H. Moore Dear Mr. Keeler: With reference to "Pinehaven" , the owner wishes to construct another duplex on the property under a bonus plan. Please find attached an Agreement between the Omer and The County of Albemarle concerning the bonus plan under Section 16.4.3 of the Albemarle County Code. I have submitted this Agreement to Mr. Fred Payne, Assistant County Attorney, and he has approved it. I have since applied for a building permit. If you should have any questions, please let me know. Sincerely, JOHN B. MOORE, BUILDER JBM/sbs enclosure THIS AGREEMENT, made and entered into this 14th day of April, 1986, by and between JEROME H. MOORE, party of the first part, and the COUNTY OF ALBEMARLE, VIRGINIA, party of the second part, WITNESSETH : WHEREAS, Jerome H. Moore is the owner of certain real estate in the County of Albemarle, Virginia known as Pinehaven located on Rio Road and shown on Tax Map Sheet 62A1-02 as Parcel 7; and WHEREAS, Jerome H. Moore desires to obtain from the County of Albemarle, Virginia, a density increase of 30% for the development of said property pursuant to Section 16.4.3 of the Albemarle County Code; NOW THEREFORE, Jerome H. Moore agrees as follows: a) At least 30% of the number of units achievable under gross density-standard level shall be and have been developed as' low or moderate cost units; and b) The initial sale price for sale units or the rental rate for a period of five (5) years from the date hereof for rental units shall qualify as low or moderate cost housing under either the Virginia Housing Development Authority, Farmer's Home Administration or Housing and Urban Development, Section 8; and c) The rental rates of the low or moderate cost units for a period of five (5) years or until the units are sold as low or moderate cost units, whichever comes first, shall be restricted to $415.00 per month for a two (2) bedroom unit with such increases from time to time as shall be agreed upon by the County of Albemarle This Agreement shall not be effective until such time as a building permit is issued for the construction of an additional duplex unit on said property.
