Revise the development rights note. Incorporate language specific to the "31 acre" rule. I have also attached the Citizen's Guide to Development Rights which discusses the "31 acre" rule. I have included one possible wording below with the underlined portions being the portions that are somewhat flexible. The underlined quantities are based upon the fact that 31 acres being divided by 5 development rights would equal 6.2 acres per development right. However, the smallest lot allowed for a parcel using a development right is 2 acres, as long as the proposed parcel meets all other requirements of the County Subdivision Ordinance and Code. It might be helpful to meet and discuss your options for this wording. One possible way to word the note is "TMP 84-44 retains 3 development rights and may be further divided and when further divided these rights shall not comprise more than 18.64 acres. Parcel Y is assigned 1 development right and may be further divided and when divided these rights shall not comprise more than 6_2 acres. TMP 84-53 retains 4 development rights and may be further divided and when further divided these rights shall not comprise more than 28.12 acres. Parcel D is assigned 1 development right and may not be further divided. No development rights will transfer with Parcel E." Please see the comments for SUB2016-100, sent to you on this same date, to reference the development rights and "31 acre" rule values for TMP 84-44 prior to changes proposed in this subdivision plat. Rev. 1: Comment Addressed. However, please ensure that the two remaining development rights for TMP 84-44 will be sufficient to meet the needs of all future subdivisions that are now planned including the two subdivisions discussed in our 1/23/2017 Pre -Application meeting. 3. [14-302 (A)(11)] Instrument creating property proposed for subdivision. This subdivision is based upon the subdivision proposed in SUB2016-100 already having been approved and recorded. Therefore, this plat will not be able to be approved until SUB2016-100 is approved. Also, recordation of the plat for SUB2016-100 should take place prior to recordation of this plat and the Deed Book and Page number for the plat from SUB2016-100 should be included under the other Deed Book and Page references in note 1. Provide "Deed Book Page " in that location so that the book number and page can be written on this plat prior to its recordation. Rev. 1: Comment not fully addressed. SUB2016-100 not only created Parcel "X" but it also modified the acreages of TMP 84-44 and TMP 84-53. Therefore, "(Pcl "X" )" next to the blank deed book and page number in Note 1 should either be expanded to specify that the newly recorded plat (SUB2016-100) also impacted TMP 84-44 and TMP 84-53 or replace "(Pcl "X")" with "(plat)" to match how plats are specified in other locations on the plat. 4. [14-302 (B)(1)] General Information. Include a date of last revision on the plat. This date should be updated prior to each resubmission. Rev. 1: Comment not fully addressed. Update the plat so that the most recent revision date, for the next resubmission, is added. 5. [14-302 (B)(10)] Stream Buffers. Include the stream buffers in the plat. The stream buffer in the northwest corner of Parcel Y appears to be missing. Rev. 1: Cornment Addressed. 6. [14-303 (A)] Statement of consent to division. All parcels affected by this plat need to be listed in the statement. Parcels TMP 84-44, TMP 84-53, Parcel "D", Parcel "E" and Parcel "Y" must be mentioned in the note. Rev. 1: Comment not fully addressed. No change to Parcel "X" is taking place with this plat. Therefore, it should not be referenced in the statement of consent. Instead "Y" should take the place of "X" in the statement. "D" and "E" are also portions of existing parcels. Revise statement of consent to state "...(Parcel "Y" and "E" being a portions of TMP 84-44, Parcel "D" being a portion of TMP 84-53, TMP 84-44 and TMP 84-53)..." or contact the plat reviewer to discuss wording that you consider to be more appropriate. 7. [14-303 (D)] Acreage of lots. Revise the parcel lot sizes in the calculation of the size of TMP 84-44. Parcel "D" in that calculation is not the same size as shown elsewhere on the plat size and also it appears it should not be added to TMP 84- 44 at all. From the plat it appears Parcel "Y is actually being added to Parcel "Y". Please clarify and update the quantities as appropriate. Rev. 1: Comment Addressed. 8. [14-309; 14- 310] Soils evaluation; Health Director Approval. Provide Health Department approval for the drainfields or submit soils work for Parcel "Y". Approval by the Health Department is required before approval the subdivision. The "Water Supply and/or Sewage Disposal System Construction Permit" submitted with this plat appears to be for TMP 84-44A. Rev. 1: Comment Addressed. 9. [NEW Comment] Revise the acreage of TMP 84-53. The acreage of TMP 84- 53 shown on this plat does not appear to reflect the changes what will be made once the plat for SUB2016-100 is recorded. This plat (SUB2016-182) is to be recorded after the plat for SUB2016-100 is recorded. Therefore, the initial acreages of the parcels on this plat must reflect the acreages shown as the consequence of that other plat. SUB2016-100 shows TMP 84-53 as containing 159.534 acres. Either update this plat to reflect the acreages shown in the plat for SUB2016-100 or contact the plat reviewer to discuss what you consider to be the correct acreages for that parcel. Note that SUB2016-100 is ready for signatures.
